    Complaints dealt with by the Communications Authority (“CA”) (released on 15 December 2020) The CA considered the following cases which had been deliberated by the Broadcast Complaints Committee (“BCC”) – Complaint Cases 1. Television Programme “Another Hong Kong” (另一個香港) broadcast by Television Broadcasts Limited (“TVB”), PCCW Media Limited (“now TV”), Hong Kong Cable Television Limited (“HKCTV”) and Radio Television Hong Kong (“RTHK”) 2. Radio Programmes “Weekend Lucky Star” (潮爆開運王) broadcast by Hong Kong Commercial Broadcasting Company Limited (“CRHK”) The CA also considered cases of dissatisfaction with the decisions of the Director-General of Communications (“DG Com”) on complaint cases. Having considered the recommendations of the BCC, the CA decided– 1. that the complaints against the television programme “Another Hong Kong” (另 一個香港) were unsubstantiated. Nevertheless, there is scope to improve identification of the source of acquired/relayed factual programmes on controversial issues of public importance in Hong Kong to help viewers in making decisions in their choice of programmes and in forming their expectations and judgements. The CA suggested that TVB could inform viewers of the existence of other parts of such programmes which were not broadcast on its service, and that now TV and HKCTV should provide sufficient information about the source of such programmes in a prominent manner prior to their broadcast; 2. that strong advice should be given to CRHK on the complaint against the radio programmes “Weekend Lucky Star” (潮爆開運王); and 3. to uphold the decisions of the DG Com on two cases of dissatisfaction with the decisions of the DG Com. For the first time in Europe, TVB’s subsidiary ‘The Chinese Channel’ is offering a line-up of five of the Group’s flagship infotainment channels including “TVBS-Europe” which specialises in Hong Kong drama series, local news and Chinese community events in Europe. Having considered the recommendations of the BCC, the CA decided – 1. that an advice be given to ATV on the complaints related to the television programme “Mark Six<Live>” (六合彩<現場直播>); 2. that no further action be taken against ATV on the complaints related to the television programme “ATV Focus” (ATV 焦點); 3. that no further action be taken against Television Broadcasts Limited (“TVB”) on the complaints related to the television programme “Triumph In The Skies II” (衝上雲霄II); 4. that the complaints related to the control and management of ATV are substantiated. As the CA has already imposed sanction on ATV for breaching the relevant licence condition, including a financial penalty of $1,000,000, no further action be taken against ATV on the complaints; and 5. to uphold the decisions of the DG Com on 29 cases of dissatisfaction with the decisions of the DG Com.     For immediate release HKTV Responses to the Court’s decision of TVB’s Judicial Review (Hong Kong, 13 May 2013) Hong Kong Television Network Limited (“HKTV”) welcomes the Court of First Instance’s decision to dismiss TVB’s application for leave to apply for judicial review against the recommendation to issue additional domestic free television programme service licences made by the then Broadcasting Authority (the predecessor of the Communications Authority). The Government emphasized that they will put the Open Policy in action, but they put the Delaying Policy in action in reality. HKTV applied for a Domestic Free TV Program Service Licence on New Year Eve in 2009, 1229 days have passed now. Yet, the Court dismissed TVB’s application for leave to apply for judicial review, and there is no further excuse for the Government to delay, and therefore, decisive action should be made on issuing new licences.     Appendix Case – Television Broadcasts Limited (“TVB”)’s Pre-emption of Radio Television Hong Kong (“RTHK”) Television Programme “Headliner” (頭 條新聞) Originally Scheduled for Broadcast on the Jade Channel of TVB at 6:00pm to 6:30pm on 30 June 2017 A total of 406 complaints were received against TVB’s pre-emption of the captioned RTHK programme. The major allegation was that the sudden pre-emption of the RTHK programme to make way for the broadcast of news footage of President Xi Jin-ping’s meeting people from various sectors of the society (which had already been broadcast on the I News Channel of TVB and by other TV stations at around 5:10pm) and a pre-recorded feng-shui programme that had no urgency violated the relevant condition in TVB’s domestic free television programme service (“free TV”) licence regarding the broadcast of RTHK programmes. Other allegations included breach of the relevant provision regarding programme changes as no prior notice or only short notice was given to inform viewers of the relevant broadcasting arrangement; the pre-emption amounted to self-censorship, affected freedom of speech and the press, deprived viewers of the right to watch the programme concerned; and some complainants were dissatisfied with TVB’s response to media enquiries issued on 5 July 2017 about the rescheduling. - 2 - The Communications Authority (“CA”)’s Findings In line with the established practice, the CA considered the complaints and the representations of TVB in detail.
