Declaration of Pecuniary and Conflicts of Interest Section 451 of the Local Government Act 1993 requires that if a councillor or member of a council or committee has a pecuniary interest in any matter before the council or committee, he/she must disclose the nature of the interest to the meeting as soon as practicable and must not be present at, or in sight of, the meeting, when the matter is being discussed, considered or voted on.

A pecuniary interest is an interest that a person has in a matter because of a reasonable likelihood or expectation of financial gain or loss (see sections 442 and 443 of the Local Government Act 1993).

A non-pecuniary interest can arise as a result of a private or personal interest which does not involve a financial gain or loss to the councillor or staff member (eg friendship, membership of an association, or involvement or interest in an activity). A councillor or staff member may elect to leave the Council Chambers during consideration of the matter.

Parts of the Meeting that can be Closed to the Public Section 10A of the Local Government Act 1993 states that a Council, or a Committee of the Council of which all the members are Councillors, may close to the public so much of its meeting as comprises: a) The discussion of any of the matters listed below, or b) The receipt or discussion of any information so listed Matters & Information (a) Personnel Matters concerning particular individuals (other than Councillors). (b) Personal hardship of any resident or ratepayer. (c) Information that would, if disclosed, confer a commercial advantage on a person with whom the Council is conducting (or proposes to conduct) business. (d) Commercial information of a confidential nature that would, if disclosed: (i) Prejudice the commercial position of the person who supplied it, or (ii) Confer a commercial advantage on a competitor of the Council, or (iii) Reveal a trade secret. (e) Information that would, if disclosed, prejudice the maintenance of law. (f) Matters affecting the security of the Council, Councillors, Council Staff or Council property. A Council or Committee of the Council may allow members of the public to make representations to or at a meeting, before any part of the meeting is closed to the public, as to whether that part of the meeting should be closed.

A meeting is not to remain closed during the discussion of anything referred to in the above list except for so much of the discussion as is necessary to preserve the relevant confidentiality, privilege or security, and if the matter concerned is a matter other than a personnel matter concerning particular individuals, the personal hardship of a resident or ratepayer or a trade secret - unless the Council or Committee concerned is satisfied that discussion of the matter in an open meeting would, on balance, be contrary to the public interest.

10.2 Precis of Correspondence GOV:MGS:AGS Author: General Manager Purpose: Matters for consideration by Council Information Items: 10.2.2 Letter of request - Mission 10.2.1 Correspondence for Information Office of Local Government (OLG) Advice has been received from the OLG that Council elections have been postponed for 12 months and may be extended further until 31 December 2021. Where elections were held for Mayor’s in 2018 the two year term expires and elections will need to be held in our case in September for both Mayor & Deputy Mayor.

Recommendation:

That Council note the postponement of the Local Government elections.

10.2.2 West Wyalong Mission - Rankins Springs Parish On behalf of St Kevin’s Church, Boomerang Street, Rankins Springs requesting an exemption from the $452 annual access charge for potable water supply to be introduced by Council from 1 July 2020.

While a religious organisation is exempt from rates under s555 of the Local Government Act 1993, a religious organisation is not exempt from charges under s501 of the Act.

Recommendation:

For Council determination.

Project Updates McGee Street Rehabilitation – Stage 1 (Hillston Motel to Hillston Hardware) is progressing ahead of schedule with the following works complete: • All pavement layers at finished height, shaped and compacted • Concrete works (kerb and gutter and no-fines concrete layer) • Subsoil and stormwater drainage Works crews will proceed onto stage 2 (Hillston Hardware to High St intersection) on Monday 7 April 2020. Contractors are on site to lower Telstra, NBN and Council communications.

Hillston Aerodrome – Pavement testing of the Hillston Aerodrome has been undertaken by Aitken & Rowe Geotechnical Engineers. The purpose of the testing is to get a pavement load rating so that council are then aware of what aircraft can/can’t land on that airstrip. The outcome of the testing is pending.

Carrathool Rd Pave and Seal – Full 4km of road has been brought to final surface level and awaiting final trim. Sealing complete on 1km section of road whilst other sections are drying out from significant rainfall over the job site.

Lachlan Valley Way Pave and Seal – Side-track and subgrade formation is complete on next 3.7km section of heading south from end of existing seal to approx. 200m south of Cowl Cowl Station entrance. Gravel haulage continues in between wet weather events.

Lachlan River Rd Pave and Seal – Side-track and subgrade formation is complete on next 1.6km of sealed pavement heading north from existing seal. Gravel haulage continues in between wet weather events.

Hillston Bore-5 investigation – Council has completed the process of flushing of Bore-5 on Lachlan River Road to address water quality issues. This project was requested by the Department of Primary Industry & Environment (DPIE) to find a way to go forward to address the water quality and utilize the bore for drinking water.

Council has submitted a report with all water testing results to the Public Health Unit on 26/03/2020 for review and further recommendations to resolve water quality issues.

A detailed report will be submitted to the council with Public Health Unit (PH unit) recommendations in due course.

10.4 Heavy Vehicle Safety and Productivity Program - Round 7 Funding GS:PRO:HVSPP Author: Director Infrastructure Services Purpose: To outline to Council the projects nominated under round seven of the Heavy Vehicle Safety and Productivity Program Background The Heavy Vehicle Safety and Productivity Program (HVSPP) is now open for Local Councils. Under Round Seven (7) of the Heavy Vehicle Safety and Productivity Program (HVSPP), the Australian Government will provide up to 50 percent of the total cost of eligible proposals that meet the program objectives. Proposals will be comparatively assessed with a total of $150 million in funding made available.

The Department will use the information provided in the proposed projects to check eligibility and assess proposals for funding recommendation. Where appropriate, priority may be given to councils classified as Category C under Disaster Relief Funding Arrangements (DRFA) relating to natural disasters during the round. Proposals which have been lodged with the National Bushfire Recovery Agency (NBRA) or Emergency Management (EMA) are not eligible for supplementary or additional funding under Round Five of the Bridges Renewal Program (BRP).Projects that are eligible for funding under the stream must meet one or more of the following conditions: • Proposals on the National Land Transport Network; • Rest Areas; • Parking/decoupling bays; • Technology trials; • Road enhancements; • Bridges, where they are a necessary component of the works and do not exceed 40 percent of the total project funding; • Demonstration projects; • Livestock transport industry proposals, provided such a facility is in a drought declared area and associated with a public road, and initiated and delivered by a local, state or territory government; and • Livestock vehicle effluent collection and treatment facilities (provided such a facility is associated with a road and access is similar to that of a traditional rest area).

Applicants may submit as many projects as they see fit. Applicants should demonstrate they have considered the level of monetary and in-kind co-contribution to the project. Projects with co-contribution from multiple sources are viewed favourably by the Project Assessment Panel as they provide compelling evidence of stakeholder alignment. Co-contribution for Council projects is not compulsory but is an advantage in the decision-making process.

This year’s project nominations and associated funding request, along with Council contributions is outlined in the table below. That Council approve the following projects under round seven of the HVSPP:

1. Carrathool Road – Pave & Seal $1,000,000. 2. Hillston HV Bypass Upgrade – Stage 1, $800,000. 3. Noting the 50% required co-contribution will be sourced from the Roads to Recovery (RTR) grant funds of $500,000 from the 2020/2021 Financial Year, and that the co- contribution of $400,000 be sourced from the Financial Assistance Grant Roads component for the 2020/2021 Financial Year.

10.5 Pulletop Road Closure RDS:RC:PRC Author: Manager Infrastructure Services Purpose: Request permission to close public access to northern section of Pulletop Road to support the Reviving Malleefowl project Background: Local Land Services (LLS) is working with landholders within Carrathool Shire to help protect and restore Malleefowl habitat to increase Malleefowl numbers through the Reviving Riverina’s Malleefowl project.

Land adjoining both sides of Pulletop Road (located adjacent to Rankins Springs Road north of Griffith) has been selected as one of these habitats. LLS has requested that Council assist in the project by allowing LLS to install gates and fencing across the road reserve to restrict public access through the habitat.

The section of Pulletop Road requested is shown below with the habitat area outlined in green. This section is unformed and is not maintained by Council, where access to Pulletop Nature Reserve will be maintained. The same landholder owns both sides of this section of Pulletop Road and is one of the main proponents of the project.

LLS request permission from Council to install fencing and gates at the locations marked on the map above. The project is fully funded by LLS. The restricted access would not create any significant implication in this area and would enable greater biodiversity as well as provide safe habitat for a species otherwise thought extinct.

Under Division 2 of the Roads Act 1993 Council can permit a landholder to erect a gate across a road where it intersects a boundary fence. It is recommended that Council grant permission for the landholder to erect a fence and gate at the locations shown.

1. 2. 4. NOTICE OF COMMENCEMENT (Prescribed Condition) The applicant is to submit to Council, at least two (2) days prior to the commencement of any works, a ‘Notice of Commencement of Building or Subdivision Works’.

5. BUILDING INSPECTIONS The applicant must obtain a Compliance Certificate pursuant to Section 6.16 of the Environmental Planning and Assessment Act 1979, as amended, from Council or an accredited certifying authority, certifying compliance with the Building Code of Australia for the stages of construction listed in Column 1. For the purposes of obtaining the Compliance Certificate the works must be inspected by the accredited certifying authority at the times specified in Column 2.

NOTE 3: Submission of the bracing plan and the Truss and Frame Certificate is required seven (7) working days before the frame inspection.

6. CONFORM WITH APPROVED PLANS The development shall take place in accordance with the approved development plans as submitted with DA2019/003 and DA2019/003 Modify. Any alterations or additions marked by Council on the approved plans and/or the specifications must be carried into effect.

7. HOURS OF OPERATION The applicant must take all reasonable steps to minimise dust and noise generation during the demolition and/or construction process. No offensive noise must be emitted during either process. Such activities must only be undertaken Monday to Friday 7.00am to 6.00pm and Saturday 8.00am to 1.00pm, excepting public holidays.

8. RUBBISH AND DEBRIS All building rubbish and debris, including that which can be wind-blown, must be contained on site in a suitable enclosure, approved by Council, at all times prior to disposal at Council's Waste Management Centre. The container must be erected on the building site prior to work commencing.

Materials and sheds or machinery to be used in association with the construction of the building must not be stored or stacked on Council’s footpath, nature strip, reserve or roadway.

NOTE 1: No building rubbish or debris must be placed, or be permitted to be placed on any adjoining public reserve, footway, road or private land.

NOTE 2: The applicant must retain weighbridge certificates, receipts or dockets that clearly identify where waste has been deposited. Documentation must include quantities and nature of the waste.

This documentation must be provided to Council prior to application for an Occupation Certificate for the development.

NOTE 3: The suitable container for the storage of rubbish must be retained on site until an Occupation Certificate is issued for the development.

The reason for the imposition of the above consent conditions is as follows: 1. To achieve the objectives of Section 1.3 of the Environmental Planning and Assessment Act 1979, having regard to the relevant matters for consideration contained in Section 4.15 of the Act and the Environmental Planning Instruments applying to the land; 2.
