Ordinance No. 10-2006 ORDINANCE AMENDING THE SAN JUAN COUNTY COMPREHENSIVE PLAN AND UNIFIED DEVELOPMENT CODE AND ADOPTING THE OLGA HAMLET PLAN WHEREAS, the Olga Hamlet was designated as a hamlet activity center on the Official Map of the San Juan County Comprehensive Plan in 1998, and the boundaries were modified to the current configuration in 2000, consistent with RCW 36.70A.070(5)(d)(iv); and WHEREAS, for all hamlet activity centers, Section B, Element 2.3.B of the Comprehensive Plan anticipates that area-specific plans will be adopted; and WHEREAS, beginning in 1998 and continuing through 2005 with numerous community meetings, the public has been extensively involved in developing the Olga Hamlet Plan, consistent with RCW 36.70A.140; and WHEREAS, environmental review and disclosure documents produced previously by the Community Development and Planning Department, including the 2000 Draft and Final Environmental Impact Statements for Activity Centers, were adopted by reference for the 2006 proposed Olga Hamlet Plan in compliance with the requirements of the State Environmental Policy Act; and WHEREAS, for the purposes of RCW 36.70A.130 the adoption of activity center plans is analogous to the adoption of a subarea plan and may occur outside of the annual docket for amendments to the Comprehensive Plan (RCW 36.70A.130(2)(a)(i)); and WHEREAS, a duly advertised public hearing was held by the San Juan County Planning Commission on March 9, 2006, at which public testimony was heard, and after hearing further testimony at a continued hearing on May 19, 2006, the Commission voted unanimously to recommend approval of the proposed plan and forwarded its findings and recommendation to the County Council; and WHEREAS, the San Juan County Council held a duly advertised public hearing on July 11, 2006, and after consideration of the whole record makes the following legislative findings: The WA Department of Community, Trade and Economic Development (CTED) was given the 60 day notice of the county's intent to adopt the Olga Hamlet Plan as required by state law. Differences between countywide standards for land use and development and those standards for specific villages and hamlets are contemplated by Comprehensive Plan policies (2.3.B.5 and 2.3.B.6) to recognize differences in physical features and character among these areas, as well as to reflect community values. The standards proposed for the Olga Hamlet are clearly derived from the single goal and the objectives of the Olga Hamlet Plan. 2. The Olga Hamlet Plan is the first activity center plan to be adopted. Amendments to the Comprehensive Plan and San Juan County Code are necessary to effect this plan and incorporate it into the appropriate sections: Section B, Element 2 of the Comprehensive Plan and to the Unified Development Code at SJCC 18.30. NOW THEREFORE, BE IT ORDAINED that the Olga Hamlet Plan (Exhibit A), is hereby adopted in its entirety and the following amendments are hereby adopted to the Comprehensive Plan and the San Juan County Code, respectively. Comprehensive Plan, Section B, Element 2 New subsection 2.5, Overlay Districts 2.5.F Village and Hamlet Activity Center Plans Goal: To provide for location-specific land use designations and development standards for areas designated as village and hamlet activity centers. 1. Incorporate the goals and policies of the Olga Hamlet Plan by this reference, as an overlay district and implement the Olga Hamlet Plan by adoption in its entirety as part of the Unified Development Code. Unified Development Code, SJCC 18.30 New Section 18.30.240 18.30.240 Village and Hamlet Activity Center Plans A. Purpose. To establish location-specific community plans for designated village and hamlet activity centers, in accordance with the Comprehensive Plan (Section B, Element 2, Policy Section 2.3.B). B. Applicability. Upon the adoption of each activity center plan, it shall apply as an overlay district to the area within the boundaries of the activity center and its provisions shall prevail over any conflicting provisions of the Comprehensive Plan or of this code.
