Washington, D.C. 20580 [email protected] Dear Mr. Levine: For far too long multilevel marketing (MLM) companies have used deceptive marketing to promote the business opportunity and sell their wares.1 In fact, the problem is so longstanding and pervasive that the MLM industry’s self-regulatory body, the Direct Selling Self-Regulatory Council (DSSRC), stated just last month that: Though the industry has made significant strides to curtail the dissemination of unsupported claims regarding income potential …, there is still a great deal of work ahead of us to assure that the product and earnings claims communicated to consumers and potential salesforce members are truthful and accurate.2 Moreover, industry trade group, the Direct Selling Association (DSA), published an article in its January 2021 journal that stated, “[d]irect sellers will never be able to wholly prevent distributors from making improper claims.”3 Such pessimism is cause for concern as improper health and income claims not only deceive consumers but also lead to social, emotional, and physical harms, and financial hardship.4 Given this backdrop, TINA.org urges the Commission to implement a penalty offense program targeting the direct selling industry and its market-wide practice of utilizing deceptive earnings representations and false health claims.5 For more than 40 years, the FTC has consistently pursued individual MLM companies making

    How Have The Ponzi Schemes/UDSs/CISs Duped the Investors in India 1 Preface Though the nature of duping the public by promising unrealistic returns on their investment has been practiced since ages, in independent India, especially in the last few decades, there have been several such scams related to Ponzi scheme/unregulated deposit scheme (UDS)/illegal Collective Investment scheme (CIS) which have duped millions of gullible persons and have fraudulently collected billions of Rupees from them. Although the basic premise of these scams have remained same: collect money promising very high returns, pay the initial investors out of proceeds collected from subsequent investors till the scam/schemes bust, etc., the modus operandi has been evolving over the years. The idea for writing a book like this came up in discussion between teams of IEPFA and IICA, when it was discussed and decided to bring to the attention of public various Ponzi schemes/UDSs/CISs which have taken place in India over the years. To spread the message of such defrauding financial scams far and wide this book is being kept as an open source resource. In preparation of this book, active assistance was provided in terms of carrying out research, writing of cases, etc. by the research associate Shubhasree Bhadra. We are also thankful to the teams at IICA and IEPFA for their valuable comments on the subject. QNET Ltd managing director JR Mayer said the world today is in a consolidation of the workforce that cannot possibly provide enough jobs. "Through direct selling, we are able to provide business skills, training and, most important, jobs to developing parts of the world where they (jobs) can be scarce," he told Bernama in an interview. Mayer said according to the World Federation of Direct Selling Associations (WFDSA), which represents direct selling associations from more than 60 countries, the market size of the industry globally grew 5% last year to hit US$153 billion (RM483.3 billion) in sales. He said globally, 90 million people are involved in the direct selling business. QNET, the flagship company of QI Group, founded by Malaysian entrepreneur Datuk Seri Vijay Eswaran and Filipino entrepreneur Joseph Bismark, sells a variety of exclusive lifestyle and wellness products around the world through the multi-level marketing or direct selling method. The company is represented by more than 25 worldwide offices and agencies as well as independent representatives in more than 100 countries. Last year, the company recorded a turnover of about US$500 million (RM1.57 billion) to be ranked among the top five direct selling companies in Asia.
