By-Law Number 427-2007 -Appoint members to Committees - ARJOURNMENT - I N Brighton, Ontario N December 18, 2006 The Council of the Corporation of the Municipality of Brighton met on the above date at 7:00 p.m. in the Council Chambers, MEMBERS PRESENT: Mayor Chris Herrington; Councillors Mile Vandertoorn, Brian Ostnmder, Emily Rowley, Craig Kerr, Chuck Ward and Anna Moskaluk Staff Members: Jim Phillips, Bruce Davis, Ken Hurford and Helen Bryant Public Meeting called to order. DFCLAR4TJON OF PECUNIARY INTEREST None declared. Public Meeting #1 The purpose ofthe first public meeting is to request comments on a proposed Zoning By law Amendment for the following application: File No: Zoning By-law No. 421-2006 Applicant Thomas Lance Location: S Centre Street, Municipality of Brighton The Planner advised that notice of the public meeting was sent by first class mail on November 27th 2006, to all property owncrs within 120 metres of the subject property. Notice was also circulated to all the agencies required under the Plaiming Act In addition, a simi notice was also posted on the property. Thomas Lance wishes to enlarge the existing dwelling on his lot at 8 Centre Street. Mr. Lance wishes to add a new attached garage and storage area (approximately 600 square feet) as well as a family room (approximately 430 square feet). The proposed addition would have a setback of 4.0 feet (122 metres) from the north property line which is an interior side lot line. This complies with the minimum interior side yard setback requirement of 1.2 metres. Mr. Lance is requesting special consideration with respect to the setback from the west property line which is rear lot line. The Zoning By-law requirement is 7.5 metres (24.6 feet). Mr. Lance is requesting a setback of 4.0 feet, An issue that should be considered is whether approval of the requested special zoning could result in significant expansion of buildings beyond what is illustrated on the site plan. The R2 Zone permits up to 40 percent lot coverage of all buildings and structures. Mr. Lance’s home (1800 square feet) is currently covering approximately 18 percent of the lot The proposed addition (1030 square feet) would increase this to approximntely 28.3 percent An approach that would limit additional future construction would be to cap the maximum lot coverage at an amount less than the P2 maximum of 40 percent In this case it would seem appropriate to establish a cap of 32 percent This would leave some capacity for a small accessory building such as a garden shed. The special R2-11 provisions are proposed as follows: i. Maximum rearyard 1.2 metres ii. Maximum lot coverage 3.2 percent Thomas Lance supported the proposed By-law No one present opposed the proposed By-law. Public Meding #2 The purpose ofthe second public meeting is to request comments on a proposed Zoning By-law Amendment for the following application: File No: Zoning By-law No. 422-2006 Applicnnt: Randy Whitehouse and Arleen Davis Location: Pad of Lot 30, Concession 1, North side of White’s Road The Planner advised that notice of the public meeting was sent by first class mail on November 27th 2006 to all property owners within 120 metres of the subject property. Notice was also circulated to all the agencies required under the Planning Act and a sign notice was posted on the property. The applicants were granted provisional Consent (B22-2006) on October 16, 2006 to create a new lot of approximately 4.5 acres (1.8 hectares) for rural purposes. The consent application proposed the severance of lands with an area of 1.8 hectares (4.5 acres) from a property of 40.0 hectares (100 acres). The proposed new lot would have a frontage of 82.3 metres (270 feet) on White’s Road and a depth of 190 metres (624.5 feet). There is an existing dwelliog, barn and three small sheds on the severed parcel. The retained parcel would have an area of approximately 38.4 hectares (95 acres) and a frontage of 320 metres (1050 feet) on White’s Road. The lot to be retained is currently vacant however a single detached dwelling is proposed. The lot proposed to be severed is currently zoned Rural (RU). The lot to be retained is currently zoned Rural (RtJ) with lands adjacent to two watercourses being subject to the Floodprone Overlay Zone. The proposed rezoning would change the zoning of the parcel to be severed to Rural Exception No. 21 (RU-21). The provisions of the RU- 21 Zone would set special lot area and lot frontage provisions for the lot to be severed; in addition a special rear yard setback (7.0 metres) for the existing barn would also be established. Randy Vhitehouse supported the proposed By-law No one present opposed the proposed By-law. Councillor Ji’Iike Vw,derioorn declared a co:i/lict in the nextportion of the public meeting dealing with Zoning By-lan’ No. 423-2006 (George & Diane A/lore) and left the Council Chambers. Public Meeting #3 The purpose of the third public meeting is to request comments on a proposed Zoning By law Amendment for the following application: File No: Zoning By-law No. 423-2006 Land Owner: George and Diane Allore ApplicantlAgent: Linda Reddall Location: Part of Lot 29, Concession 1,494 Scriver Road The Planner advised that notice ofthe public meeting was sent by first class mail on November 27 2006 to all property owners within 120 metres of the subject property. Notice was also circulated to all the agencies required under the Planning Act and a sign notice was posted on the property. The agent Linda Reddall has submitted an offer to purchase a lot fronting on Scriver Road owned by George and Diane Allore. Ms Reddall wishes to establish a dog kennel on the property. A dog kennel is not permitted in any zone in Brighton as a “right”, meaning that in each circumstance a site specific rezoning is required. This is also consistent with the provisions of the Dog Control By-Jaw (No. 287-2005) which states that “a site specific amendment to Zoning By-law No. 140-2002 shall be inquired prior to the licensing of any dog kennel. Ms. Reddall is proposing to use an existing barn that is situated approximately 59 metres (195 feet) west of Scriver Road to house the kennel. The subject rezoning application requested that a special zone be established on the subject property to permit the establishment of a dog kennel. The building that is proposed to house the kennel is situated more than 55 metres (iSO feet) west of Scriver Road. The distance from this barn to the Mwy Esther Cohn lot created earlier in 2006 and to Mm. Colin’s dwelling is just over 300 metres. There are no other existing dwellings or rural residential lots that are closer. The proposed special Rural Zone; RU-22 would specifically permit a kennel on the subject lands and stipulate that all buildings and structures associated with a dog kennel shall be setback a minimum of 55 metres (180 feet) from the front Jot line. Linda Reddall (Agent) supported the proposed By-law Ms. Reddall has no intentions of a public boarding kennel. This kennel is for exclusive dogs, highly trained. Dogs am not allowed to mu free, these aro world class dogs and temperament is a # I consideration. frfr. Arnold Peppy inquired to the number of dogs and fencing requirements. Ms. Reddall said the by-law allowed 3-20 dogs as in kennel licence requirements. Would like a double fenced area to prevent dogs from getting out, the material is waiting to be installed. Randy Whitehouse was most concerned with dogs barking. Ms. Reddall responded these dogs are well trained and does not permit barking.

    TOWARDS A MULTI-PARTY POLICY MONITORING FRAMEWORK FOR EVALUATING INFRASTRUCTURE ENVIRONMENTAL ASSESSMENTS ON THE OAK RIDGES MORAINE by Katrina Broughton A thesis submitted to the School of Urban and Regional Planning In conformity with the requirements for a degree of Master of Urban and Regional Planning Queen’s University Kingston, Ontario, Canada (September, 2008) Copyright © Katrina Broughton, 2008 Abstract The Oak Ridges Moraine, located in south-central Ontario, is recognized for its ecological importance in providing “clean and abundant water resources, healthy and diverse plant and animal habitat, an attractive and distinct landscape, prime agricultural land, and sand and gravel resources” (Ministry of Municipal Affairs and Housing, 2002). It is protected by the Oak Ridges Moraine Conservation Plan (2002). A number of initiatives are ongoing to develop monitoring capabilities across the Oak Ridges Moraine (Monitoring the Moraine Project, 2008; Ontario Ministry of Municipal Affairs, 2008). The purpose of this thesis is to develop and test a multi-party policy monitoring framework to determine if infrastructure environmental assessments on the Oak Ridges Moraine comply with the policies of the Oak Ridges Moraine Conservation Plan (ORMCP) and meet best practices of environmental assessment identified in the literature. The multi-party policy monitoring framework developed for this research has two dimensions: 1. A moraine-wide survey and map of infrastructure environmental assessments contributing to a “governance watch” (Francis, 2006a; Francis, 2006b) perspective of infrastructure; and 2. An evaluation of an infrastructure environmental assessment case study (York Region’s Lower Leslie Street Trunk Sewer and 19th Avenue Interceptor Sewer) against a set of criteria to determine if it complies with the ORMCP and environmental assessment best practices.
