Participation in inter-departmental County projects related to recreation and historic preservation. Annual Report 2009 Section 1 Page 1 Division of Land Development Services Summary of Annual Operations Land Use and Building Permits Permits staff processed 408 new Land Use Permit (LUP) Applications. Eighty-one (81) LUPs were modified during the course of the review procedure. During the course of the year, nine (9) LUPs were canceled and one (1) expired. Of the 358 issued LUPs, fifty-one (51) were issued for new single family dwellings and twelve (12) for mobile homes. One hundred-forty (140) LUPs issued were subjected to the building codes review process. The Division issued one hundred-twenty four (124) Certificate(s) of Occupancy in conformance with the provisions of the Building Code. The Total Estimated Value of construction costs for CY 2009 within the County’s permitting jurisdiction was $15,058,370.00. During 2009, eighteen (18) LUPs were issued with some degree of Administrative Variance to setback requirements and twenty-seven (27) LUPs were issued as After-the-Fact Authorizations. By the end of CY 2009, LDS performed twenty (20) code inspections related to the permit process. During 2009, one hundred and thirteen (113) construction plans were submitted to the LDS office and ninety-five (95) construction plans were approved throughout the course of the year. Analysis of permits data indicates that the largest percentage of the County’s development (by Estimated Value) took place within the Greater Cumberland Planning Region. Fees invoiced for permitting services during 2009 were valued at $47,002.84. This value excludes fees invoiced on behalf of the Allegany Soil Conservation District. Rezoning Cases Rezoning Case #70 was initiated in CY 2008. The subject area is a 104 acre parcel located on the west side of New Georges Creek Road (MD 36), approximately ¾ of a mile northeast of Ocean Hill Road intersection. The area was subject to a surface mine for coal extraction. Initially, the Petitioner requested that an area be rezoned from A-Agricultural and G2-General Urban to I-Industrial. During 2008, the Planning Commission processed the request, conducted hearings, and forwarded unfavorable comments to the Allegany County Commissioners relative to the approval of the request. After due process, the Allegany County Commissioners remanded the Case (4/16/2009) to the Planning Commission for further consideration and study. The initial request was essentially denied, whereupon the Applicant re-filed an amended application (8/24/2009) and the re-zoning process was re-initiated. After hearings and due process by the Planning Commission, the Planning Commission recommended the County Annual Report 2009 Section 1 Page 2 Division of Land Development Services Commissioners re-zone the subject area. The County Commissioners approved the rezoning request through Resolution 09-32, with an adoption date of December 17, 2009. Consequently, the subject area was rezoned C-Conservation, G2-General Urban and I-Industrial with an effective date of January 4, 2010. The intent of the Petitioner was to develop the parcel for a rubble fill, an asphalt plant, a recycling center and a contractor’s storage yard with office building. As of the date of this report, the property owner had not submitted any applications to seek authorization for the aforementioned uses. Administrative Rezoning During mid 2009, the County initiated an administrative re-zoning procedure for certain areas within the National Highway corridor through LaVale as well as Pinto. These administrative re-zonings were approved through Resolutions 9-19 through 22, on August 20th, 2009, with an effective date upon passage of said Resolutions. The re-zonings within LaVale addressed the minor expansion of Commercial A Zoning Districts onto properties with de facto commercial use. The subject of the
