“Following the failure of the owners of this property to comply with the terms of an Enforcement Notice requiring compliance with conditions 3, 6, 7, 8 and 9 of planning permission Reg. Ref. D97A/0684 for development comprising “Retain and complete replacement dwelling on approved site”, the Council’s Legal Services Department has been instructed to seek an Order pursuant to Section 160 of the Planning and Development Act 2000 (Court Injunction).

Draft affidavits have been prepared and arrangements are in hand to have these examined by Counsel with a view to having the case entered for listing during the coming court term.

Any person seeking to dispose of property the subject of an Enforcement Notice would experience difficulty in showing clear title to a potential purchaser as the making and issue of an Enforcement Notice will appear on the Planning Register.”

“To ask will the Manager write to the RPA requesting additional lighting at the Dundrum station entrance from Dundrum Main Street?”

Reply:

“The RPA have already acknowledged that the public lighting between Dundrum Main Street and the Dundrum LUAS stop is inadequate and have undertaken to effect an upgrade to same.

A communication has been forwarded to the RPA requesting that the improved lighting be expedited as soon as possible. A response to that communication is currently awaited.”

DDP/62/05 Major Planning Applications

D04A/1254 10-Feb-2005 Permission

Location: Bowl Leisureplex, No. 62-79 St. Laurence's Park & Stillorgan Public Library and adjoining council owned land, Stillorgan, Co. Dublin.

Proposal: For a mixed use development on a site comprising the Stillorgan Bowl Leisureplex No.'s 62-79 St. Laurence's Park, the existing Stillorgan Public Library and adjoining Council owned land, which is the subject of a sale agreement with Dun Laoghaire Rathdown County Council and also an ancillary area of Council owned land where environmental improvement works and traffic management works are proposed. The subject site comprises 1.59 hectares bounded by St. Laurence's Park to the North, Lower Kilmacud Road to the South, N11 Stillorgan Road to the East and Old Dublin Road to the West.

The proposed development involves the demolition of all existing structures on the site including the Leisureplex building Dun Laoghaire Rathtdown County Council temporary library building, No. 62 and 63 St. Laurence's Park and 16 two- storey Local Authority maisonette units at No. 64-79 St. Laurence's Park.

The proposed development is a mixed-use scheme comprising a total of 314 No. residiential units (82 no. 1-bed, 199 no. 2-bed and 33 no. 3-bed and includes 40 no. social housing units and 8 no. live/work units); approx 2,238 sq.m. gross floor area retail; approx. 3,938 sq.m. gross floor area offices; approx. 3,719 sq.m. gross floor area (indoor) leisure/recreational facilities (Class 11(e) use); approx. 486 sq.m. gross floor area crèche; approx. 1,019 sq.m. gross floor area new public library and ancillary car parking with associated landscaping and site development works. The overall development will consist of approx. 40,349 sq.m. gross floor area overall in 15 No. mixed use blocks (Blocks A,B,C, D, E, F, G, I, J, K, L, M, N, O, P) as follows:-

Block A : 5-storey over double basement - comprising c.2,091 sq.m. double height leisure/recreational facility (Class 11(e) use) at basement level c. 792 sq.m. retail at ground floor level and 4 No. office units with combined gross floor area c. 3,938 sq.m. over four floors above.

Blocks B, C, D, E & F : 7 storey over double basement comprising c. 1,628 sq.m. leisure/recreational facility (Class 11(e) use) at upper basement level, 5 No. retail units at ground floor level (combined gross floor area c. 1,183 sq.m.) with 80 No. apartments in total over four upper floors plus two additional levels of setback penthouses: each block comprising 16 No. apartments in the form of 5 No. 1-bed units, 10 No. 2-bed units and 1 No. 3-bed setback detached penthouse unit.

Block G : 6/8 storey atrium building - comprising c. 1,019 sq.m. public library at upper ground floor level, 71 No. apartments comprising 6 No. 2-bed duplex units at lower ground floor level and 65 No. units from lower ground floor to sixth floor level in the form of 19 No. 1-bed duplex units, 1 No. 2-bed unit, 44 No. 2 bed duplex units and 1 No. 3-bed duplex unit.

Block I : 15- storey corner building (at junction of Lower Kilmacud Road and N11 Stillorgan Road) comprising c. 263 sq.m. ground floor (part double height) retail and 34 No. units which includes 1 No. ground floor 2 - bed duplex live/work unit and 33 No. apartments over thirteen floors comprising 30 No. 2-bed units and 3 No. 3-bed setback duplex penthouses.

Blocks J, K and L : 8 - storey comprising 51 No. units which includes 6 No. 2-bed live/work duplex units over ground and first floor level and 45 No. apartments over four upper floors plus two additional levels of setback penthouses, in the form of 12 No. 1-bed units, 18 No. 2-bed units, 6 No. 3-bed units, 6 No. 3-bed setback penthouses and 3 No. 3-bed setback detached penthouses.

Block M : 7 storey - comprising 15 No. units which includes 1 No. 2 bed live/work duplex unit over ground and first floor level and 14 No. apartments over four upper floors plus one additional level with setback penthouse, in the form of 4 No. 1-bed units, 7 no. 2-bed units, 2 No. 3-bed units and 1 No. 3-bed setback detached penthouse.

Blocks N & O: 7 - storey and 6 - storey respectively - comprising c. 486 sq.m. gross floor area crèche across ground floor level and 29 No. apartments over upper floors comprising 8 No. 1-bed units, 16 No. 2 - bed units and 4 No. 3 - bed units over five upper floors and 1 No. 3-bed setback detached penthouse on Block N.

Block P : 3-storey social housing - comprising 34 No. apartments in three separate blocks in the form of 14 No. 1-bed apartments and 2 No. 2-bed apartments at ground floor level and 17 No. 2 bed duplex units and 1 No. 3 - bed duplex unit over first and second floors.

The proposed development includes a total of 528 No. car parking spaces with 478 No. car parking spaces and bin storage facilities over two basement levels, 23 No. car parking spaces in service yard and 27 No. surface car parking spaces; 360 No.bicycle parking spaces at basement and surface levels; service yard to the rear of Block A at upper ground floor level and service yard to rear of Blocks B-D at lower ground floor level; children's play area; landscaping works across the site including hard and soft landscaping and tree planting and new boundary treatment along the Lower Kilmacud Road and N11 Stillorgan Road: all associated site development works including a single storey ESB substation and security building (c. 23 sq.m.) in the northeast corner of the site, a second ESB substation at ground floor level in Block N and a new roundabout junction at St. Laurence's Park to facilitate vehicular access to the site.

Vehicular access to the development will be via the existing entrance points at the Dublin Road and St. Laurence's Park with additional access to the social housing in Block P (34 No. units) and Block G (6 no. units) at St. Laurence's Park. Pedestrian access to the site will be via a gated access at street level along the Lower Kilmacud Road and two points along St. Laurence's Park.

An Environmental Impact Statement will be submitted to the Planning Authority with the Planning Application.

“That the Manager ensure that any major planning applications such as that on the Knockrabo site include a levy which would facilitate the completion of the ramping of the Mount Merrion area and specifically the outstanding ramps on the Lower Trees Road.”

The following Report of the Manager was CONSIDERED .

“Members at a Special Meeting of the Council held on the 21/1/’04 adopted a Development Contribution Scheme in accordance with Section 48 of the Planning & Development Act 2000 & incorporated into that scheme is a list of projects that the Council intend to carry out during the period the scheme is operative. The list of projects that the Transportation Department proposes to undertake during the life of the scheme includes provision for traffic calming measures. Any decision in relation to the specific traffic calming schemes to be undertaken and the priority to be afforded to such schemes is a matter for the Transportation Department.

The Development Contribution Scheme provided for the following rates of contribution in respect of planning permissions granted following adoption of the scheme:

The Development Contribution Scheme also provides that the rates of contribution shall be updated from January 1 st each year during the life of the Scheme in accordance with annual increases in the Wholesale Price Index, Building & Construction (Capital Goods). Accordingly, the above rates were increased on the 1 st of January 2005 by 9.39%, which was the increase in the index to 31/12/’04 as notified to the Council by the Central Statistics Office. When this percentage increase is applied to the contribution rates existing at 31/12/’04 in respect of the Residential, Industrial/Commercial and Domestic Extension Classes of Development the revised rates effective from 1/1/’05 are:

Following a discussion the Report of the Manager was NOTED . It was AGREED that the Motion would be forwarded to the Director of Services, Transportation.

“That this Committee calls on the Manager to request that the RPA provides means of access for mobility impaired persons to the Dundrum LUAS Station.”

The following Report of the Manager was CONSIDERED .

“The difficulties related to facilitating mobility impaired access to the elevated Dundrum LUAS stop from the Main Street level have long been acknowledged by the RPA. However, the Light Rail Order granted to CIE by the Minister for Public Enterprise in September 1999 did not physically provide for a direct or assisted means of access for the mobility impaired between the Main Street level and the LUAS stop. While access to the stop for the mobility impaired is available from Taney Road, it is recognised that this arrangement is somewhat convoluted and well divorced from the recently completed bus/LUAS Interchange in front of Usher House.

It had originally been anticipated that in the medium-to-longer term a lift or escalator access arrangement could have been retrofitted locally on foot of more strategic redevelopment proposals for the environs of the stop involving the Taney Bridge undercroft, residual land parcels at Main Street level and the original Station House concourse. Unfortunately that initiative, involving three separate interests, including the Council, has been slow to come to fruition and no detailed programme has yet been advised vis a vis realistic implementation timescales.

A letter has recently been forwarded to the RPA requesting that they revisit, in consultation with the County Council, the feasibility of effecting short-term measures to facilitate improved direct access for the mobility impaired between the new Interchange facility and the elevated LUAS stop. A reply to that communication is currently awaited.”

The Report of the Manager was NOTED . The Motion was PUT and AGREED. It was AGREED that a Report on the issue would be brought to a future meeting of the Area Committee when a reply had been received from the Railway Procurement Agency.

“That the Manager report what is the progress of the Section 160 Injunction Action in relation to (address supplied), planning ref: D02A/1004; have the Legal Services Department liaised with the Private Rental Tenancies Board to establish whether the owner has registered the property (100) and numbers (address supplied) Drive (which are also rented out by him) as per the Landlord and Tenant Act and if not, why they have not used that route to establish legal responsibility to ensure the owner complies with all aspects of the law.”

The following Report of the Manager was NOTED.

None of the properties mentioned in the motion was registered with the Council as a private rented dwelling in accordance with the provisions of the Housing (Registration of Rented Houses) Regulations 1996 & 2000. Since 1 st September 2004, responsibility for registration of private rented dwellings transferred to the Private Residential Tenancies Board pursuant to Part 7 of the Residential Tenancies Act 2004. The Board has confirmed that none of these dwellings is included in their register of private rented dwellings. It is the responsibility of owners of private rented dwellings to register with the Board and failure to register on the part of any such property-owner is a matter for the Private Residential Tenancies Board.”

“To ask the Manager to provide a report on the following difficulties being experienced by Stars of Erin Glencullen: the problems to their property and the spilling onto adjoining properties by the discharge from the roads drain, added to by the increased volume caused by the larger drain system introduced during 2003; to confirm if the manhole built on their property was done with consent and written notification; and to indicate how and by whom this manhole shall be inspected and maintained?”

Reply:

“The Senior Executive Engineer, Road Maintenance and the Roads Inspector met representatives of the Star of Erin and following discussions they have agreed a plan of works to resolve the problems being experienced by the Club.

Club representatives will investigate the problems further and revert to the Council.

Ongoing discussions will continue until the problems are resolved.”

“To ask the Manager to review the exits from Coolkill and Downs to Sandyford Road, to outline what measures can be taken by the Council in improving safety at this location, to indicate if a yellow box might be provided and to indicate what plans, if any there are for the piece of land between those estates and the new wall?”

Reply:

“The exits have been reviewed. In order to improve safety at this location two ramps have recently been installed which will assist with sightline improvement towards the village. There are no plans to provide a junction box, as the location does not meet the Traffic Section criteria outlined at recent meetings.”

“To ask the Manager to report when Dundrum Town Centre will open and to outline the traffic management plans to be implemented to ensure traffic flow in the area, following this?”

Reply:

“The opening of a large part of Phase I of the Dundrum Town Centre is scheduled for March 3rd 2005.

In advance of the opening the Traffic Section has met on many occasions with the Head of Mobility for the Dundrum Town Centre, the Gardai and the consulting traffic engineers acting for the Dundrum Town Centre.

To facilitate the rejuvenation of the Town Centre significant improvements have been made to the Transportation infrastructure in the Dundrum Area generally over the past 5 years. The roads infrastructure includes the construction of the Dundrum By Pass, the Wyckham ByPass and the more recent Wyckham By Pass extension. In addition 3 QBC’s are at an advance stage of design, all leading to/from Dundrum. These are Sandyford Road, Churchtown Road and Taney Road (to Blackrock) also a new bus/LUAS interchange has recently been completed at Dundrum. Design work is also proceeding on the Dundrum – Sandyford Link Road and a report on this scheme is on the Agenda of this meeting.

Whilst the Town Centre is located immediately adjacent to the highly successful LUAS service and on many existing and proposed bus routes it is anticipated that a significant number of visitors to the Centre will arrive by car.

A detailed signage strategy will be implemented on opening which includes fixed signs remote from the Town Centre eg the N11, M50 etc. and also Variable Message Signs close to the centre which will direct cars to the relevant car park (Red/Green/Yellow and also the LUAS car park) and indicate the numbers of available spaces.

The traffic patterns will be monitored closely in the few days after the opening to determine the volumes and the directions from which the cars will arrive.

In addition clearways will be implemented on opening along the key routes to the Centre and double yellow lines are being installed along Sandyford Road from Kilmacud Road to Ballally Roundabout.

Changes are being made to traffic signal stagings and/or timings at the following junctions: Sandyford Road/Wyckham By Pass, Dundrum By Pass/Dundrum Main Street and Dundrum Main Street and Taney Road.

Work on Phase II of the centre commenced in the current year. A Traffic Management Plan is currently underway which covers the wider Dundrum area and will identify necessary improvements to the Transportation Infrastructure for the area. Already improvements are identified such as the link road from the Wyckham By Pass to Blackthorn Drive.”

“To ask the Manager to review the quality of the road and footpath in the Jamestown Cottages area including the entrance and exit to the cottages and to outline what measures can be undertaken by the council to improve safety for pedestrians & motorists?”

Reply:

“This roadway serves 8no. cottages and 3 other dwellings. It is a narrow road. It has two entrances onto Enniskerry Road.

The Council has no proposal to widen this road. Road Maintenance Section is examining the road to ascertain if any works are required.

In the interests of vehicular and pedestrian safety it is proposed to introduce a one-way system on the roadway serving Jamestown Cottages in Kilternan following consultation with local residents and the Gardaí as reported to previous Area Committee Meetings. It is also proposed to erect ‘Children at Play’ signs.

The ingress is proposed to be at the entrance closer to Stepaside Village and the egress is proposed to be at the other entrance, which would then become the exit.

A one-way traffic system when put in place will make the road safer for vehicular traffic and vulnerable road users.”

“To ask the Manager to outline the measures being taken to provide a sound barrier between The Gallops (Orby) and the M50, and to indicate when these measures will commence and finish?”

Reply:

“Noise screens are provided on the South Eastern Motorway in accordance with the provisions of the Environmental Impact Statement that accompanied the scheme.

Noise amelioration measures were not warranted on the south side of the motorway between the Murphystown Road over-bridge and the existing Ballyogan Estate housing. Accordingly the scheme does not provide for noise amelioration at The Gallops/Orby Estate.”

“To ask the Manager to request to provide bus shelters for Ballyogan, this is particularly crucial for the health and comfort of children who find themselves sitting in wet clothes for the duration of the school day?”

Reply:

“The Traffic Section has ongoing meetings with Dublin Bus in relation to the upgrading of the existing bus stop facilities in the County. Dublin Bus have recently submitted proposals for two new bus shelters on Ballyogan Road to Traffic for approval before a forward planning application is made to the Council. Dublin Bus have confirmed that these shelters will be erected this year subject to a grant of Planning Permission.”

“To ask the Manager to report on feasibility of providing pedestrian crossings at junction of Oakdown Road and Upper Churchtown Road?”

Reply:

A clearway was introduced along Upper Kilmacud Road and Blackthorn Drive/Avenue. Double yellow lines will be installed along parts of Wedgewood in the near future to alleviate a traffic hazard caused by poor parking. Double yellow lines will be installed along parts of Drive. Double yellow lines will be installed along significant lengths of Taney Road.

It must be stated that not all LUAS related parking on public roads in housing estates is necessarily an undesirable situation. Where the parking does not result in a traffic hazard or does not impact on the general free flow of traffic then no parking restrictions are considered necessary.”

DDP/92/05 Various issues regarding opening of Dundrum Town Centre

“To ask the Manager given the imminent opening of the Dundrum Town Centre: (i) what measures have been taken by the Council to assist in the management of anticipated increases in road traffic in the Dundrum Area; (ii) what coordinating measures are being taken by the Council and the Town Centre Developers; (iii) to provide an interim report on the recently commissioned Dundrum Area Traffic Plan?”

Reply:

“(i)/(ii) The opening of a large part of Phase I of the Dundrum Town Centre is scheduled for March 3rd 2005.

In advance of the opening the Traffic Section has met on many occasions with the Head of Mobility for the Dundrum Town Centre, the Gardai and the consulting traffic engineers acting for the Dundrum Town Centre.

To facilitate the rejuvenation of the Town Centre significant improvements have been made to the Transportation infrastructure in the Dundrum Area generally over the past 5 years. The roads infrastructure includes the construction of the Dundrum By Pass, the Wyckham ByPass and the more recent Wyckham By Pass extension. In addition 3 QBC’s are at an advance stage of design, all leading to/from Dundrum. These are Sandyford Road, Churchtown Road and Taney Road (to Blackrock) also a new bus/LUAS interchange has recently been completed at Dundrum. Design work is also proceeding on the Dundrum – Sandyford Link Road and a report on this scheme is on the Agenda of this meeting.

Whilst the Town Centre is located immediately adjacent to the highly successful LUAS service and on many existing and proposed bus routes it is anticipated that a significant number of visitors to the Centre will arrive by car.

A detailed signage strategy will be implemented which includes fixed signs remote from the Town Centre eg the N11, M50 etc. and also Variable Message Signs close to the centre which will direct cars to the relevant car park (Red/Green/Yellow and also the LUAS car park) and indicate the numbers of available spaces.

The traffic patterns will be monitored closely in the few days after the opening to determine the volumes and the directions from which the cars will arrive from.

In addition clearways will be implemented along the key routes to the Centre and double yellow lines are being installed along Sandyford Road from Kilmacud Road to Ballally Roundabout.

Changes are being made to traffic signal stagings and/or timings at the following junctions: Sandyford Road/Wyckham By Pass, Dundrum By Pass/Dundrum Main Street and Dundrum Main Street and Taney Road.

Work on Phase II of the centre commenced in the current year. A Traffic Management Plan is currently underway which covers the wider Dundrum area and will identify necessary improvements to the Transportation Infrastructure for the area. Already improvements are identified such as the link road from the Wyckham By Pass to Blackthorn Drive.

(iii) The baseline traffic model for the study is currently being calibrated and ready for use by the end of February. Testing of short-term mitigation measures to ease congestion associated with the opening of the Town Centre can then commence. Following this, testing of medium and longer-term measures will be conducted. It is expected that the study will be completed by May 2005.”

DDP/93/05 Presentation by Monica Schaefer, Irish Drivers Education Association Ltd. (IDEA) on Steer Clear Driver Education project for transition year students

Ms. Monica Schaeffer and Mr. William Siddell gave a presentation on the Steer Clear Driver Education project for transition year students. Following the presentation there was a Question and Answer session. The Dundrum Area Committee NOTED the presentation and gave its full support to the project.

DDP/94/05 Attendance of Representative from Dublin Bus to discuss bus routes 14, 14A and 48A taking into consideration the Luas service

Mr. Declan Murray from Dublin Bus gave a presentation on the impact of LUAS on the Bus Routes Nos 14, 14A and 48A. He advised that Dublin Bus were considering changes to the routes in the area to better serve the community wishing to link with the LUAS in Dundrum and going into Dublin City.

Following a discussion, the Members expressed their thanks to Mr. Murray for his presentation. It was AGREED that Dublin Bus would inform the Council of any changes to the routes. The presentation was NOTED .

DDP/96/05 Larchfield / Taney / Rosemount Traffic Calming

The following Report of the Manager was NOTED .

“Traffic Situation

The estates of Larchfield/Taney/Rosemount are being used as a rat run between Dundrum Road and Clonskeagh Road and traffic speeds are regularly exceeding the legal limit of 50kph for these roads. A number of non-residents are using Taney Park in particular as a shortcut to bypass the signalised Taney Road/Clonskeagh Road Junction.

Proposed Consultation Process

Dún Laoghaire-Rathdown County Council (DLRCC) met with representatives from the various residents associations and have prepared the attached proposals following the meeting, taking on board where practicable, the various concerns of the residents. It is proposed now to proceed with a wider public consultation process whereby an advertisement will be placed in a National Newspaper inviting submissions from residents. Drawings of the proposals will be on display in the Dundrum Office.

Summary of Proposals

A brief summary of the proposal is as follows:

Permanent Road Closure at Taney Park and Farmhill Road. Ramps/Refuge Islands on Larchfield Road, Taney Crescent, Farmhill Park, Mt Carmel Avenue. Build Outs on Rosemount and Larchfield Road.

Post Consultation

Following the consultation process it is proposed to bring a report back to the Area Committee with a recommendation. In order to proceed with the scheme it will require the support/acceptance of the significant majority of the residents. It must be stressed that all work proposed is subject to funding being made available – only approximately 50% funding has been identified to date.”

DDP/97/05 Report submitted in accordance with Part 8, Article 81 of the Planning & Development Regulations 2001 Sandyford Industrial Estate Link Road

The following Report of the Manager was CONSIDERED .

“The construction of a link road from the Wyckham Bypass Extension to Blackthorn Drive (parallel to the LUAS line) is a six-year road objective of the Dun Laoghaire Rathdown County Council County Development Plan 2004-2010. It is also an objective of the Development Contribution Scheme. The route of the proposed road, as shown on Development Plan maps 5 & 6, lies mainly to the north of the LUAS line on the Dundrum side of the Drummartin Link Road and to the south of the LUAS line on the Sandyford Industrial Estate side of Drummartin Link Road.

In November 2003 Roughan & O'Donovan Consulting Engineers were commissioned to carry out a feasibility study to identify all of the constraints along the route, and to examine the issues arising from the interaction of the proposed road with the LUAS line, with the proposed Sandyford to St.Helens motorway, and with the interim Drummartin Link Road.

The feasibility study concluded the following :-

A strategic need for the proposed Sandyford Industrial Estate Link Road has been recognised for many years, and the link road has been integrated with the overall planning of the main road network for the Dundrum and Sandyford areas. The proposed link road is compatible with the long-term road objective of developing a motorway from Sandyford Industrial Estate to the N11 at St.Helen’s, which would eventually form part of an Eastern Bypass for Dublin. The proposed road will serve as a key link to the motorway network from both Dundrum and the Sandyford Industrial Estate. Increased development projections for Dundrum, Sandyford and Stillorgan Industrial Estates will give rise to a greater need for a high quality direct road link between the two areas. An initial traffic assessment has indicated that there would be considerable demand for the proposed new road. The main environmental impact of the proposed road would be traffic noise affecting nearby houses. Noise projections indicate that it will be feasible to mitigate this impact through use of low noise road surfacing, and localised noise barriers at sensitive locations. Although the space available for the proposed road is limited in some locations, it will be feasible to construct the new road to an appropriate standard within the route corridor. The proposed road will be deliverable and economical in the context of the large-scale local developments that would benefit directly from the new link.

Description of the proposed scheme

At the Dundrum end the road will commence on the southern side of the LUAS line at a junction already constructed beside the Balally stop. Initially the road will run between the LUAS line and the rear gardens of houses on Balally Drive. After emerging from the Rockfield apartments site the road will cross over to the northern side of the LUAS line and run along the southern edge of Airfield Estate and then through a narrow reservation behind Holywell. There will be a staggered crossroads junction with the Drummartin Link Road at the bridge over the LUAS line beside the Kilmacud stop. East of this junction the proposed road will run on the southern side of the LUAS line through the lands of St Benildus college and then through a road reservation behind Stillorgan Industrial Park as far as Blackthorn Drive. The vertical alignment of the new road will generally follow existing ground level.

The proposed works consist of: Construction of 1.7km of single carriageway road between the Wyckham Bypass Extension in Dundrum and Blackthorn Drive in the Sandyford Industrial Estate including cycle tracks, grass verges, footpaths, safety barriers, road marking, public lighting, drainage and signage Construction of signal controlled junctions at the junctions of the proposed Sandyford Industrial Estate Link Road with the Drumartin Link Road and with Blackthorn Drive Alteration of the Drumartin Link Road Bridge to accommodate 4 lanes of traffic Construction of a precast bridge for pedestrians and cyclists to the east of the Drumartin Link Road Bridge Construction of a precast tunnel over the LUAS Line approximately 150m east of the Construction of boundary walls,fences and noise attenuation barriers along the route of the proposed road

Conclusion

It is now proposed to conduct a public consultation in accordance with Part 8 of the Planning and Development Regulations. Following the Part 8 process a Compulsory Purchase Order for the necessary land will be submitted to An Bord Pleanala for approval. No private gardens will be affected. The implementation of this scheme will be dependant on funding being available.

Copies of the drawings and Environmental Impact Report are available at this meeting.”

Mr. J. Hayes, Senior Executive Engineer presented the Drawings and the Environmental Impact Report to the members. Following a discussion during which some Members raised their concerns in relation to the scheme, the Report was NOTED .

They are required to carry out the reinstatement of the road in accordance with the “Guidelines for the Opening, Backfilling and Reinstatement of Trenches in Public Roads” issued by the Department of the Environment, Health and Local Government, 2002.

They are also required to carry out full lane resurfacing where the trench reinstatement impinges on the motorway scheme at the eastern end of Brehon Field Road and the section from the Kingston entrance westwards. These two sections were constructed within the last 5 years and are covered by a 5-year moratorium.

Reinstatement deposits/bonds have been lodged with the Council by the developer to ensure that the work is carried out to the required standards.”

The Council will discuss with the landowner the most appropriate time and season for planting the replacement trees.”
