Bechtel, Jr. Foundation Appendix A: A Narrative History of the Redistricting Reform Measures California’s modern history with redistricting began with a stalemate between Republican Governor Ronald Reagan and the Democrats in the state legislature over the 1970s districts. The stalemate threw the process into the courts, who promptly appointed a commission of retired judges called “Special Masters” to draw the lines in the legislature’s place. Democrats were wary of the Special Masters’ plans, but generally did well under those plans in the ensuing decade, and Republicans also seemed content with the outcome. But in the ensuing decades, Democrats became the clear majority party in the legislature and had no interest in abandoning control, while in future fights Republicans did as well or better when the courts drew the lines. In this way, the involvement of judges in the redistricting process—and even the notion of a commission of any kind—became tainted with partisan implications, at least in the minds of the political class. In the decades to come, the perspective on a commission or any judicial involvement in a redistricting process became a fairly effective shorthand for Democratic and Republican opinions of the process. By the time of the next redistricting, Democrats in the legislature faced a Democratic governor, Jerry Brown.

    FROM JERRY­RIGGED TO PETERED OUT: LESSONS FROM THE DEUKMEJIAN ERA FOR CONTEMPORARY CALIFORNIA STATE BUDGETING Daniel J.B. Mitchell, UCLA Ho­Su Wu Professor of Management and Public Policy The new governor took office in the midst of a major state budget crisis. At the time he took office, it was unclear that state could pay its bills if drastic action were not taken. Yet the incoming governor was committed to a no­tax­increase program. Through borrowing, the state managed to surmount its budget crisis. As the economy recovered and resulting tax revenue flowed in, it even was able to engage in major construction projects. When he stood for re­ election, the governor was overwhelmingly returned to office for a second term. Sadly, however, the economy began to slow during that second term. Fears mounted that the state could face a renewed budget crisis. This description may seem to depict the career to date of Arnold Schwarzenegger. He inherited a budget crisis from Gray Davis who he replaced in the 2003 recall. But the introductory vignette actually refers to the story of George Deukmejian (“Duke”) who was first elected in 1982, inheriting a budget crisis from Jerry Brown. (Deukmejian’s construction projects leaned towards prisons for most of his terms in office, needed as state sentencing laws tightened, rather than the roads and other infrastructure pushed by Schwarzenegger.) And as it turned out, the economic downturn that began to take shape towards the end of Deukmejian’s second term indeed did produce a major budget crisis, a legacy he left for his successor, Pete Wilson.

    State of California LITTLE HOOVER COMMISSION February 23, 2005 The Honorable Arnold Schwarzenegger Governor of California The Honorable Don Perata The Honorable Dick Ackerman President pro Tempore of the Senate Senate Minority Leader and members of the Senate The Honorable Fabian Núñez The Honorable Kevin McCarthy Speaker of the Assembly Assembly Minority Leader and members of the Assembly Dear Governor Schwarzenegger and members of the Legislature: The Little Hoover Commission has reviewed the Governor’s plan to reorganize the Youth and Adult Correctional Agency, creating a new Department of Corrections and Rehabilitation. The Commission has concluded that the plan, if effectively and swiftly implemented, would enable the department to significantly improve the performance of correctional programs and enhance public safety. Part of this calculus relies on assurances of further improvements by Secretary Hickman during the Commission’s public hearing. Consequently, the Commission recommends that the Legislature allow the plan to go into effect and continue to work to solve problems that are not solved by the reorganization plan. The Commission will review the progress of the reforms in one year, with a particular focus on improvements in youth corrections. The Governor’s Reorganization Plan addresses concerns that the correctional system’s organizational structure contributes to persistent and serious problems, including egregious cost overruns, inmate abuse, and parolee failure. The plan strengthens an ambiguous chain of command, thus increasing accountability throughout the organization. It focuses the new department on performance assessment and rehabilitation – elements critical to improving outcomes. It also adds important new functions, including research to facilitate the use of evidence-based strategies; information technology to improve management; and, risk management to change practices that increase liabilities.

Gmail’s large storage space and automated processes developed to scan the content of incoming messages and create advertisements based on the scanned terms have enraged privacy groups on an international level. This iBrief will compare Gmail’s practices with its peers and conclude that its practices and procedures are consistent with the standards of the webmail industry. The iBrief will then propose additional measures Gmail could institute to further protect webmail users’ and alleviate the concerns of privacy advocates. INTRODUCTION ¶1 Louis Gerstner, former CEO of IBM, once stated that with new technology the “real issues are not technical;” rather, the benefit stemming from new technology “is always counterbalanced by an equally important list of societal concerns.”2 Though not officially released to the general public, Google’s webmail client, Gmail, illustrates Gerstner’s statement, as it has already generated not only praise and excitement, but also criticism and threats of legislative regulation. ¶2 Two components of Gmail that raise privacy concerns are its two- gigabyte storage capacity and its Adsense technology, which scans e-mail and places advertisements into the message related to its content.3 This iBrief will analyze Gmail’s conformity with privacy laws and compare Gmail to other webmail clients such as Yahoo! and MSN Hotmail (“Hotmail”).
