Consent of copyright owner required for any other use. 541-19X0055 R1 25 June 2019 EPA Export 11-08-2020:04:37:10 Byrne Ó Cléirigh Consulting 1 COMAH Land Use Planning Assessment of Dublin Port Company’s MP2 Project 1 INTRODUCTION Dublin Port Company is progressing its MP2 Project, part of which includes redevelopment / reconfiguration of the eastern part of the Port serving the three ferry terminals (Terminals 1, 2 and 5). This development is within the vicinity of several establishments that fall within the scope of the Chemicals Act (Control of Major Accident Hazards Involving Dangerous Substances) Regulations, 2015 (the COMAH Regulations), in particulate the Calor establishment and the Indaver establishment, to the west of the development on the northern side of Tolka Quay Road. To support the development of the MP2 Project, RPS (Dublin Port Company’s planning advisors) requested Byrne Ó Cléirigh to conduct a COMAH land use planning assessment of the development. The purpose of the assessment is to examine the development in the context of the Health and Safety Authority’s COMAH land use planning guidance, to identify the types of development that may be compatible with the COMAH risk zones around the Calor (and other COMAH) establishment, and to conduct a high-level review of the Calor installation to ascertain whether the risk zones could be reduced. This report describes our assessment of the development and our conclusions as to the individual and societal risk presented to the development from the COMAH establishments. 2 PLANNING CONTEXT 2.1 Dublin City Development Plan In accordance with the Planning and Development Act, 2000, as amended, Dublin City Council (DCC) has prepared the latest version of its development plan: The Dublin City Development Plan 2016- 2022. Section 9.5.10 of the Plan (reproduced in Appendix 6) summarises the COMAH legislative regime and the role of the Health and Safety Authority (HSA) in providing advice to planning authorities. Irish Ferries have been invited to provide a written submission to this Committee on the implications of Brexit for ports in Wales and in that context, to respond to two key questions, which are; - What risks and opportunities does Brexit present for Welsh ports? - What steps should be taken, and by whom, to mitigate any risks and secure any benefits? It is important to note that Irish Ferries do not have a public position on this and are unlikely to do so until the outcome is more clearly defined. We have a responsibility to our shareholders and customers, to approach this in a measured way. At this very early stage in the Brexit process, any reports on the likely impact of Brexit in relation to international trade, and in turn its impact on trade through the ports in Wales, will inevitably contain a high degree of speculation.
