China Southern will operate one daily flight between Beijing and Detroit using its new Boeing 787 aircraft. “I’m very pleased that Detroit will be added to China Southern’s network beginning in 2009,” said China Southern Chairman Liu Shaoyong. “Detroit Metropolitan Airport is a world-class facility that will serve as an excellent gateway to North America for our customers.” According to an economic impact study commissioned by the Wayne County Airport Authority, China Southern’s nonstop Beijing–Detroit service will generate over $95 million in annual economic benefit to the region. “China Southern’s new service will certainly have a tremendous positive impact on our economy,” said Wayne County Airport Authority CEO Lester Robinson. “The nonstop service between Detroit and Beijing will not only increase business activity but will create new opportunities for trade and exchange.” Beijing currently ranks as Detroit’s second-largest market in China for passenger traffic behind Shanghai. Nonstop service between Detroit and Shanghai on Northwest Airlines will also begin in March 2009. Cargo is also expected to play an important role in the success of both flights. -

Can it be possible that it was 50 years ago this September that this aircraft made its first public appearance? This plane had its origins in 1964, when Boeing began work on a proposal for the C-5A large military airlifter contract, and after Lockheed won that contest, Boeing considered a commercial passenger version as a means of salvaging the program. Urged on by Pan Am president Juan Trippe, Boeing in 1965 assigned a team headed by Chief Engineer Joe Sutter to design a large new airliner, although Boeing at the time was really more focused on its supersonic transport (SST) program. A launch customer order from Pan Am on April 13, 1966 for twenty five aircraft pushed Sutter's program into high gear, and in a truly herculian effort, Joe Sutter and his Boeing team, dubbed “The Incredibles,” brought the program from inception on paper to the public unveiling of a finished aircraft in the then unheard of time of 29 months. These statistics are presented in two distinct sections called; Statistical Accidents, which outlines hull loss, substantial damage, fatal injury and serious injury accidents; and Excluded Events, outlining hostile actions, and non-hostile events. Not covered in this document are airplanes manufactured in the Commonwealth of Independent States (CIS) (former Soviet Union), which are excluded because of the lack of operational data. -

61 far from solution. The difficulties of acquiring land and financing for this costly project appeared overwhelming. Mean- while, fuel tankers continued to make their noisy take-offs over Honolulu. The airport hoped there would be a technical development that would eliminate the need for this flight path. Highlights July 1, 1962 The Hawaii Visitors Information Program was established to welcome passengers at Honolulu International Airport and Honolulu Harbor, to encourage travel to the Neighbor Islands, and to provide information and other help to airport and harbor visitors. As of June 30, 1963, the staff of the HVIP consisted of 33 full-time and nine part-time employees. July 10, 1962 The widening of Taxiway X and restoration of P Road with a crossing over a new drainage ditch was com- pleted at a cost of $113,463.82. July 22, 1962 The Empress of Lima, a four-engine Britannia jet turboprop, crashed at 11:19 p.m. and burned while making an approach to Runway 8 on the Hickam Field portion of the airport. Twenty-seven persons were killed and 13 survived. It was the worst civil air carrier accident in the Islands’ history. The Air Force Fire Department acted promptly to minimize loss of life. Personnel of the Airport, Navy and City and County assisted in fighting the fire, maintaining order, and pro- viding ambulances and other services. The crash dramatically showed the need for continued cooperation between the Air Force and the airport. Several meetings were held after the crash and a number of suggestions developed for further improvement of the pattern for teamwork. -

It allowed KLM and any other Dutch carrier to fly to any point in the United States, and allowed U.S. carriers to fly to any point in the Netherlands, a country about the size of West Virginia. The U.S. was ideologically wedded to open markets, so the imbalance in traffic rights was of no concern. Moreover, opening up the Netherlands would allow KLM to drain traffic from surrounding airline networks, which would eventually encourage the surrounding airlines to ask their governments to sign “open skies” bilateral with the United States. • 1993 - the U.S. conferred antitrust immunity on the Wings Alliance between Northwest Airlines and KLM. The encirclement policy began to corrode resistance to liberalization as the sixth freedom traffic drain began to grow; soon Lufthansa, then Air France, were asking their governments to sign liberal bilaterals. • 1996 - Germany fell, followed by the Czech Republic, Italy, Portugal, the Slovak Republic, Malta, Poland. • 2001- the United States had concluded bilateral open skies agreements with 52 nations and concluded its first multilateral open skies agreement with Brunei, Chile, New Zealand and Singapore. • 2002 – France fell. • 2007 - The U.S. and E.U. concluded a multilateral “open skies” traffic agreement that liberalized everything but foreign ownership and cabotage. • 2011 – cumulatively, the U.S. had signed “open skies” bilaterals with more than100 States. Multilateral and Bilateral Air Transport Agreements • Section 5 of the Transit Agreement, and Section 6 of the Transport Agreement, provide: “Each contracting State reserves the right to withhold or revoke a certificate or permit to an air transport enterprise of another State in any case where it is not satisfied that substantial ownership and effective control are vested in nationals of a contracting State . -

Justice O’Connor, with whom The Chief Justice and Justice Thomas join, dissenting. The petition for a writ of certiorari in this case presents an important issue that has divided the Courts of Appeals: the meaning of the term “service” in the portion of the Airline Deregulation Act of 1978 (ADA) that pre-empts any state law “related to a price, route, or service of an air carrier.” 49 U. S. C. §41713(b)(1). I would grant the peti- tion to resolve this issue and bring needed certainty to this area of the law. We have addressed the scope of the ADA’s pre-emption provision on two prior occasions. In Morales v. Trans World Airlines, Inc., 504 U. S. 374, 383 (1992), we noted the “broad pre-emptive purpose” of the ADA. And while we have never directly addressed the definition of “service” within the meaning of §41713(b)(1), we have suggested that this term encompasses “access to flights and class-of- service upgrades.” American Airlines, Inc. v. Wolens, 513 U. S. 219, 226 (1995). The Courts of Appeals, however, have taken directly conflicting positions on this question of statutory interpretation.
