    275 A RIGHT THAT SHOULD’VE BEEN: PROTECTION OF PERSONAL IMAGES ON THE INTERNET EUGENIA GEORGIADES “The right to the protection of one’s image is … one of the essential components of personal development.” Grand Chamber of the European Court of Human Rights ABSTRACT This paper provides an overview of the current legal protection of personal images that are uploaded and shared on social networks within an Australian context. The paper outlines the problems that arise with the uploading and sharing of personal images and considers the reasons why personal images ought to be protected. In considering the various areas of law that may offer protection for personal images such as copyright, contract, privacy and the tort of breach of confidence. The paper highlights that this protection is limited and leaves the people whose image is captured bereft of protection. The paper considers scholarship on the protection of image rights in the United States and suggests that Australian law ought to incorporate an image right. The paper also suggests that the law ought to protect image rights and allow users the right to control the use of their own image. In addition, the paper highlights that a right to be forgotten may provide users with a mechanism to control the use of their image when that image has been misused. J.L. & ARTS 157 (2015) A Mask that Eats into the Face: Images and the Right of Publicity Rebecca Tushnet* ABSTRACT In their eagerness to reward celebrities for the power of their “images,” and to prevent other people from exploiting those images, courts have allowed the right of publicity to distort the First Amendment. The power of the visual image has allowed courts to create an inconsistent, overly expansive regime that would be easily understood as constitutionally unacceptable were the same rules applied to written words as are applied to drawings and video games. The intersection of a conceptually unbounded right with a category of objects that courts do not handle well has created deep inconsistencies and biases in the treatment of visual and audiovisual media, particularly comics and video games. These problems show up both in First Amendment defenses and in copyright preemption analysis. The possible arguments one might offer for treating images differently are insufficient to justify this disparity. The Article concludes that, absent the distortion produced by images, the right of publicity would properly be understood as sharply limited. Bodily perfection: embodying the 'essential man' During the nineteenth century, and due to the development of biology, health reform, and the optimistic belief that it was within the capacity of men to improve themselves, the masculine body was elevated to a position of enormous importance. 'Body-building' came to be associated with ideals of perfection and virtue and muscular bulk in men became a highly prized cultural value. Unsurprisingly, the heroes of nineteenth century imperialist adventure narratives were portrayed as muscular and young,1 their physical perfection, bodily vigour and tanned complexion becoming an expression of their virility. The relevance of physical perfection has remained ingrained in our western society. We live in a world obsessed with images and appearances and where sheer physicality is very likely to determine successful performance in society as is exemplified by the new myth-like quality physically- perfect top models such as Naomi Campbell or Claudia Schiffer have acquired; or by the fame of actors such as Sharon Stone, Brad Pitt, Arnold Schwarzenegger or Sylvester Stallone, whose bodies more than their acting skills granted them widespread social recognition; or by the idol-like status of sport figures such as Ronaldo, Moya or Agassi who have become modern society's new demi-gods, not only admired for their sports achievements but for their bodies, which have become icons of physical perfection as can be appreciated in a recent advertising campaign for a well-known Swiss watch trade mark.
