İlk olarak bu çalışma boyunca sekiz yılı geçirdiğim Hacettepe Üniversitesi Tarih Bölümü benim için önemli bir okuldu. Nihâyet bu serüven tamamlandı. Bu bağlamda büyük dedemiz "halka nâfiʽ bir sahs olan" Hacı Hafız Ömer'in ilim yolunda taşıdığı bayrağı devralmak benim için büyük onurdur. Evvela bu çalışmanın ortaya çıkmasında tez hocam Prof. Dr. Mehmet Öz, bu acemi bütünleşik doktora öğrencisinin sorularına cevap verirken hiç usanmadı. Bu anlamda çalışmanın gelişmesinde tavsiyeleriyle yol gösterirken, her daim ilminden istifade etmeme imkân tanıdı. İlâveten, ilim yolunda attığım adımlarda karşıma çıkan engellere karşı kadirşinas kişiliği ve hoşgörüsüyle hep yanımdaydı. Bu vesileyle kendisine şükranlarımı sunuyorum. Yerleşimciler tarafından kuşatılmış, Osmanlı döneminden beri varlığını sürdüren küçük bir köy olan Nahhâlîn'de misafir kaldığım zamanlarda Shakarnah ailesi bütün imkânlarını seferber ederek, Filistin'de bir ailem olduğunu hissettirdiler. Osmanlı Kudüsü'nde Toplum Ve Siyaset (1703-1789), Doktora Tezi, Ankara, 2017 Bu tez 1703-1789 yılları arasında, Kudüs'teki yerel ileri gelenlerin şehir siyasetindeki etkinlikleri ile onların servetlerini ve şikâyet mekanizmasının Kudüs özelinde işleyişini ele almaktadır. Konu hakkında başvurulan kaynak ve araştırmaların değerlendirildiği giriş bölümünün ardından ilk bölüm Kudüs'ün kent kimliğini tanımlamaktadır. İkinci bölüm bu kimliğin oluşmasında katkı sunan mekânı ve siyasi figürleri konu edinmektedir. Din kenti özelliğinin ona kattığı değerin İslam devletleri zamanından beri devam eden özellikleri Kudüs'te vakıfların gelişmesine katkı sağlamıştır. Bu anlamda şehir siyasetine yön veren ileri gelenler için önemli bir kaynak olan bu müesseselerin etkisi ve devletin bu kurumlarda görev alanlar ile olan ilişkisi ikinci bölümde incelenmiştir. Şehirdeki servet dağılımını ortaya koymayı da amaçlayan bu bölümde Osmanlı devletinin Kudüslülere sunduğu önemli ikramlardan birisi olan surre üzerinde de durulmuştur. Son bölüm ise Osmanlı devletinin tebaasına sunduğu bir imtiyaz olarak şikâyet mekanizmasının Kudüs özelinde işleyişi ve konu dağılımları üzerinden değerlendirmeleri yapılmıştır. Tezin ana kaynakları Filistin Arşivlerinde bulunan şeriʽyye sicilleri ile Başbakanlık Osmanlı Arşivinde bulunan şikâyet defterleridir. Ayrıca bu iki hukuk kaynağına ek olarak fetva mecmuaları ile dönem kroniklerinden istifade edilmiştir. Introduction Historically, the area which later became geographic Palestine under the Mandate fell under the domination of various outside forces. Since the Islamic expansion alone portions of Palestine were controlled by numerous successive regimes including the Umayyids, Abbasids, Tulunids, Fatamids, Seljukids, Crusaders, Ayyubids, Mamelukes, Ottomans, British, Jordanians, and Israelis. Many factors made Palestine a covetous object for neighboring regimes and ideologies. The area is and was a strategic territorial buffer between the Levant in the north and Egypt in the south. Palestine served as a point of arrival and departure for religious pilgrims and economic goods. Lacking the indigenous natural resources to resist, a strong internal demographic cohesion, and a tradition of central governmental authority, the Arab inhabitants of Palestine repeatedly accepted, opposed, or accommodated themselves to outside influences. Only in the middle of the 20th century did a separate indigenous Palestinian Arab national movement begin to develop and then largely in reaction to Zionism. In the 20th century, the Arab world and the Great Powers and Zionism/Israel greatly influenced the historiographic evolution of Palestine and the Palestine question. After World War I, Cairo, Damascus, Baghdad, Beirut, Amman and other Arab capitals individually concentrated on seeking first to rid themselves of British and French physical presence. Cuno THE ORIGINS OF PRIVATE OWNERSHIP OF LAND IN EGYPT: A REAPPRAISAL In the historiography of Egypt it has long been accepted that private ownership of land was introduced in the nineteenth century.' This development in statute law has often been linked analytically to a process of "moderni~ation."~Mod- ernization theory posits a fundamental dichotomy between two ideal-type so- cieties, the traditional and modern, which implies an equally sharp discontinu- ity between historical eras: before and after the beginning of modernization. In this view, traditional societies lack the potential for generating significant social change from within. Change results rather from the expansion of communica- tions and diversification of technology worldwide from modem Europe and North America. In the process of modernization, traditional norms and struc- tures break down in the host societies, and new, rational values and institutions emerge in their place. The development of Egypt's new land regime is usually considered one such change. In most historical studies to date, the impact of Europe and/or the rise of powerful reformers influenced by European ideas have been seen as crucial to the beginnings of modernization in the Middle East. For Egypt, the two events most symbolic of this are the French occupation of 1798-1801and the reign of Muhammad Ali Pasha, 1805- 1848, the "founder of modem Eg~pt."~On closer examination of the sources, however, the evidence shows not historical discon- tinuity but its opposite; not the shattering and replacement of institutions but their dynamic evolution, due as much to indigenous forces as to outside influ- ence~.~This calls for a reappraisal of socioeconomic change in Egypt, of its relationship to European influences, and of the significance to it of reform legis- lation.

    LEGAL PROTECTION AND CIRCUMVENTION OF RIGHTS FOR CULTIVATORS IN MANDATORY PALESTINE Kenneth W. Stein In the immediate wake of communal violence that plagued Palestine in August 1929, High Commissioner Sir John Chancellor, himself favorably disposed to Arab claims to Palestine, succinctly defined the intermediary role His Majesty's Government was playing between Arab and Jew. He said that "there is a tendency here to regard the Government as sort of umpire and scorer, trying to hold the balance between the two races, noting when one scores off the other, and regarding it as only fair that the next point in the game should be scored by the race that lost the preceding one."1 The general ebb and flow of policy in Palestine was determined by the confines of the Mandate's articles and the Balfour Declaration, which appeared as its preamble. When the High Commissioner, Colonial Office, or Palestine administration officials strayed from those bounds, protests were heard in threatening decibels from segments of both the Arab and Jewish communities. In November 1921, for example, after the riots of the preceding May, High Commissioner Sir Herbert Samuel somewhat allayed Arab apprehensions about all of Palestine being turned over to the Zionists, by conferring upon some 2,500 Arab cultivators the exclusive right to farm some of the most fertile land in Palestine. The signing of the Beisan Agreement, in turn, angered those Zionists who had prematurely contemplated easy access to these 300,000 metric dunams2 of state domain. After the 1929 disturbances, the Passfield White Paper of October 1930 temporarily put the Zionists on notice that implementation of the national home concept would be postponed.

They will answer tears with blood and bury your diplomatic documents in the ashes of your own homes.1 With these prophetic words Rubanovich captured two elements of the Left’s critique of Zionism (a decade before the movement was formally launched): that it was bound to violate the rights of indigenous Arabs, and that it would do so by using international diplomacy to secure its position. In other words, using terminology that was not yet common, Zionism was condemned for its colonial practices vis-à-vis the indigenous population, and for its potential association with imperialist powers. How this set of ideas gave rise to different movements and activists, shaped by subsequent historical circumstances, is the topic of this article.

He was a devoted family man and gave generously of himself to 10.6082/hjh8-8n25 his students, colleagues, and friends. He leaves a rich research oeuvre that dates URI back to his student days in the late 1950s and early 1960s, when he was enrolled in the Arabic and Middle Eastern Studies Department of the Hebrew University of Jerusalem. There he encountered such luminaries as Uriel Heyd, David Ayalon, and Gabriel Baer, who sparked his interest in the Mamluk and Ottoman Empires and the social history of the Middle East. His doctoral dissertation, awarded in 1969 by the University of California, Los Angeles, was written under the supervi- sion of the renowned Islamic scholar Gustave von Grunebaum. In his dissertation (which was published in book form in 1982 1), Winter analyzed the writings of the celebrated Egyptian Sufi ʿAbd al-Wahhāb al-Shaʿrānī (d. 973/1565), thus shedding light on aspects of Egypt’s social and religious life in the sixteenth century after the Ottoman conquest in 1517. In 1972, he joined the Department of Middle Eastern and African History at Tel Aviv University and became one of its pillars until his retirement in 2004.

Kressel and Reuven Aharoni Is there empirical evidence supporting the surprising Ḥamas claim that a large part of the Palestinian Arabs are not indigenous to this area but rather immigrated from surrounding countries? On March 23, 2012, the Ḥamas minister of the interior and of national security, Fathi Ḥammad, slammed Egypt for not helping to prevent fuel shortages in the Gaza Strip. He then averred that Gaza deserved more brotherly assistance from Egypt, saying that “half of the Palestinians are Egyptian and the other half are Saudis.”1 This dramatic assertion raises questions. Was Ḥammad simply overstating his people’s links to a country whose help he sought, or was he reporting something true, if largely unknown, about Palestinian roots? The answer matters, because the statement marks perhaps the first time a prominent Palestinian leader openly departed from a well-entrenched mythology about the Palestinian-Israeli conflict.
