Th e dream of a constitution through an elected CA was envisaged in the 1950s but it was only in April 2008 that the country elected its fi rst Constituent Assembly (CA-I) to draft a constitution. Although the CA-I was not successful in drafting a constitution, it completed a signifi cant amount of work which was largely endorsed and owned by the second Constituent Assembly (CA-II) within the fi rst six months of its mandate. VII Th e CA-II faced a number of challenges between its election and promulgation of the constitution, including the April and May 2015 earthquakes, negotiations with Madhes-based and Th aru political parties on provincial demarcations and responding to concerns registered by Indigenous and ethnic communities as well as women activists, on the issues of inclusion, representation and equality. Not all of these concerns were refl ected in the provisions of the new constitution leading these groups to register strong dissents and express discontent. Th e strongest and most concerning expression of discontent came from the Madhes-based political parties whose elected members did not participate in the meeting of the CA-II which endorsed the constitution, the signing of the statute nor its promulgation. More troubling were the resultant protests and violence in the Terai which continued to escalate even after the promulgation of the constitution, and which claimed the lives of more than forty Nepali citizens and security forces personnel. Th is report provides an overview of Nepal’s peace and constitution building processes describing the incredible gains made by national actors and highlighting the important role played by the international community. International actors have supported Nepal’s transition to peace and its eff orts to conduct successful elections. In addition, they have provided necessary infrastructure and administrative support, capacity building and technical expertise to the CA’s elected members, Committees and Secretariat. Moreover, they have also provided capacity building and technical expertise to political parties and civil society organizations representing the interests of women and historically disadvantaged groups. Now that Nepal has promulgated its constitution, the challenge will be its implementation. Th e international community greeted the statute cautiously, expressing concerns with the escalating violence in the Terai and stressing the need for the government to respond to the outstanding issues through dialogue with disaff ected groups. Th e government has stated that it is willing to continue discussions and emphasized that the constitution can be improved to address concerns through subsequent amendments. Th e stability of Nepal’s polity will be dependent on the government’s immediate actions in this regard and we anticipate the international community’s continued commitment to support all eff orts to ensure a durable constitution with broad-based acceptance. INTRODUCTION Th e idea of a Constituent Assembly (CA) in Nepal dates back to the 1950s when the country was, for the fi rst time, entering into democracy, after the end of 104-year old autocratic Rana rule. However, it was not until fi fty-eight years later that Nepal started drafting a constitution through an inclusive and participatory CA after the election of the fi rst CA (CA-I) in 2008. With the promulgation of the new Constitution in 2015, Nepal moved from a unitary form of government to a federal one with a strong focus on decentralization based on “cooperative federalism”. The new federation has three tiers of government, namely federal, state and local, whereby powers shall be exercised pursuant to the Constitution and the state laws. The Constitution has assigned both exclusive and concurrent powers, to be jointly exercised by the federal and the state levels or jointly by all three tiers of government. The jurisdiction of the local governments is outlined under Schedule 8 of the Constitution, which establishes that local governments are responsible for development activities and for mobilizing the necessary resources to carry out such activities.

While studies on democracy promotion, to this day, mainly focus on Western “donors” and international organizations, this paper looks at the role played by India in the complicated process of moving from a peace agreement to the establishment of an inclusive, democratic constitution in Nepal. More specifically, it is analysed how a powerful neighbouring democracy (India) participated in what is essentially a domestic negotiation process (constitution-making) with a view to influencing the emerging demo- cratic regime. In terms of the issues on the negotiation table, the analysis shows that India, in pushing for an inclusive constitution, pursued the specific agenda of supporting the inclusion of the Madheshis, an ethnic group mostly living in Nepal’s Terai region. In terms of negotiation strategies, the paper identifies four different ways in which India tried to influence the constitution: high-level dialogue; economic blockade; international coalition building; and targeted support of domestic oppositional forces in Nepal. Com- prehensive as this negotiation strategy was, it only met with partial success. Parameters that limited India’s influence included the domestic strength and legitimacy of the official Nepali position (elite alignment; popular support) as well as scepticism concerning In- dia’s role in Nepal, which was reinforced by India’s overly partisan agenda.

INTRODUCTION In April 2006, there was a country-wide people’s movement in Nepal, popularly known as the Jana Andolan II,2 against King Gyanendra’s direct rule3 following a 12-point understanding reached between the Seven Party Alliance4 and the Communist Party of Nepal (Maoist), which was leading a communist insurgency against the state. The 19-day-long Jana Andolan II5 (People’s Movement II) ended direct rule by Gyanendra, forced him to return power to the reinstated parliament, and created a conducive environment for the signing of the Comprehensive Peace Agreement (CPA) between the government and the rebel Maoists in November 2006. The success of Jana Andolan II in thus ending the decade-long conflict that had affected all parts of the country has thus been hailed by many as being exemplary of the ways in which engaged citizenry and communities at the local level can have an impact on the resolution and transformation of violent conflict at the national level.

The available sources indicate that the municipality of Bharatpur and the surrounding district of Chitwan have been affected by the Maoist insurgency. There have reports of violent incidents in Bharatpur itself, which is the main centre of Chitwan district, but it has reportedly not been as affected as some of the outlying villages of Chitwan. A map of Nepal is attached for the Member’s information which has Bharatpur marked (‘Bharatpur, Nepal’ 1999, Microsoft Encarta – Attachment 1). A 2005 Research Response examined the presence of Maoist insurgents in Chitwan, but does not mention Maoists in Bharatpur.
