ORDER

Sri Shaik Khasim Saheb filed a complaint dated 03-05-2017 which was received by this Commission on 03-05-2017 for not getting the information sought by him from the Public Information Officer/ The Mandal Educational Officer, Huzurnagar Mandal, Suryapet District.

The brief facts of the case as per the Complaint and other records received along with it are that the complainant herein filed an application dated 28-03-2017 before the PIO requesting to furnish the information under Sec.6(1) of the RTI Act, 2005, on the following points mentioned in his application annexed.

Stating that the complainant did not get any reply from the Public Information Officer, he preferred this Complaint before the Commission requesting to arrange to furnish the information sought by him u/s 18(1) of the RTI Act, 2005.

Basing on the material papers available on record, the complaint was taken on file and notices were sent to the parties concerned directing them to appear before this Commission for hearing on 09-05-2018 at Hyderabad

The case is called on 09-05-2018 at Hyderabad. The complainant is absent. The Public Information Officer/ Shri P. Lakpathi, Mandal Educational Officer, Huzurnagar Mandal, Suryapet District is present.

Heard the Public Information Officer and perused the records.

Shri P. Lakpathi, Mandal Educational Officer, Huzurnagar Mandal, Suryapet District stated that through letter No.32/MRC/HNR/2017, dated 04-04-2017 furnished the replies which are given by Telangana Recognized School, Management Association, Huzurnagar Mandal. The complainant filed application dated 28-03-2017 before The Mandal Educational Officer, Huzurnagar Mandal, Suryapet District with a request to furnish the details of private schools and also details of the fees collected during the period 2013-2018.

The Commission is of the view that the District Educational Officers and the RJDs are the sanctioning authorities to give permission to open the private schools.

As such it is for the District Educational Officer/Mandal Educational Officer to furnish the information relating to the private schools in the mandal to the complainant.

On perusal of the District Educational Officer, proceedings No.1458/2009 dated 15-02-2010, which are available in the case file, the District Educational Officer, Nalgonda renewed the recognition of one of the primary school in Huzurnagar Mandal with a condition prescribed in Government Order No. 1 and also issued directions of the Private Schools. At item No. 7 & 9 of the said proceedings dated 15-02-2010, the District Educational Officer directed the correspondent of the private school, that the related records and accounts shall be furnished every year by 30th September and the fee structure fixed by the Government body shall be got approved by the District Educational Officer every year. As such the information sought by the appellant shall have to be furnished by the District Educational Officer only.

Hence, in view of the above position the District Educational Officer and Mandal Educational Officer are directed to furnish the information to the extent available relating to private schools to the complainant within (15) days from the date of receipt of this order under intimation to this Commission.
