The History of Cultural Production in the United States Tracks the Racial Divide That Inaugurated the Founding of the Republic
INTELLECTUAL PROPERTY AT THE INTERSECTION OF RACE AND GENDER: OR LADY 1 SINGS THE BLUES BY K.J. GREENE The history of cultural production in the United States tracks the racial divide that inaugurated the founding of the Republic. The original U.S. Constitution excluded both black women and men from the blessings of liberty. Congress enacted formal laws mandating racial equality only scant decades ago, although it may seem long ago to today’s generation. Interestingly, the same Constitution that validated slavery and excluded women from voting also granted rights to authors and inventors in what is known as the Patent/Copyright clause of Article I, section 8. Those rights have become the cornerstone of economic value not only in the U.S but globally, and are inextricably tied to cultural production that influences all aspects of society. My scholarship seeks to show how both the structure of copyright law, and the phenomena of racial segregation and discrimination impacted the cultural production of African-Americans and how the racially neutral construct of IP has in fact historically adversely impacted African- American artists.2 It is only in recent years that scholarship exploring intellectual property has examined IP in the context of social and historical inequality. This piece will explore briefly how women artists and particularly black women have been impacted in the IP system, and to compare how both blacks and women have shared commonality of treatment with indigenous peoples and their creative works. The treatment of blacks, women and indigenous peoples in the IP system reflects an unfortunate narrative of exploitation, devaluation and the promotion of derogatory stereotypes that helped fuel oppression in the United States and in the case of indigenous peoples, aboard. -

PERFORMERS BiU Withers By Rob Bowman He was the leading figure in the nascent black singer-songwriter movement of the early 1970s. BILL WITHERS WAS SIMPLY NOT BORN TO PLAY THE record industry game. His oft-repeated descriptor for A&R men is “antagonistic and redundant.” Not surprisingly, most A&R men at Columbia Records, the label he recorded for beginning in 1975, considered him “difficult.” Yet when given the freedom to follow his muse, Withers wrote, sang, and in many cases produced some of our most enduring classics, including “Ain’t No Sunshine,” “Lean on Me,” “Use Me,” “Lovely Day,” “Grandma’s Hands,” and “Who Is He (and What Is He to You).” ^ “Not a lot of people got me,” Withers recently mused. “Here I was, this black guy playing an acoustic guitar, and I wasn’t playing the gut-bucket blues. People had a certain slot that they expected you to fit in to.” ^ Withers’ story is about as improb able as it could get. His first hit, “Ain’t No Sunshine,” recorded in 1971 when he was 33, broke nearly every pop music rule. Instead of writing words for a bridge, Withers audaciously repeated “I know” twenty-six times in a row. Moreover, the two-minute song had no introduction and was released as a throwaway B-side. Produced by Stax alumni Booker T. Jones for Sussex Records, the single’s struc ture, sound, and sentiment were completely unprecedented and pos sessed a melody and lyric that tapped into the Zeitgeist of the era. Like much of Withers’ work, it would ultimately prove to be timeless. -

That’s old news, but it’ll never get old to me: Black male rappers have been so maligned as to render his award almost unimaginable to those of us who have loved the music for decades. At the ceremony, the prize’s administrator, Dana Canedy, greeted Lamar on the steps of Columbia University. “We’re both making history right now,” she said. And so they were: Canedy is the first black woman to hold her post, and Lamar — or “Pulitzer Kenny,” as he now delightfully, and delightedly, calls himself — is the first hip-hop artist to win the award. On the same day, Branden Jacobs-Jenkins was nominated for the prize for drama (he was also nominated in 2016). Last spring, “Black Panther,” with its nearly all- black cast, surpassed a billion dollars in worldwide ticket sales. In May, Sean “Diddy” Combs outbid a rival to purchase a Kerry James Marshall painting for $21.1 million at Sotheby’s. The sale was a triumph: A black multimillionaire bought a black artist’s painting for the highest sum ever paid for the work of a living African-American artist. -

From those who have been here for thousands of years to the most recent immigrants, we are all contributing to American culture. We are all being translated into a new language. BOOK Everyone should know by now that Columbus did not “discover” America. Rather, we are all still discovering America—and we must continue to do AWARDS so. The Before Columbus Foundation was founded in 1976 as a nonprofit educational and service organization dedicated to the promotion and dissemination of contemporary American multicultural literature. The goals of BCF are to provide recognition and a wider audience for the wealth of cultural and ethnic diversity that constitutes American writing. BCF has always employed the term “multicultural” not as a description of an aspect of American literature, but as a definition of all American litera- ture. BCF believes that the ingredients of America’s so-called “melting pot” are not only distinct, but integral to the unique constitution of American Culture—the whole comprises the parts. In 1978, the Board of Directors of BCF (authors, editors, and publishers representing the multicultural diversity of American Literature) decided that one of its programs should be a book award that would, for the first time, respect and honor excellence in American literature without restric- tion or bias with regard to race, sex, creed, cultural origin, size of press or ad budget, or even genre. -
