Zdravko Peran ZNAČAJ INTERDISCIPLINARNIH PROMETNIH EKSPERTIZA U SUDSKIM PROCESIMA U EVROPSKOJ UNIJI 5 1. U V O D Osnovna postavka interdisciplinarnog ekspertiza jest spoznaja da prilikom bilo kakve prometne nesreće u prometu tijelo osobe koja upravlja prometnim sredstvom i putnici u prometnom sredstvu čine sa prometnim sredstvom nedjeljivu cjelinu. Npr. tijelo pješaka i tijelo osobe u prometnom sredstvu djeluju jedno na drugo, a rezultat toga su ozljede koje nastaju kako kod pješaka, tako i osobe koja upravlja prometnim sredstvom, kao i oštećenja na prometnom sredstvu. Interdisciplinarne ekspertize potrebno je provoditi i kod fingiranih prometnih nesreća. U prekršajnim postupcima pojavile su se fingirane - inscenirane prometne nesreće, u kojima se osobe za upravljačem prije nastanka događaja dogovore na koji će način inscenirati prometnu nesreću i dobiti naknadu štete od osiguravajućeg društva. Naknada štete se isplaćuje temeljem police trećeg lica ili casko police. Inscenirane prometne nesreće uglavnom su lakše prometne nesreće, sa većom ili manjom materijalnom štetom. Kod većih materijalnih šteta uglavnom su sudionici vlasnici novih, skupih i modernih automobila, a jedan od automobila je strane registarske oznake. Utvrđivanje insceniranosti prometne nesreće je iznimno složena interdisciplinarna ekspertiza, a od eksperta zahtjeva veliko znanje i iskustvo. Naime, takvom ekspertizom je potrebno utvrditi dali se događaj može dovesti u vezu s nenamjernim štetnim događajem. Interdisciplinarna prometno-toksikološka ekspertiza se češće pojavljuje u cestovnom prometu. Svaki sudski spis prometne nesreće na Prekršajnom, Općinskom, Županijskom i Vrhovnom sudu sadrži Nalaz i Mišljenje o alkoholiziranosti i utjecaju opojnih droga ili ljekova osoba koje su sudionici prometne nesreće. Da li je alkohol ili neko drugo opojno sredstvo uzrok nesreće ili nije je području pravne struke, tj. sudca, državnog odvjetnika i odvjetnika. Interdisciplinarna prometno-financijska ekspertiza pojavljuje se pri obračunu vrijednosti prometnih sredstavva i obračunu vrijednosti šteta na prometnim sredstvima. Za utvrđivanje vrijednosti prometnog sredstav uzimaju se u obzir slijedeći elementi: vrijednost novog 6 prometnog sredstva, zastarijelost tipa, dodatna oprema ako nije uračunata u cijenu vovog prijevoznog sredstva, vrijednost prijevoznog sredstva prema godinama starosti, pogonski učinak (prijeđeni kilometri i sati rada), opće stanje prijevoznog sredstva, broj prethodnih vlasnika, način eksploatacije, investicijsko ulaganje i zemlja proizvodnje (porijekla) prijevoznog sredstva, ponuda i potražnja na tržištu. Interdisciplinarna prometno-kriminalistička ekspertiza izvodi se na način da se temeljem tragova nađenim očevodom na mjestu prometne nesreće pronalazi kriminalističkom obradom sudionik prometne nesreće, ili sudionika nekog drugog događaja. Interdisciplinarne ekspertize su rezultat zajedničkog rada prometno-tehničkih eksperata, sudsko medicinskih eksperata, eksperta za toksikologiju, eksperta za kriminalistiku i rada sa istražnim, sudskim, državno odvjetničkim i policijskim organima. Primjena stručnih znanja iz oblasti interdisciplinarnih ekspertiza radi provođenja Zakona svakim danom postaje sve intezivnija, kako u cijelom svijetu, tako i kod nas. Zahtijevi pravosuđa su takvi da treba utvrditi i ocijeniti pojedine važne činjenice u sudskom postupku, a posebna disciplina koja se bavi proučavanjem primjenjenih znanosti naziva se forenzička (sudska) znanost. Dostignuća ovih znanosti nisu dovoljno poznata u javnosti, a praćenje ovog područja rada nedovoljno je obrađeno u literaturi. 7 2. After the initial amazement that the pub- lic demonstrations of electric power caused, it became an indispensable energy source in everyday use. Ultimately, the amount of its consumption in industry and per capita is an indicator of development in a particular area. Firstly, the paper gives examples of good practice in Europe- an cities regarding old trams, emphasizing their efforts to conserve cultural and technical heritage. Additionally, an overview of old trams in Zagreb (preserved and non-preserved, operational and non-operational) in the original form is presented. The paper also proposes the introduction of a tourist tram line as an additional service easily accessible to citizens and tourists, provided by the public transport authority in Zagreb. In creating the tourist line solution, the following was taken into consideration: optimization, resource savings, quality of the offer, and the costs. The proposed tourist line solution would lead to creating a better public transport image among the public, resulting in increased transport demand, better finances, improved vehicle utilization and even more sustainable modal split. In addition to the mentioned, there are also operational benefits for the old tram fleet, since the museum trams are best preserved by using them. The paper especially highlights the importance of popularizing public transport in the City of Zagreb as a part of cultural heritage for both citi- zens and tourists.
