Therefore, this paper was an attempt to investigate gender dimensions in the emerging African genres; a case study of local hip hop songs in Kenya. It discussed the extent to which hip hop language is gender biased. It focused on the popular local hip hop songs and video images that occur with the songs. The study used the Social Semiotic Theory in the theoretical framework. Ten hip hop songs and ten video excerpts were purposively selected for analysis. The hip hop songs were coded according to the name of the artist and year of production. The data was analyzed under three sections: Linguistic analysis, Image analysis and Gender analysis. The study revealed that indeed there is gender bias in the language of the favourite youth culture. This was revealed in the lexis that distinguishes gender, in the syntactic analysis and also in the image analysis. It was found that in hip hop music, men tend to be regarded higher in terms of roles, occupation and general human traits like strength and control than women. The study therefore recommends that radio and television stations, and other advertising agencies should join the battle for women liberation by using gender sensitive language and focusing on positive and constructive societal changes in terms of gender roles. -

Kyoto University Southeast Asian Studies, Vol. 39, No. 4, March 2002 Modeling the State: Postcolonial Constitutions in Asia and Africa* Julian GO** Abstract This essay examines the independence constitutions of Asia and Africa in the twentieth cen- tury through a macro-comparative lens. The examination focuses upon the intra-imperial isomorphic thesis which proposes that newly independent countries, in formulating their constitutions, merely imitated the constitutional form of their former mother country. I find that while independent constitutions indeed imitated the constitutions of their former moth- er country, this mimicry was neither universal nor whole scale. It occurred foremost in terms of the constitutional provisions for governmental system. Conversely, at least half of the independence constitutions in Asia and Africa had provisions for religion, rights, and/or political parties that ran counter to the constitutional model of the former mother country. These countervailing tendencies to the logic of intra-imperial isomorphism reveal crucial trans-imperial influences on the making of modern postcolonial constitutions. Introduction The decolonization of Asia and Africa since WWII appears at once as a novel and yet banal historical process. On the one hand, it was an intensified moment of state-building and frenzied constitutional activity. As the Western empires crumbled, they left behind a mul- titude of nascent states each seeking to institute a new constitutional order. The number of these new states, and especially its impact upon the configuration of the global political map, is staggering. In 1910 there were 56 independent countries in the world. By 1970, after the first major wave of decolonization, the number had increased to 142. -

With the promulgation of the new Constitution in 2015, Nepal moved from a unitary form of government to a federal one with a strong focus on decentralization based on “cooperative federalism”. The new federation has three tiers of government, namely federal, state and local, whereby powers shall be exercised pursuant to the Constitution and the state laws. The Constitution has assigned both exclusive and concurrent powers, to be jointly exercised by the federal and the state levels or jointly by all three tiers of government. The jurisdiction of the local governments is outlined under Schedule 8 of the Constitution, which establishes that local governments are responsible for development activities and for mobilizing the necessary resources to carry out such activities. -

While not attempting to make a comprehensive compendium of each and every constitution building process in 2013, the report focuses on countries where constitutional reform was most central to the national agenda. It reveals that constitution building processes do matter. They are important to the citizens who took part in the popular 2011 uprisings in the Middle East and North Africa seeking social justice and accountability, whose demands would only be met through changing the fundamental rules of state and society. They are important to the politicians and organized interest groups who seek to ensure their group’s place in their nation’s future. Finally, they are important to the international community, as peace and stability in the international order is ever-more dependent on national constitutional frameworks which support moderation in power, inclusive development and fundamental rights. Saif Pardawala 12/7/2012 TRC Cradock Four Amnesty Hearings Abstract: The Amnesty Hearing of the Truth and Reconciliation show the connection between the South African Apartheid state and the mysterious disappearances of four Cradock political activists. The testimonies of members of the security police highlight the lengths the apartheid state was willing to go to suppress opposition. The fall of Apartheid and the numerous examples of state mandated human rights abuses against its opponents raised a number of critical questions for South Africans at the time. Among the many issues to be addressed, was the need to create an institution for the restoration of the justice that had been denied to the many victims of apartheid’s crimes. Much like the numerous truth commissions established in Eastern Europe and Latin America after the formation of democracy in those regions, the Truth and Reconciliation Commission was founded with the aims of establishing a restorative, rather than punitive justice. The goal of the TRC was not to prosecute and impose punishment on the perpetrators of the state’s suppression of its opposition, but rather to bring closure to the many victims and their families in the form of full disclosure of the truth. The amnesty hearings undertaken by the TRC represent these aims, by offering full amnesty to those who came forward and confessed their crimes. In the case of Johan van Zyl, Eric Taylor, Gerhardus Lotz, Nicholas van Rensburg, Harold Snyman and Hermanus du Plessis; the amnesty hearings offer more than just a testimony of their crimes. The amnesty hearings of the murderers of a group of anti-apartheid activists known as the Cradock Four show the extent of violence the apartheid state was willing to use on its own citizens to quiet any opposition and maintain its authority. -

No. 43 Working Papers Working Negotiating Between Unequal Neighbours: India‘s Role in Nepal‘s Recent Constitution-Making Process Prakash Bhattarai December 2018 1 Negotiating Between Unequal Neighbours: India’s Role in Nepal’s Recent Constitution-Making Process1 Prakash Bhattarai ABSTRACT Nepal’s post-conflict constitution-making process has seen the involvement of many international actors. While studies on democracy promotion, to this day, mainly focus on Western “donors” and international organizations, this paper looks at the role played by India in the complicated process of moving from a peace agreement to the establishment of an inclusive, democratic constitution in Nepal. More specifically, it is analysed how a powerful neighbouring democracy (India) participated in what is essentially a domestic negotiation process (constitution-making) with a view to influencing the emerging demo- cratic regime. In terms of the issues on the negotiation table, the analysis shows that India, in pushing for an inclusive constitution, pursued the specific agenda of supporting the inclusion of the Madheshis, an ethnic group mostly living in Nepal’s Terai region. In terms of negotiation strategies, the paper identifies four different ways in which India tried to influence the constitution: high-level dialogue; economic blockade; international coalition building; and targeted support of domestic oppositional forces in Nepal. Com- prehensive as this negotiation strategy was, it only met with partial success. Parameters that limited India’s influence included the domestic strength and legitimacy of the official Nepali position (elite alignment; popular support) as well as scepticism concerning In- dia’s role in Nepal, which was reinforced by India’s overly partisan agenda. -

PREFACE A new Constitution for a new Nepal drafted and adopted by an elected and inclusive Constituent Assembly (CA) is a key element of the Comprehensive Peace Agreement (CPA) of November 2006 that ended a decade long Maoist insurgency.
