Oct. 2021 6 A Foreign Commission for Domestic Needs: The Constitutional Founding of Malaysia H KUMARASINGHAM Introduction ‘The calibre of the Commission will have to be very high, since the problems will be unusual and of great complexity’.1 Thus stated the last British colonial High Commissioner in Malaya, Sir Donald McGillivray, when assessing the needs and demands a constitutional commission would be tasked with drawing up the constitutional foundations for an independent Malaysia. The constitutional founding of Malaysia is one of the more unique in British and Imperial constitutional history and McGillivray was not exaggerating in describing the situation as ‘unusual’. Not only was this the first major transfer of power in British Asia since the end of the Indian Empire a decade before, but it also confronted the constitution-makers with a complex polity enmeshed in rebellion, racial divisions, peculiar legal relations with Britain, esoteric governing structures, indigenous rulers with varying privileges, precarious geo- political position and pronounced religious and ethnic sensitivities. Far from being a dry, pro forma and incidental body, the Federation of Malaya Constitutional Commission, better known as the Reid Commission, and its Report, were unquestionably critical and conspicuous in the constitutional founding of independent Malaysia. While it would be another eight years before modern Malaysia would appear – with the incorporation of North Borneo and Sarawak, and the exclusion of Singapore – the Reid Commission’s report laid the constitutional foundation for Malaysia when published in 1957. This chapter examines the constitutional context that led to the founding of independent Malaya. The leading local actors were the indigenous rulers across the Federation jealous of their prerogatives and a pragmatic coalition between the major communal parties: United Malays National Organisation (UMNO), Malayan Chinese Association (MCA) and the Malayan Indian Congress (MIC). Despite this, Malaya sought an entirely non-local Commission to establish the constitutional identity for an independent state. As Lauren Benton and Lisa Ford noted in their work on international law and the nineteenth century British Empire, colonial commissions of inquiry have been largely eschewed by academics and have thus become a ‘grossly understudied constitutional moment’.2 This essentially remains the case for the following century when the Southeast Asian states’ constitutions covered in this volume were framed. The Reid Commission provides for Malaysia this critical ‘constitutional moment’ that ushered in the constitutional character and complexion of the country. I Malayan Context The Malay Archipelago since early times has been a region of deeply rooted governing traditions and experience of diversity in every sense. Melaka, especially, became the centre of the Malay world and had a rich cosmopolitan culture and a flourishing trading network and historically controlled most of the modern Malaysian peninsular and islands. The Sultanate of Melaka, as a commercial and cultural entrepôt, attracted significant migration not just from the Malay world, but also from across Asia. When the Sultanate fell to the Portuguese in 1511 the centre of the Malay world may have been lost, but its example, even if romanticised, remained as a template of kingship and governance. The Sejarah Melayu or Malay Annals, though written well after the fall of Melaka details a founding story of Malay kingship that successor regimes, both colonial and local, would try and emulate. As Harper states, they served as a ‘source of instruction’ and ‘enshrined the sanctity and authority, the daulat, of the Ruler’, which in turn help give cohesiveness to the state and foster Malay nationalist thought and their 2 Lauren Benton and Lisa Ford, Rage for Order – The British Empire and the Origins of International Law 1800-1850 (Cambridge, Massachusetts: Harvard University Press, 2016) at 59. 2 authority and fitness in government.3 This narrative remains critical to traditional authority in contemporary Malaysia and was openly prominent in the foundation of the state when Rulers’ position and prerogatives were at the forefront of debate. European colonialism did not dismantle traditional rule. Instead, as will be discussed further below, the British were in favour of keeping traditional Malay governance roles and styles in place. As Harper argues ‘the hallmark of colonial rule was the reinvention of traditional forms’.4 Unlike some other traditional societies affected by colonialism the local Malay rulers largely not only retained their position, but also their influence on their subject culturally and constitutionally. However, while the Sultans were accepted as sovereign rulers, they had to admit – through a series of treaties – an on-the-spot British resident who had substantial powers. This was formalised in the 1874 Pangkor agreements that ensured British indirect rule in the Malay states. The Straits Settlements, which did not have Rulers, was administered directly by the British. Nonetheless Malay culture and practices permeated throughout. Even before it was formalised in 1957, the Malayan polity and constitutional culture contained what former Lord President of the Supreme Court, Salleh bin Abas, described as ‘traditional elements’: (a) the Sultanate or Rulership; (b) the Islamic religion; (c) the Malay language; and (d) Malay privileges.5 The need for such constitutional and cultural considerations in the Malaysian founding was due to major demographic changes, the Malays were far from being the only community in the archipelago and sought protection of their status. Migration caused a tremendous impact upon the composition of Malaya that would consequently affect the political bargaining surrounding the state’s constitutional foundation. Colonialism accelerated the migration of various communities to the region. In particular, Chinese and Indian immigrants came to Malaya particularly from the nineteenth century as the British encouraged labourers specially to work on the plantations that were critical to the region’s substantial commercial contribution to the imperial economy. So many of the colonial era confrontations were associated with tensions and violence between the Malays and non-Malays. The Malays were fearful of the growing permanence of the Chinese and Indian communities. While all had originally seen the migrant labour as being temporary, greater settlement in fact occurred due to economic and geopolitical reasons. In 1947 over 60 per cent of the so-called ‘immigrants’ had actually been born in Malaya.6 This had major repercussions. With little inclination or capability of moving, this large non-Malay population would seek not only rights for their respective communities, but also participation and recognition in the foundation of the state.     Damien Cheong ____________________________________________________________ Selling Security: The War on Terrorism and the Internal Security Act of Singapore DAMIEN CHEONG Abstract The Internal Security Act (ISA) of Singapore has been transformed from a se- curity law into an effective political instrument of the Singapore government. Although the government's use of the ISA for political purposes elicited negative reactions from the public, it was not prepared to abolish, or make amendments to the Act. In the wake of September 11 and the international campaign against terrorism, the opportunity to (re)legitimize the government's use of the ISA emerged. This paper argues that despite the ISA's seeming importance in the fight against terrorism, the absence of explicit definitions of national security threats, either in the Act itself, or in accompanying legislation, renders the ISA susceptible to political misuse. Introduction In 2001/2002, the Singapore government arrested and detained several Jemaah Islamiyah (JI) operatives under the Internal Security Act (ISA) for engaging in terrorist activities. It was alleged that the detained operatives were planning to attack local and foreign targets in Singa- pore. The arrests outraged human rights groups, as the operation was reminiscent of the government's crackdown on several alleged Marxist conspirators in1987. Human rights advocates were concerned that the current detainees would be dissuaded from seeking legal counsel and subjected to ill treatment during their period of incarceration (Tang 1989: 4-7; Frank et al. 1991: 5-99). Despite these protests, many Singaporeans expressed their strong support for the government's actions.

    Evolution of a Revolution Between 1965 and 2005, changes to Singapore’s Constitution were so tremendous as to amount to a revolution. These developments are comprehensively discussed and critically examined for the first time in this edited volume. With its momentous secession from the Federation of Malaysia in 1965, Singapore had the perfect opportunity to craft a popularly-endorsed constitution. Instead, it retained the 1958 State Constitution and augmented it with provisions from the Malaysian Federal Constitution. The decision in favour of stability and gradual change belied the revolutionary changes to Singapore’s Constitution over the next 40 years, transforming its erstwhile Westminster-style constitution into something quite unique. The Government’s overriding concern with ensuring stability, public order, Asian values and communitarian politics, are not without their setbacks or critics. This collection strives to enrich our understanding of the historical antecedents of the current Constitution and offers a timely retrospective assessment of how history, politics and economics have shaped the Constitution. It is the first collaborative effort by a group of Singapore constitutional law scholars and will be of interest to students and academics from a range of disciplines, including comparative constitutional law, political science, government and Asian studies.     'The Oriental Jennings' An Archival Investigation into Sir Ivor Jennings’ Constitutional Legacy in South Asia Mara Malagodi LSE Law Department New Academic Building 54 Lincolns Inn Fields London WC2A 3LJ ABSTRACT The article investigates the legacy of British constitutionalist Sir Ivor Jennings (1903‐1965) in South Asia. In 1940, when Jennings moved to Sri Lanka, a new phase of prolific writing on the laws of the British Empire and Commonwealth began for him, together with a practical engagement with constitution‐making experiences in decolonising nations across Asia and Africa. The archival material relating to Jennings’ work on postcolonial constitutional issues forms part of the collection of Jennings’ Private Papers held at the Institute of Commonwealth Studies in London. This article seeks to explain why this material has until now remained so under‐researched. INTRODUCTION The present article explores a neglected aspect of the life and work of noted British constitutionalist Sir Ivor Jennings (1903‐1965): his engagement with constitutional issues in the postcolonial world. In particular, the analysis investigates Jennings’ constitutional legacy in South Asia where he was involved, both academically and professionally, with most of the region’s jurisdictions.1 Jennings played a direct role in Sri Lanka (1940‐1954), the Maldives (1952‐1953), Pakistan (1954‐1955), and Nepal (1958), and had a long‐term indirect engagement with India. In 1940, Jennings moved to Sri Lanka – where he resided until his appointment in 1954 as Master of Trinity College in Cambridge – and became progressively involved with constitution‐making processes and constitutional change across the decolonising world. I refer to this period of Jennings’ life experiences, to the body of literature pertaining to the postcolonial world that he produced, and to his advisory work in decolonising countries as the ‘Oriental Jennings’ – a body of literature largely ignored by academic scholarship.2 The paper seeks to explain the reasons for this scholarly silence.

    INTRODUCTION ‘We have the advice of the greatest living authority on Constitutional Law regarding the British Commonwealth – Dr Jennings’, proclaimed the Leader of the Ceylon Senate in December 1947 in a parliamentary debate on the future constitutional design of the island.1 So in thrall to William Ivor Jennings was the powerful and soon to be first prime minister of independent Ceylon, D.S. Senanayake, that in the same debate it was contemptuously suggested that his initials stood for ‘Dominion Status Senanayake’, a form of independence that Jennings advocated as Senanayake’s pervasive and persuasive adviser.2 Senanayake was never in doubt as to the value of Jennings and publicly expressed his gratitude by delivering to the Englishman a knighthood, on his advice, for services to Ceylon, less than six months later in the King’s 1948 Birthday Honours List. Ivor Jennings was born in Bristol on 16 May 1903.Hehada remarkable career stretching across the world as a constitutional scholar in the heyday of decolonization before his death in Cambridge at just sixty-two on 19 December 1965.3 After studying mathematics and law, he obtained a first-class degree for the law tripos in 1924–1925 while at St Catharine’s College, Cambridge. After a short time as a law lecturer at the University of Leeds, he went to the London School of Economics (LSE) in 1929, where he rose to become Reader in English Law. While at the LSE, Jennings published some of his most famous and influential works, including The Law and the Constitution (1933), Cabinet Government (1936), and Parliament (1939).

Also, the chairman has developed into an institution that carries out agenda-setting within the framework of the parliament. This raises the conceptual question of whether legislation in Malaysia is still performed independently by the parliament. The observed patterns require an attempt to re-conceptualize the roles as well as the assigned meaning of various expressions of parliamentary routine, including those that are unwritten and informal, for instance those which can also be termed “subjective forms of rule” at one's own discretion. In my doctoral thesis, I apply an interdisciplinary analytical framework that relates to accountability studies, as well as micro- sociological direct interaction, the interpretations of procedural interactions in conversation, as well as studies of political discretion in parliamentary operations. My main research question asks how the Speaker of Parliament fulfils his responsibilities by disrupting ongoing parliamentary debates.

    his three volume publication includes the constitutional documents of all Tcountries in Southeast Asia as of December 2007, as well as the ASEAN Charter (Vol. I), reports on the national constitutions (Vol. II), and a collection of papers on cross-cutting issues (Vol. III) which were mostly presented at a conference at the end of March 2008. This collection of Constitutional documents and analytical papers provides the reader with a comprehensive insight into the development of Constitutionalism in Southeast Asia. Some of the constitutions have until now not been publicly available in an up to date English language version. But apart from this, it is the first printed edition ever with ten Southeast Asian constitutions next to each other which makes comparative studies much easier. The country reports provide readers with up to date overviews on the different constitutional systems. In these reports, a common structure is used to enable comparisons in the analytical part as well. References and recommendations for further reading will facilitate additional research. Some of these reports are the first ever systematic analysis of those respective constitutions, while others draw on substantial literature on those constitutions. The contributions on selected issues highlight specific topics and cross-cutting issues in more depth. Although not all timely issues can be addressed in such publication, they indicate the range of questions facing the emerging constitutionalism within this fascinating region.
