The Public Payment of Magistrates in Fourth-Century Athens David M. Pritchard HAT THE ATHENIAN DEMOCRACY did not give magi- strates misthos, pay, in the fourth century B.C. has long T been argued by M. H. Hansen. This article questions his argument and makes the opposite case that fourth-century Athenians paid their officials with public funds as their fore- bears had certainly done from the late 430s.1 Hansen founds his case on the silence of our ancient sources.2 In 411/0 the oligarchic regime of the Four Hundred made Athenian magistrates, excepting the nine archons, amisthoi or unsalaried ([Arist.] Ath.Pol. 29.5; cf. Thuc. 8.65.3, 67.3). If, after they were ousted, this form of remuneration was restored, it was once more taken away by the oligarchic regime of 405/4.3 For Hansen there is simply no evidence that the democracy in the following year, that is, immediately after its second restoration, or at any point in the fourth century started to pay all of its magistrates again. In his account of the Athenian constitution of the 320s Aristotle’s pupil noted the remuneration of only a fraction of the 329 arkhontes, magistrates, which he got around to describing.4 They were the nine archons, five overseas magi- 1 The earliest evidence of misthos for Athenian magistrates is IG I3 32.8–9. 2 M. He taught me so much. And to Mrs. Norgrove and Albert Lee Abstract In the introduction, chapter one, I seek to give a brief oversight of the thesis chapter by chapter. Chapter two is a brief biography of Sir Richard Claverhouse Jebb, the still internationally recognized Sophoclean authority, and his much less well-known life as a humanitarian and a compassionate, human rights–committed person. In chapter three I look at δεινός, one of the most ambiguous words in the ancient Greek language, and especially at its presence and interpretation in the first line of the “Ode to Man”: 332–375 in Sophocles’ Antigone, and how it is used elsewhere in Sophocles and in a few other fifth-century writers. -

The Life of the Author in the Letters of “Euripides” Johanna Hanink N 1694, Joshua Barnes, the eccentric British scholar (and poet) of Greek who the next year would become Regius Professor at the University of Cambridge, published his I 1 long-awaited Euripidis quae extant omnia. This was an enormous edition of Euripides’ works which contained every scrap of Euripidean material—dramatic, fragmentary, and biographical —that Barnes had managed to unearth.2 In the course of pre- paring the volume, Barnes had got wind that Richard Bentley believed that the epistles attributed by many ancient manu- scripts to Euripides were spurious; he therefore wrote to Bentley asking him to elucidate the grounds of his doubt. On 22 February 1693, Bentley returned a letter to Barnes in which he firmly declared that, with regard to the ancient epistles, “tis not Euripides himself that here discourseth, but a puny sophist that acts him.” Bentley did, however, recognize that convincing others of this would be a difficult task: “as for arguments to prove [the letters] spurious, perhaps there are none that will convince any person that doth not discover it by himself.”3 1 On the printing of the book and its early distribution see D. Bacchylides 17: Singing and Usurping the Paean Maria Pavlou ACCHYLIDES 17, a Cean commission performed on Delos, has been the subject of extensive study and is Bmuch admired for its narrative artistry, elegance, and excellence. The ode was classified as a dithyramb by the Alex- andrians, but the Du-Stil address to Apollo in the closing lines renders this classification problematic and has rather baffled scholars. The solution to the thorny issue of the ode’s generic taxonomy is not yet conclusive, and the dilemma paean/ dithyramb is still alive.1 In fact, scholars now are more inclined to place the poem somewhere in the middle, on the premise that in antiquity the boundaries between dithyramb and paean were not so clear-cut as we tend to believe.2 Even though I am 1 Paean: R. He attended Roeper City and Country School in Bloomfield Hills, Michigan, and in 1994 he graduated from Swarthmore College, earning an Honors B.A. in Economics (his major) and Biology (his minor). After working for several years at public policy research firms in Pennsylvania and New Jersey, he decided to pursue the study of Classics, an interest of his since childhood. Upon earning an M.A. with Distinction in Latin and Greek from the University of Maryland at College Park in 1999, he enrolled in the Ph.D. program in Classics at Brown University. While working on his Ph.D., he spent two years as Seymour Fellow (2002-2003) and Capps Fellow (2004-2005) at the American School of Classical Studies at Athens and participated in the summer program of the American Academy in Rome (2000). -

The Imagery of Bacchylides' "Ode 5" Stern, Jacob Greek, Roman and Byzantine Studies; Spring 1967; 8, 1; ProQuest pg. 35 The Imagery of Bacchylides' Ode 5 Jacob Stern CBPTBD by most c~tics as pertinent to any interpretation of i{Bacchylides' Ode 5 is the scholion to Iliad 21.194: 1 according to the scholiast Pindar told the story of a proposal of marriage between Heracles and Deianeira, which took place in Hades after the death of Meleager; in this narration the offer was made by Meleager, who desired to protect his sister from the awful Achelous. In Bacchyl ides' Ode 5 the plot is different in one important regard: it is rather Heracles himself, moved to tears by the recital of Meleager's story, who asks whether Meleager has a sister whom he might make his bride. Bacchylides' version of the myth2 has been thoroughly discussed by the critics, who, in their interpretation of it, fall into two groups. In the first we find those who, surprisingly enough, take it in conjunction with the abrupt end of the myth as humorous. Zielinski's HHerculem ... ionica quadam levitate contactum," or ]ebb's "une naivete qui peut nous faire sourire," are typical of this view. 3 It often has associ ated with it the opinion that the humor can only be accounted for by assuming a courtly reference to some marriage among Hieron's followers. The second interpretation is most clearly represented by Preuss: Hut Meleagri laudes augeret, fabulam immutavisse iure Bacchylides existimari potest."4 The change in point of view is conceded to be slightly Hromamic,"5 but is found to have the advan tage of focusing the attention more completely on Meleager. -

Harris THE RULE OF LAW IN ATHENIAN DEMOCRACY Reflections on the Judicial Oath The rule of law was one of the most important cultural values in Athenian democracy. When delivering the funeral oration for the Athenian soldiers who fell at Lamia in 322 BCE, Hyperides (Epi- taphios, 25) declares: «For men to be happy they must be ruled by the voice of law, not the threats of a man; free men must not be frightened by accusation, only by proof of guilt; and the safety of our citizens must not depend on men who flatter their masters and slander our citizens but on our confidence in the law» (transl. Cooper). In another funeral oration (this one probably not deliv- ered), Lysias (2.19) praises the ancestors of the Athenians because «They thought it characteristic of wild animals to gain power over each other through violence, but that men ought to define what is just by law, persuade each other with reason, and serve both these aims by submitting to the rule of law and being instructed by rea- son» 1. Thucydides (2.37) attributes a similar idea to Pericles in the funeral oration he delivered in 430 BCE: «In public life we do not violate the laws because we obey those in office at any time and the laws, especially those established to help those who are wronged». In the Ephebic Oath, which the young men of Athens swore every year, each ephebe promises to obey the established laws and any laws that may be established prudently in the future 2. -
