    west coast music Midnight Special Please find attached the Midnight Special song list for your review. SPECIAL DANCES for Weddings: Please note that we will need your special dance requests, (I.E. First Dance, Father/Daughter Dance, Mother/Son Dance etc) FOUR WEEKS in advance prior to your event so that we can confirm that the band will be able to perform the song(s) and that we are able to locate sheet music. In some cases where sheet music is not available or an arrangement for the full band is need- ed, this gives us the time needed to properly prepare the music and learn the material. Clients are not obligated to send in a list of general song requests. Many of our clients ask that the band just react to whatever their guests are responding to on the dance floor. Our clients that do provide us with song requests do so in varying degrees. Most clients give us a handful of songs they want played and avoided. Recently, we’ve noticed in increase in cli- ents customizing what the band plays and doesn’t play with very specific detail. If you de- sire the highest degree of control (allowing the band to only play within the margin of songs requested), we ask for a minimum of 100 requests. We want you to keep in mind that the band is quite good at reading the room and choosing songs that best connect with your guests. The more specific/selective you are, know that there is greater chance of losing certain song medleys, mashups, or newly released material the band has.

    December People Band Biographies Robert Berry: Robert Berry was born into a musical family. His father had a dance band that travelled the ballroom circuit in the late 40's and 50's, where his mother was the featured vocalist. When Berry was born his father opened a music store. There, through the busy store’s affiliation with Vox guitars and amps - the brand the Beatles used, Robert was introduced to many of the local musicians. Local hit makers like the Count Five, Syndicate of Sound, Harper’s Bizarre and others often frequented the store. Berry began studying piano in earnest at 6 years old and by age 12 was recruited to join his first rock band with 4 older high school seniors. He continued classical and jazz studies before entering San Jose State University, as a music major. Berry first gained international attention with San Francisco based Hush, and headed to the UK to play in GTR along with Steve Howe of Yes fame, and then achieved a top ten charting single and toured with 3, his partnership with Keith Emerson and Carl Palmer. Before launching December People, Robert played with Sammy Hagar and toured with Ambrosia. When not touring with December People Robert is the bass player with the Greg Kihn Band. Gary Pihl: Raised in the suburbs of Chicago for the first 12 years of his life, Gary Pihl relocated to the San Francisco Bay area. Gary had his recording debut at age 19 with Day Blindness. He says, “After my time in Day Blindness, I was in a band called Fox with Roy Garcia and Johnny V (Vernazza), who went on to play in Elvin Bishop’s band.

    COPYRIGHT INFRINGEMENT ANALYSIS IN MUSIC: KATY PERRY A “DARK HORSE” CANDIDATE TO SPARK CHANGE? Edward M. Christian* ABSTRACT The music industry is at a crossroad. Initial copyright infringement judgments against artists like Katy Perry and Robin Thicke threaten millions of dollars in damages, with the songs at issue sharing only very basic musical similarities or sometimes no similarities at all other than the “feel” of the song. The Second Circuit’s “Lay Listener” test and the Ninth Circuit’s “Total Concept and Feel” test have emerged as the dominating analyses used to determine the similarity between songs, but each have their flaws. I present a new test—a test I call the “Holistic Sliding Scale” test—to better provide for commonsense solutions to these cases so that artists will more confidently be able to write songs stemming from their influences without fear of erroneous lawsuits, while simultaneously being able to ensure that their original works will be adequately protected from instances of true copying. * J.D.     Just Between You and Me: A Memoir. By Myles Goodwyn. Toronto, Ontario: Harper Collins, 2016. 379 pp. ISBN 978-1- 44344-670-9. Reviewed by: David Montgomery, York University Libraries1 The story arc of any rock memoir is predictable. It begins or ends with substance abuse, there are troubled family relationships, extra-marital affairs, betrayals, friends left behind, “musical differences,” management conflicts, and of course, as in any bildungsroman the vicissitude of fortune. The guitar slinger turned raconteur is duty-bound to caution that even modest fame comes at a price, that “rock and roll is a vicious game.” Like the music, the memoir embraces the cliché. On his third go at rehab, April Wine frontman Myles Goodwyn reflects, “Things come in threes” (341). Goodwyn tells us that the goal of his unvarnished memoir was to set the record straight, and not to settle old scores. Neither as beloved as Rush, nor as emblematic as The Tragically Hip, April Wine was nonetheless quintessentially Canadian. With roots in the Maritimes and Quebec, the band regularly toured Ontario rock circuits in the early 1970s, expanding its range to the rest of Canada by the end of the decade. It peaked in the early 1980s, with modest success in England and the US, and garnered worldwide sales of 20 million albums—a solid career. Yet, despite winning several Juno awards and in 2010 being inducted into the Canadian Music Hall of Fame, April Wine may also be a candidate for a quick fade. While songs such as “Weeping Widow,” “Oowatanite,” and “Roller” may resonate with the home demographic, future induction into Cleveland’s Rock & Roll Hall of Fame is unlikely.

JUL/AUG 2016 Healing with my Hands In September of 2010 my 25 year old son went into the hospital with a flare up of the Crohn's disease that had been interfering with his life for over 12 years. We expected a 3-4 day stay which was his norm. After a few days of fluids and steroids he would be on his way to a quick recovery. What really happened is that he barely made it home after 2 1/2 months of intensive care and rehab, multiple surgeries, dozens of procedures, a weight loss of 50 pounds and the loss of the life he knew. For this Mama it was the most frightening, agonizing, and heartbreaking time of her life. I plummeted into a dark abyss of which I had never experienced before. Fear and anxiety plagued my every waking moment. Without the aid of a sleeping pill, it also visited me in my sleep. When Tommy died suddenly in March of 2011, I fell even deeper into the abyss. I cared not for surviving and thought endlessly of joining him. Along with my intense need to see him again, my heart and soul needed a respite from the excruciating heartbreak.
