ALTERNATE HISTORY – ALTERNATE MEMORY: COUNTERFACTUAL LITERATURE IN THE CONTEXT OF GERMAN NORMALIZATION by GUIDO SCHENKEL M.A., Freie Universität Berlin, 2006 A THESIS SUBMITTED IN PARTIAL FULFILLMENT OF THE REQUIREMENTS FOR THE DEGREE OF DOCTOR OF PHILOSOPHY in THE FACULTY OF GRADUATE STUDIES (German Studies) THE UNIVERSITY OF BRITISH COLUMBIA (Vancouver) April 2012 © Guido Schenkel, 2012 ABSTRACT This dissertation examines a variety of Alternate Histories of the Third Reich from the perspective of memory theory. The term ‘Alternate History’ describes a genre of literature that presents fictional accounts of historical developments which deviate from the known course of hi story. These allohistorical narratives are inherently presentist, meaning that their central question of “What If?” can harness the repertoire of collective memory in order to act as both a reflection of and a commentary on contemporary social and political conditions. Moreover, Alternate Histories can act as a form of counter-memory insofar as the counterfactual mode can be used to highlight marginalized historical events. This study investigates a specific manifestation of this process. Contrasted with American and British examples, the primary focus is the analysis of the discursive functions of German-language counterfactual literature in the context of German normalization. The category of normalization connects a variety of commemorative trends in postwar Germany aimed at overcoming the legacy of National Socialism and re-formulating a positive German national identity. The central hypothesis is that Alternate Histories can perform a unique task in this particular discursive setting. In the context of German normalization, counterfactual stories of the history of the Third Reich are capable of functioning as alternate memories, meaning that they effectively replace the memory of real events with fantasies that are better suited to serve as exculpatory narratives for the German collective. -

Er sah die in den Schlammboden getretenen Hunger-Toten, von denen zuweilen ein Arm, ein Bein aus dem Boden ragte. Dies alles hat sich zugetragen im Frühjahr und Sommer 1945 am deutschen Rhein. An den Ufern des Stromes und seiner Nebenflüsse, zwischen Rheinberg in der Nähe von Wesel im Norden und Bad Kreuznach im Süden, waren mehr als eine halbe Million Soldaten der Deutschen Wehrmacht auf Äckern und Wiesen zusammengetrieben, von Drahtverhauen eingezäunt, allesamt Gefangene der Amerikaner. Die Weltgeschichte kennt keine größere Ballung von Gefangenen auf so wenigen Quadratkilometern. Hier auf den feuchten Wiesen der Rheinniederung pferchten die Sieger aus Amerika die Soldaten der geschlagenen deutschen Armeen zusammen. Drei Namen stehen vor allen für alle Zeiten als geographische Standortbestimmung der Wiesenlager in den Chroniken der Kriegsgefangenengeschichte: Rheinberg, Wickrath und Remagen. -

The story of the two German states that quickly emerged under the conditions of the Cold War can be understood as a constant struggle to achieve these goals. What is true democracy? How could the perpetrators of the Holocaust be turned into trustworthy democrats, and how could a democratic Germany contribute to a peaceful post-war international order? This seminar seeks to explore the different paths that the capitalist West and the communist East took after 1945, emphasizing the extent to which policies in both states were always dependent on one another. In particular, it will take a look at calls for democratization in both German states since the 1960s, including the 1968 student revolution in the West and the East German civil rights movement that evolved in the late 1980s. Finally, the course will analyze how the legacies of both German states continue to shape Germany after reunification and how today’s Germany deals with challenges to democracy in light of its totalitarian past Course Requirements: This seminar class can only succeed if everybody attends regularly and participates in class discussions. Each student will introduce the readings for one week in a brief presentation (10 min). -

Remedies for Victims of Violations of International Humanitarian Law
RICR Septembre IRRC September 2003 Vol. 85 No 851 497 Remedies for victims of violations of international humanitarian law LIESBETH ZEGVELD* International humanitarian law (“IHL”) has never been confined to the level of relations between States.1 On the contrary, the initiators of the nineteenth century conventions already believed that human persons had inviolable rights even during armed conflicts.2 However, recognition of rights is one thing, the right to claim those rights is another. So far, States have been reluctant to entitle, explicitly and in general, victims of violations of international humanitarian law to claim reparation. As humanitarian law treaties do not expressly envisage causes of action for victims in national or international law, they are hardly able to exercise their rights. On this point international humanitarian law sharply contrasts with tendencies in international law. In spite of the gap in the International Law Commission’s Articles on State Responsibility, which were finally adopted in 20013 but fail to mention rights of individuals in the regime of secondary rights,4 it is generally known that human rights treaties provide a remedy, both substantive and procedural, for individuals suffering injury from unlaw- ful conduct by State authorities. For example, Article 13 of the European Convention on Human Rights stipulates that individuals whose rights as set forth in that Convention are violated shall have “an effective remedy before a national authority”. And Article 50 of the same Convention mandates the European Court of Human Rights to afford just satisfaction to victims. Human rights treaties also provide for specific provisions on compensation, for example to victims of unlawful arrest or detention.5 Most recently, the Rome Statute of the International Criminal Court6 authorizes the Court to determine any damage, loss or injury to victims and order reparations to them. -

Denn eine Mehrheit von Europäern hatte den Zweiten Welt- krieg nicht am militärischen Schlachtfeld erlebt, sondern als Kriegsgefangene, Zwangsarbeiter und KZ-Insassen, aber auch als Partisanen, Kollaborateure und „Mitläufer“. „In the annals of history, however, never have so many people been caught up in the process of collaboration, resistance, and retribution as in Europe during and after the Second Wolrd War.“ Aber auch die „tägliche Demütigung“ sollte nicht unterschätzt werden, denn: „Männer und Frauen wurden verraten und erniedrigt, tagtäglich zu kleinen Gesetzwidrigkeiten genötigt, bei denen jeder et- was und viele alles verloren“.2504 Beim Vormarsch der Roten Armee nach Ost- und Westpreußen, Pommern und Schlesien, nach Mähren und Böhmen, in die Slowakei und nach Ungarn, durch den Banat, die Batschka und die Baranya, beim Vormarsch der jugoslawischen Partisanen durch die Vojvodina, Kroatien und Slowenien, bei der Evakuierung der Karpatendeutschen, beim Prager Aufstand, dem Brünner „Todesmarsch“ und dem Aussiger Pogrom, nicht zuletzt bei der Übernahme der neuen polnischen Westgebiete, ließen nicht nur sowjetische Soldaten, sondern auch polnische und tschechische Soldaten, Milizionäre und „Revolutionsgarden“, serbische, kroati- sche und slowenische Partisanen, sogar „Zivilisten“ aller Art, ihren Hassgefühlen gegenüber „den Deutschen“ freien Lauf.
