FINAL SUMMARY JUDGMENT This cause is before the Court upon a Renewed Motion for Summary Judgment filed by Defendants, Morris Publishing Group, LLC, Morris Publishing Group, LLC d/b/a The Florida Times-Union, Jacksonville.com, and Mike Freeman, against Plaintiff.1 The Court has considered the pleadings, answers to interrogatories, depositions, and affidavits for and against summary judgment; and the arguments of counsel. Upon the foregoing, the Court finds that Defendants' Renewed Motion for Summary Judgment should be granted, based upon undisputed facts. This Court, through a predecessor judge, denied Defendants' previously filed Motion for Summary Judgment. However, reconsideration of matters therein is appropriate in light of additional discovery, including the deposition of Plaintiff. See, Hull & Co., Inc. v Thomas, 834 So.2d 904 (Fla. 4th DCA 2003). BACKGROUND Plaintiff, John P. Daly ("Daly"), is a professional golfer on the PGA Tour. On March 25, 2005, an opinion column by sports-writer Mike Freeman ("Freeman"), entitled "Daly, Duval Star in Golfs Surreal Life" ("Column"), appeared in the print edition of The Florida Times-Union and on its website (found under the domain name jacksonville.com). A copy thereof is attached hereto. In the Column, Freeman expressed opinions about the long-standing, public controversy surrounding Daly's career and personal life.

THE 2006 PGA MEDIA GUIDE – 411 PGA of America Awards ¢ PGA Player of the Year The PGA Player of the Year Award is given to the top PGA Tour player based on his tournament wins, official money standing and scoring average. The point system for selecting the PGA Player of the Year was amended in 1982 and is as follows: 30 points for winning the PGA Championship, U.S. Open, British Open or Masters; 20 points for winning The Players Championship; and 10 points for winning all other designated PGA Tour events. In addition, there is a 50-point bonus for winning two majors, 75-point bonus for winning three, 100-point bonus for winning four. COLLEGE OF THE HOLY CROSS Clutch Strokes: Performance Under Pressure in Golf Jeffrey Paadre This paper examines 10 years worth of PGA Tour Tournament data in order to examine whether or not clutch performance exists during the final round of a tournament. After controlling scores for differences in course difficulty, the paper finds no evidence of tangible clutch performance. The authors find that the perception of clutch performance is more likely attributable to talent differential between golfers. Assuming a normal distribution of golfer talent, it is possible that Tiger Woods can outshoot his opponents on the final day of a tournament as well as lose his lead to his competitors. Motivation and Literature In professional sports, heroes can be created through the concept of clutch performance. The perception of clutch performance occurs when an athlete raises his or her performance to an extraordinary level during the most important moments of a sporting event. Athletes such as David Ortiz and Adam Vinatieri have been immortalized as legends due to their consistent ability to help their teams win baseball and football games during important games where the outcome was hanging in the balance. Conversely Bill Buckner and Scott Norwood are amongst the unfortunate athletes burdened with reputations as choke artists based on their inability to perform well when their teams needed a high performance the most. One of the challenges that accompanies examining performance under pressure lies within trying to define which performances constitute clutch performance. For example, in 2005 John Henry, the owner of the Boston Red Sox, presented David Ortiz with a plaque inscribed “David Ortiz: The Greatest Clutch Hitter in the History of the Boston Red Sox”.

Alex Cejka, 66-67-72=205 (-11) Alex Cejka enters the final round of THE PLAYERS with a 5-shot lead, the first time in his career he holds a 54- hole outright lead. Prior to this week, Cejka’s best position entering a final round on the PGA TOUR was a share of the lead at the 2001 British Open Championship. His 5-stroke lead entering the final round is the largest 54-hole lead in tournament history, bettering a 4-stroke advantage by Greg Norman in 1994 and Larry Mize in 1986.
