Lid, Legislative Assistant COUNCIL FILE NO. 10-1076: SURVEY FINDINGS FROM SCHOOL-PARKS SHARED USE STUDY The Department of Recreation and Parks (Depaliment) began its shared use relationship with Los Angeles Unified School District (LA US D) in 1967 with an agreement for the construction and operation of a pool at Venice High SchooL The pool was subsequently built by the City on LAUSD property. The Department cunently has 36 formal agreements with LAUSD through Joint Use Agreements (JUA) and License Agreements. An additional 199 school or park sites have a shared use relationship through a permit or an informal reciprocal agreement. Use fees have historically not been collected from or paid to LAUSD under these arrangements_ However, recent discussions with LAUSD have indicated that this may change in the future, as LA USD is considering a policy change that would impose use fees on the Department for use of non JUA related school sites. , Besides LAUSD schools, the Depmtment also has working relationships with private schools and independent · chmter schools not under LAUSD. Under normal circumstances, these schools are subject to the Department's Rates and Fees for their use of Department facilities. Some of these schools are located outside the City of Los Angeles but have chosen to utilize Depaliment recreational facilities due to their proximity to a particular park. As previously reported to the Arts, Parks, Health and Aging Committee (Committee) on June 14, 2011 and September 7, 2011 and to City Council on November 21, 2011, the Department's Partnership Division conducted a Citywide Study (Study) surveying and identifying all existing relationships between the Department and various schools. The Study helped update the Department's existing list of shared use sites, establish what activities were occurring at such sites and under what type of arrangement (JUA, permit, license agii'eement, or informal anangement). The Study resulted in a better understanding of cunent activities, challenges and/or issues associated with such relationships, so that action could be undertaken to make improvements. The Study identified 235 school and park sites where some kind of shared use anangement exists. Of the 235 sites, 32 are currently under JUAs and four ( 4) under License Agreements; 172 sites are used by schools (Chmter Independent schools, private schools and LAUSD); 160 are under Depaliment Permits and 12 arc undocumented, where the use is between a school principal and park director. The Department uses 27 schools of which 18 are permitted and nine (9) are informal. Schools located outside the City of Los Angeles that utilize Depmiment sites are also included in this Study. Exhibit B is a full roster of all schools and recreation centers under JUAs segregated by Council District, which includes details such as the school location, recreation center location, scope of shared use, date of execution and term, and hours of use. The Study also identified existing Prop-K funded JUAs at certain schools where the Depatiment has authorized access to the facility through a JUA. Historically, facilities related to these JUA's have been underutilizcd by the Department due to budgetary constraints. However, with such school sites identified, Department staff is now in discussions with LAUSD and local community organizations to expand public recreation opportunities at these sites through the Department's permitting process. In addition, the Department and LAUSD, with the involvement of the Mayor's Office, are presently in negotiations for two new joint use agreements related to the shared use for aquatics and recreation facilities at 1) South Region High School #12 and Green Meadows Recreation Center, and 2) South Region High School# 15 and Angels Gate Park. The Department continues to work with LAUSD to identify new sites where existing recreational activities may be enhanced or where new opportunities may be developed for the benefit and enjoyment of the pubhc. The Depatiment and LAUSD have been in long term discussions on the development of two master joint use agreements; I) a "Master Aquatics Agreement" which sets forth the general terms and conditions for city-wide joint use ofLAUSD and Department aquatics facilities; and, 2) a "Master Reciprocal Us'eAgreement" which sets forth the general terms and conditions governing local reciprocal use anangements between a school ptincipal and park director.
