NEW YORK STATE PUBLIC EMPLOYMENT RELATIONS BOARD Case No. IA 2006-24; M 2006-093 In the Matter of the Arbitration OPINION - between- THE CITY OF NEW YORK PUBLIC - and- ARBITRATION PATROLMEN'S BENEVOLENT ASSOCIATION PANEL CHAIR OF THE CITY OF NEW YORK, INC. Pursuant to Section 209.4 of the New York Civil Service Law ("Taylor Law"), on July 11, 2007 the New York State Public Employment Relations Board ("PERB") designated the undersigned Public Arbitration Panel in the above dispute between the City of New York ("City") and the Patrolmen's Benevolent Association of the City of New York, Inc. ("PBA"): Susan T. Mackenzie, Esq., Public Panel Member and Chair; Carole O'Blenes, Esq., Public Employer Panel Member; and, Jay W. Waks, Esq., Employee Organization Panel Member. By accepting appointment to this Public Arbitration Panel, the Panel Members agreed to "make a just and reasonable determination on the matters in dispute" between the parties over the terms of their collective bargaining agreement for the contract term, August 1, 2004-July 31, 2006. Pre-hearing conferences were held on August 27, 2007 and September 17, 2007, and hearings on November 6,27,28 and 29, 2007, December 12, 13 and 14,2007, and January 7,8,9, 10 and 11, 2008. A transcript of the hearings was recorded and all witnesses gave sworn testimony. The parties filed pre-hearing briefs on October 22, 2007, post-hearing briefs on February 20, 2008 and reply briefs on March 11, 2008. The Panel met in executive session on March 19, 2008, April 29, 2008, May 9, 2008 and May 19,2008. -

The plan's focus on measurable accomplishments and frequent performance reporting mirrored the highly successful anti-crime techniques pioneered by the NYPD's CompStat system. Key to the success of PlaNYC was its clear status as a mayoral priority. PlaNYC joined environment to the mayor's top priority of economic development. Last week, we may have seen a similar moment in policy development as Mayor de Blasio linked sustainability to his top goal of poverty reduction. The fact that he is attempting to integrate sustainability with his highest priority is a strong indication that sustainability goals will continue to advance in New York City. The different goals of our very distinct mayors reflect the different conditions they inherited when they assumed office. Mayor Bloomberg took office less than one hundred days after the horror of the World Trade Center's destruction. -

Irick, Acting President of the Metropolitan Transportation Authority From: Kyle Rectenwald and Paul Evans Subject: Detrimental Effects of Limited Transport Access on Low-Income New Yorkers Date: March 23, 2017 Problem: The New Yorkers Who Need Access to Transit the Most Have it the Least New York City’s low-income communities are being severely underserved by the city’s public transportation system. Around 58% of the city’s poorest residents, more than any other income group, rely on the subway and bus systems for transportation (Bendix). Yet for a variety of reasons to be outlined, these residents are being increasingly isolated from access to transit and presented with limited mobility options. Marginalization from the city’s transport network means limited access to the opportunities provided by a vibrant city like New York. This inequitable situation has real, detrimental effects on people’s lives. For one young man, simply getting from his home in West Harlem to attend college in the Bronx requires an hour or more walk every day (Stolper and Rankin 4). For many residents, lack of transport means they are unable to even pick children up from childcare, go grocery shopping, or access basic, fundamental services like hospitals and schools. For the city’s low-income population, limited access to transport is a key factor locking them into a spiral of poverty. As Councilmember David Greenfield recently said, “You can’t get out of poverty if you can’t get to your job” (Foley). -

Sir : I submit herewith annual report of the Department of Parks, Borough of The Bronx, for 1921. Respect fully, ANNUAL REPORT-1921 In submitting to your Honor the report of the operations of this depart- ment for 1921, the last year of the first term of your administration, it will . not be out of place to review or refer briefly to some of the most important things accomplished by this department, or that this department was asso- ciated with during the past 4 years. The very first problem presented involved matters connected with the appropriation for temporary use to the Navy Department of 225 acres in Pelham Bay Park for a Naval Station for war purposes, in addition to the 235 acres for which a permit was given late in 1917. A total of 481 one- story buildings of various kinds were erected during 1918, equipped with heating and lighting systems. This camp contained at one time as many as 20,000 men, who came and went constantly. AH roads leading to the camp were park roads and in view of the heavy trucking had to be constantly under inspection and repair. The Navy De- partment took over the pedestrian walk from City Island Bridge to City Island Road, but constructed another cement walk 12 feet wide and 5,500 feet long, at the request of this department, at an expenditure of $20,000. -

Articles New York City Rules! Regulatory Models for Environmental and Public Health JASON J. CZARNEZKI* Scholars have become increasingly interested in facilitating improvement in environmental and public health at the local level. Over the lastfew years, former New York City Mayor Michael Bloomberg and the New York City Council have proposed and adopted numerous environmental and public health initiatives, providing a useful case study for analyzing the development and success (or failure) of various regulatory tools, and offering larger lessons about regulation that can be extrapolated to other substantive areas. This Article, first, seeks to categorize and evaluate these "New York Rules," creating a new taxonomy to understanddifferent types of regulation. These "New York Rules" include bans, informational regulation, education, infrastructure,mandates, standard-setting, and economic (dis)incentives. -

POP-UP POTENTIAL: THE EFFECT OF REGULATORY LAWS ON THE INNOVATION OF POP-UP RESTAURANTS By: Alexandra Lauren Lizano† ABSTRACT Pop-up restaurants have risen in popularity over the past decade in the United States. As used in this Comment, a pop-up restaurant is when an existing restaurant space temporarily loans that space to another chef or restaurant for a limited period of time. This Comment seeks to explore the potential benefits and exploit the drawbacks of pop-up restaurants as property solutions in large cities. Pop-up restaurants thrive in the landscape of the sharing economy, and as such, legal scholars pose that it is imperative to understand this new type of economic scheme to efficiently regulate the entities within it.
