Corns John Milton: Life, Work and Thought Oxford / New York: Oxford University Press, 2008. xiii+488pp. Reviewed by Yuko Kanakubo Noro, Nihon University In 2008, to commemorate the quartercentenary of John Milton’s birth (December 9, 1608), several influential books of Milton studies were published: Is Milton Better than Shakespeare?, by Nigel Smith; John Milton: Paradise Lost edited by Philip Pullman 1 and A Concise Companion to Milton edited by Angelica Duran. There are three biographies as well: Milton: Poet, Pamphleteer and Patriot by Anna Beer; John Milton: A Biography by Neil Forsyth; and John Milton: Life, Work and Thought by Gordon Campbell and Thomas N. Corns. The three biographies differ from each other in the following ways: Beer’s attitude towards Milton’s life reminds the reader of Wordsworth’s invocation to Milton in his sonnet, which begins with “Milton! thou shouldst be living at this hour: / England hath need of thee:”. In short, by appreciating the great poet’s life and works, the reader is to share Milton’s thought, energy and posture towards the world’s difficulties and problems, and live positively, imitating Milton as an exemplum. The base of Beer’s approach is sympathy. Neil Forsyth’s approach is to some extent similar to Beer’s, but he seems to grasp the figure of Milton more objectively than she does, and he seems to entertain his readers by solving the problem as to, “[W]hy Milton is so loved and admired, and even, sometimes, detested”(p. -

Director General National Judicial Academy By philosophy of law, for the purpose of this article, is meant the pursuit of wisdom, truth and knowledge of law by use of reason. In other words, philosophy of law means the ratlonal investigation and study of the basic ideal and principles of law. The philosophy of natural law is the subject of this article. Longing for a Higher Law - In the human bosom there has always been a longing for a higher law than those made by the community itself. The divine theory of law, the theory of natural law, and the principles of natural justice are some theories or notions found in fulfilment of this longing. Divine laws are those ascribed to God. Divine rights of kings were supposed to have been derived from God. Laws which are claimed to be God-made, may not be amendable by man; and their reasoning and provisions also not to be ques- tioned by man. Greek thinkers from Homer to the Stoics, and reflections of Plato and Aristotle mainly provide the beginning of systematic legal thinking. In Homer, law is embodied in the themistes which the kings receive from Zeus as the divine source of all earthly justice which is still identical with order and authority. Solon the great Athenian lawgiver appeals to Dike, the daughter of Zeus, as a guarantor of justice against earthly tyranny, violation of rights and social injustice. The Code of Hamurapi was handed over by the Sun god. -
Augustinian Christian Philosophy
AUGUSTINIAN CHRISTIAN PHILOSOPHY How does Christianity bear on philosophy? Is there such a thing as Christian philosophy, or are there only Christians who are also philoso phers? How should Christianity and philosophy be related? Should they be related? In "Advice to Christian Philosophers" I said that Christian philosophers should display more autonomy: they have their own fish to fry, their own projects to pursue, (or their own axes to grind, as some might prefer to put it). Here I want to say more about what these projects (or fish, or axes) are like. And the right way to think about these matters, so it seems to me, is broadly Augustinian. Accordingly, I want to propose a program matic sketch (a very programmatic sketch) of a conception of Christian philosophy that grows out of some central Augustinian emphases. I don't claim, however, that Augustine in fact thought of Christian philosophy the way I shall suggest. The primary focus of my paper is not historical (that would in any event be beyond my competence); what I want to do is make a suggestion as to how we should think about Christian philosophy now; but this way of thinking of the matter grows out of Augustinian roots.! It's worth noting, furthermore, that what is at issue is not just a way of thinking about Christianity and philosophy, but about Christianity and scholarship more generally. There are at least four elements in Augustinian Christian philosophy. The first two of these are widely recognized and relatively uncontroversial: I shall therefore be brief about them. -

There is a passage in Immanuel Kant's general introduction to both parts of Die Metaphysik der Sitten that deserves more attention than it has received. I plan to build the present paper around the implil:ations of this passage: In all lawgiving (Gesetzgebung) (whether it prescribes for internal or external actions, and whether it prescribes them a priori by reason alone or by the choice of another) there are two elements: first, a law, which represents an action that is to be done as objectively necessary, that is, which makes the action a duty; and second, an incentive, which connects a ground for determining choice to this action subjectively with the representation of the law. -

Received December 29th, 2009 Béla Mester Hungarian Academy of Sciences, Institute for Philosophical Research, Etele út 59-61, HU–1119 Budapest [email protected] Censorship as a Typographical Chimera John Milton and John Locke on Gestures1 Abstract The aim of my paper is to show some elements in Milton’s and Locke’s political writin gs, depending on their attitudes to different media. Milton in his argumentation against censorship must demonstrate that all the ancient instances for censorship, usually cited in his century, can be interpreted as examples of another phenomenon. However, Milton, analysing loci of Plato’s Republic and some Scriptural topics, recognises the scope and significance of nonconceptual, nonprinted, nonverbal forms of communication; he des cribes them as signs of childish, female or uneducated behaviours, as valueless phenomena from the point of view of political liberty incarnated in the freedom of press. John Locke’s attitude is the same. I will show a chain of ideas, similar to Milton’s one, in his Two Tracts on Government and in his Epistola de tolerantia, focusing the analyses on the concept of adiaphora (indifferent things). However, Milton was not a researcher of the media, and his aim in his booklet was not an analysis of homo typographicus’ thought on the freedom of thought itself, depended on the medium of the printed book; his thinking inevitably met the links between our ideals on the freedom of thought and different media by which we express them. -

Abstract My thesis explores the way in which the Italian language and literary culture contributed to John Milton’s early development as a poet (over the period up to 1639 and the composition of Epitaphium Damonis). I begin by investigating the nature of the cultural relationship between England and Italy in the late medieval and early modern periods. I then examine how Milton’s own engagement with the Italian language and its literature evolved in the context of his family background, his personal contacts with the London Italian community and modern language teaching in the early seventeenth century as he grew to become a ‘multilingual’ poet. My study then turns to his first published collection of verse, Poems 1645. Here, I reconsider the Italian elements in Milton’s early poetry, beginning with the six poems he wrote in Italian, identifying their place and significance in the overall structure of the volume, and their status and place within the Italian Petrarchan verse tradition. -

Although these story-lines were O created independently and reflected different concerns, they sometimes overlapped and gave each other aid and comfort. Both exerted considerable influence on the way historians of medieval speculative thought conceptualized their subject in the first half of the twentieth cen- tury. Both versions of the map drawn by these two sets of cartographers illustrated what Wallace K. Ferguson later described as “the revolt of the medievalists.”1 One was confined largely to the academy and appealed to a wide variety of medievalists, while the other had a somewhat narrower draw and reflected political and confessional, as well as academic, concerns. The first was the anti-Burckhardtian effort to push Renaissance humanism, understood as combining a knowledge and love of the classics with “the discovery of the world and of man,” back into the Middle Ages. The second was inspired by the neo-Thomist revival launched by Pope Leo XIII, and was inhabited almost exclusively by Roman Catholic scholars. -

INTRODUCTION The notion of the public sphere, or more precisely the bourgeois public sphere, associated with German philosopher Jürgen Habermas, has become ubiquitous in eighteenth-century cultural studies. Scholars concerned with media and democratic discourse have also invoked Habermas. Nonetheless, the relationship between the emergence of the public sphere and the emergence of copyright in early modern England has not been much discussed. Moreover, with a new wave of feminist criticism appearing in the 1970s, such critics as Catherine Gimelli Martin, Gina Hausknecht, Maria Magro, and Harvey Couch have asserted that Milton’s divorce tracts are not only predictive, but that they promote the rights of women in divorce law in a way that has made Milton nearly prophetic. However, this thesis disputes the idea that Milton is supportive of modern gender equality within his divorce tracts, and asks such questions as: Does Milton attempt to gain an equal opportunity to divorce for both genders in his work? Does he desire divorce for the betterment of both spouses? And, finally, does Milton offer women any protection following a divorce? These questions are answered by means of closely examining Milton’s primary text, as well as multiple historical variables, such as religion, language, societal norms, and common outcomes of divorce for women. Through an examination of these factors, it is ultimately deciphered that Milton is not supportive of gender equality in divorce law, and thus, his divorce tracts are not predictive of modern divorce legislation. -

Chapter 8 The Senses and Human Nature in a Political Reading of Paradise Lost Jens Martin Gurr Milton, so far as I know, is the first to turn to the story of the Fall to explain the failure of a revolution.1 Introduction Let us begin with what seems a politically inconspicuous passage on the five senses. Here is Adam, lecturing Eve on reason, fancy and the senses: But know that in the soul Are many lesser faculties that serve Reason as chief; among these fancy next Her office holds; of all external things, Which the five watchful senses represent, She forms imaginations, airy shapes, Which reason joining or disjoining, frames All what we affirm or what deny, and call Our knowledge or opinion [. .].2 What we find here is a rather standard early modern understanding of the relationship between reason, fancy and the senses.3 But what is illuminating is the way in which this discussion is metaphorically politicized by means of the body politic analogy: the relations among the inner faculties, as so often in Milton, are rendered in the political terminology of rule, domination and 1 Hill Ch., Milton and the English Revolution (London: 1977) 352. 2 Milton John, Paradise Lost, ed.
