Partridge Mayor Eisenberger called the meeting to order and recognized that Council is meeting on the traditional territories of the Mississauga and Haudenosaunee nations, and within the lands protected by the “Dish with One Spoon” Wampum Agreement. The Mayor called upon Rabbi Jordan Cohen of Temple Anshe Sholom to provide the invocation. APPROVAL OF THE AGENDA The Clerk advised of the following changes to the agenda: 1. COMMUNICATIONS - AMENDED DISPOSITION 5.3 Correspondence from the Honourable Bill Mauro, Minister of Municipal Affairs and the Honourable Kevin Flynn, Minister of Labour respecting Fair Workplaces, Better Jobs Act (Bill 148). Recommendation: Be received and referred to the Executive Director of Human Resources and Organizational Development for information and appropriate action. 2. COMMUNICATIONS 5.7 Correspondence from the Ministry of Municipal Affairs seeking stakeholder and public input on the proposed changes to Ontario’s Building Code by January 4 2018. ADDED PRIVATE AND CONFIDENTIAL 10.2 Bell Municipal Access Agreement (LS14001(b)/PW14006(b)) (City Wide) Pursuant to Section 8.1, Sub-sections (e) and (f) of the City’s Procedural By-law 14-300, and Section 239(2), Sub-sections (e) and (f) of the Municipal Act, 2001, as amended, as the subject matter pertains to litigation or potential litigation, including matters before administrative tribunals, affecting the City and the receiving of advice that is subject to solicitor-client privilege, including communications necessary for that purpose. (VanderBeek/Pasuta) That the agenda for the November 22, 2017 meeting of Council be approved, as amended. CARRIED DECLARATIONS OF INTEREST Councillor Ferguson declared an interest on Appendix A, page 17 to Item 5 of the General Issues Committee Report 17-024 respecting licensing fees for taxi cabs, as his family is involved in the taxi cab business. CEREMONIAL ACTIVITIES 3.1 Fall Business Appreciation Awards (Wards 9-15) Mayor Eisenberger recognized local businesses and expressed appreciation for their investment and commitment to the City of Hamilton. The awards were presented to businesses in Wards 9-15. The winners for Wards 1- 8 were presented earlier this year. A recognition award from the Mayor’s office was also presented. Ward 15: Aldershot Greenhouses Ltd. and Dutchman’s Gold Honey Mayor’s Office: Kubes Steel Inc. and Pipeline Studios Hamilton APPROVAL OF MINUTES 4.1 November 8, 2017 (Whitehead/Jackson) That the Minutes of the November 8, 2017 meeting of Council be approved, as presented. CARRIED COMMUNICATIONS (B. Johnson/Pearson) That Council Communications 5.1 through 5.7 be approved, as amended, as follows: 5.1 Correspondence from Dana Anderson, Partner, MHBC Planning Urban Design & Landscape Architecture respecting the City of Hamilton Proposed Commercial Zones (Amendment to By-law 05-200). Recommendation: Be received. 5.2 Correspondence from Graham Flint, President, Gravel Watch Ontario respecting their concerns regarding Cornerstone Standards Council (CSC) Responsible Aggregate Standard and Certification System. Recommendation: Be received and referred to the Executive Director of Human Resources and Organizational Development for information and appropriate action. 5.4 Correspondence from Town of Tillsonburg requesting support for the Town of Tillsonburg’s Council resolution calling upon the Government of Ontario, and all political parties, to formally grant municipalities the authority to approve landfill projects in or adjacent to their communities, prior to June 2018. Recommendation: Be received and endorsed. 5.5 Correspondence from John Bolognone, City Clerk, City of Kingston requesting support for the City of Kingston’s Council resolution encouraging the provincial government through the responsible Ministers to work together to make Naloxone Kits easily available in all communities, and that the Province enact legislation and regulations as needed to limit the liability on non-paramedic responders when administering the drug to treat an overdose. Recommendation: Be received and referred to the next meeting of the Board of Health for discussion. 5.6 Correspondence from Joshua Weresch respecting the recent sales pitch that has been made for Amazon’s head-quarters. Recommendation: Be received. 5.7 Correspondence from the Ministry of Municipal Affairs seeking stakeholder and public input on the proposed changes to Ontario’s Building Code by January 4 2018. Recommendation: Be received and referred to the General Manager of Planning and Economic Development for information and appropriate action. CARRIED (Green/Farr) That Council move into Committee of the Whole for consideration of the Committee Reports. CARRIED Council Minutes 17-021 November 22, 2017 Page 5 of 21 PUBLIC WORKS COMMITTEE REPORT 17-013 (Merulla/Farr) That Item 6 of the Public Works Committee Report 17-013 respecting the Graffiti Management Strategy (PW17078/PED17198) be amended by adding sub-sections (g) and (h) to read as follows: 6. Graffiti Management Strategy (PW17078/PED17198) (City Wide) (Item 8.3) (a) That the Graffiti Management Strategy and associated timelines outlined in this report be approved; (b) That staff provide updates on the progress of the Graffiti Management Strategy and its various components as part of the Clean and Green Strategy annual reporting; (c) That Municipal Law Enforcement (MLE) be approved to hire two (2) Municipal Law Enforcement Officers (Co-op students) for a 2 year pilot project; (d) That annual costs associated with hiring of two (2) Municipal Law Enforcement Officers (Co-op students) and operating costs of one (1) vehicle, approximately $114,100, be funded through the Tax Stabilization Reserve #110046; (e) That the one-time capital cost associated with the purchase of one (1) vehicle to support the new Municipal Law Enforcement Officers (Co-op students), approximately $26,400, be funded through Tax Stabilization Reserve #110046; (f) That the internal Graffiti Working Group, led by Policy & Programs staff, develop and undertake a graffiti enforcement strategy with victim assistance program; (g) That the pursuit of additional Closed-Circuit Television Cameras (CCTV) be included as part of the Graffiti Management Strategy with a report back, accompanied by a presentation, to the Public Works Committee outlining the costs of expanding the camera program; and, (h) That the appropriate staff also report back on the cost of a counter social media campaign that encourages citizens to participate in assisting police in catching vandals and receiving a cash reward as well as the cost of a one-time City-wide graffiti clean-up. Main Motion as Amended CARRIED (Ferguson/VanderBeek) That sub-sections (d), (f) and (g) of Item 7 of the Public Works Committee Report 17-013, respecting the Gypsy Moth Infestation Control Program (PW17088) be amended to read as follows: Council Minutes 17-021 November 22, 2017 Page 6 of 21 7. Gypsy Moth Infestation Control Program (PW17088) (City Wide) (Item 8.4) (d) That the anticipated cost of the Gypsy Moth Infestation Control Program of $1,950,000 in 2018 and $550,000 in 2019 be referred to the 2018 capital budget process funded through the Tax Stabilization Reserve; (f) That the costs associated with the follow up survey (as identified in sub- section (d)) be included in the total anticipated capital costs identified for the Gypsy Moth Infestation Control Program detail sheet to be submitted through the 2018 capital budget process and be funded from the Tax Stabilization Reserve; (g) That correspondence be sent to the Minister of Natural Resources and Forestry, requesting financial assistance from the province in dealing with Gypsy Moth infestations, and that any received funds will be used to offset the capital impacts costs identified through this program.
