A six-month grace period provided an opportunity to make other funding and staffing arrangements. This article examines the evolution of Canadian Aboriginal print media since the cancellation of their main public support system and questions the future of the Aboriginal media in Canada. Secretary of State Gerry Weiner had informed the publishing managers of the Native Communications Societies the previous month that the program would die. A six-month grace period would be provided until September 1990 to allow for transition and other arrangements, but the truth of the matter remained: when the summer was over, the NCP would be no longer. -

THE EMBARRASSING PREAMBLE? UNDERSTANDING THE “SUPREMACY OF GOD” AND THE CHARTER JONATHON W. PENNEY† & ROBERT J. DANAY‡ I. INTRODUCTION At the outset of Canada’s most venerated human rights document—the Canadian Charter of Rights and Freedoms1—is a short but profound declaration: “… Canada is founded upon principles that recognize the supremacy of God and the rule of law.” This reference to the “supremacy of God” and the “rule of law”, of course, appears in the Preamble—the part of the Constitution that the Supreme Court of Canada has called the “grand entrance hall to the castle of the Constitution”,2 wherein “the political theory which the Act embodies” is found.3 Accordingly, the “rule of law” has played a rather remarkable role in the jurisprudence of the courts, most notably the Supreme Court.4 It has been called a “fundamental postulate” of our “constitutional structure”,5 a notion that that comprises “indispensable elements of civilized life”,6 and a principle † Current candidate for M.St. (Oxford) and former Justice Department Counsel. The Construction of Women As Worker-Citizens and Mother-Citizens in Canadian Employment and Child Care Policies, 1940-1988
ABSTRACT Driven Apart: The Construction of Women as Worker-Citizens and Mother-Citizens in Canadian Employment and Child Care Policies, 1940-1988. This thesis examines how Canadian women have campaigned for federal employment equity and child care policies in order to enjoy equal employment opportunities with men. It demonstrates how women articulated these double-edged demands through the Royal Commission on the Status of Women (RCSW) and the Royal Commission on Equality in Employment (RCEE). It shows that while both royal commissions called on the federal government to take up women's double-edged demands, the policy response has been uneven. Federal policies to eradicate sex discrimination at work and promote employment equity have been developed. By contrast, a publicly-funded system of child care has never been included within the federal welfare state. Drawing on forty interviews and analysis of a range of primary documents the thesis argues that the federal response to women's demands was narrowed by the meta-discourse of worker-citizenship that underpinned the Canadian welfare state. This prioritised the equal, non-discriminatory treatment of worker-citizens and defined employment inequality as a problem located in the public sphere. Although the federal government promoted the equal treatment of worker-citizens once they entered the labour market, it was less willing to address the inequalities of access many women experience as a result of assuming paid employment while caring for dependent children. Federal policy responses to women's double-edged demands were driven further apart by the costs of each policy, government structures, jurisdictional tensions over child care and the pattern of women's mobilisation on employment equity and child care during the 1980s. -

Restricting Rights, Losing Control: Canadian Policies Towards Asylum Seekers in the 1980s Christopher G. Anderson (Doctoral Student, McGill University) A Paper presented at the annual conference of the Canadian Political Science Association Winnipeg, Manitoba June 2004 I. Introduction The issue of border control has always existed as a basic and divisive dimension of liberal- democratic state politics, being deeply embedded in questions of national development and national identity. On the one hand, the right to regulate the entry of non-citizens has long been considered to comprise a core characteristic of a sovereign state. On the other hand, the controversy that seems coincident with the question of who should be allowed to enter into and to remain within the borders of a given territory (and under what conditions) predates by far the emergence of the modern nation-state itself. Alongside the various cultural, economic, medical, political, racial, and social arguments that can arise during the course of such debates, there have often been concerns expressed over any perceived divergence between the right of states to control their borders and their actual success in doing so. From the early 1970s onwards such a discrepancy seemed to many to be apparent in North America and Western Europe, and there emerged in the 1990s a comparative literature in the social sciences that sought to explain this “gap” between the authority and the capacity of states. One of the major ideas developed in this body of work is that the recent rise of a domestic rights- based politics has severely limited liberal-democratic state control over international migration. -
