    Hyundai Motor America Reports February 2021 Sales • Retail Sales Up 9% on a Daily Selling Rate Basis • Hyundai SUV Retail Sales Increased 8% FOUNTAIN VALLEY, Calif., March 2, 2021 – Hyundai Motor America reported total February sales of 48,333 units, a 9% decrease compared with the company’s all-time best February in 2020. Retail sales were down 2%. Hyundai fleet sales were down 47%, representing 9% of total volume. February 2021 contained two fewer selling days and one fewer selling weekend than last year. On a daily selling rate basis, Hyundai total sales increased 1% and retail sales were up 9%. “Hyundai’s manufacturing facilities have maintained production levels, allowing our customers to find the Hyundai vehicle they desire,” said Randy Parker, senior vice president, National Sales, Hyundai Motor America. “Significant weather in parts of the country disrupted logistics and sales. We anticipate sales bouncing back in those areas over the next several months. Despite that, consumer demand remains strong and Hyundai dealers continue to achieve increasing return on sales.” Hyundai sold 44,133 retail units in January. Retail SUV sales were up 8% and represented 69% of the total retail mix. Retail sales rose for Venue (+13%), Kona (+4%), Tucson (+9%), Santa Fe (+26%) and the entire eco-friendly lineup (+17%). In support of the motion, Cyrus claims this court lacks subject matter jurisdiction under 28 U.S.C. § 1331. Defendants Hyundai Motor Manufacturing Alabama, LLC (“HMMA”), and Hyundai Motor America (“HMA”) (collectively, “Defendants”), have filed responses in opposition to the motion (Docs. # 7 and 9), asserting that Cyrus’s action is preempted by the Employee Retirement Income Security Act of 1974, 29 U.S.C. § 1144(a) (hereinafter referred to as “ERISA”). For the reasons set forth below, the Motion to Remand is due to be GRANTED. I. FACTS AND PROCEDURAL HISTORY On May 16, 2006, Cyrus filed this civil action in the Circuit Court of Montgomery County, Alabama, alleging state law claims of breach of contract for unpaid bonuses and fraud for misrepresentations that induced him to leave his Mercedes job to work for HMA and HMMA. (Compl.) In the complaint, Cyrus named HMMA, HMA, Hyundai Motor Company, Hyundai Mobis, Inc., and Hyundai Translead as defendants. Id. On June 26, 2006, pursuant to 28 U.S.C. §§ 1441 and 1446, Defendants HMMA and HMA removed this action, arguing that this court has federal question jurisdiction under ERISA. A missing sealing pin may allow moisture to enter the engine control module connector, possibly causing a control module malfunction.     Hyundai Expands Safety Office, Reflecting the Growing Importance the Company is Placing on Automotive Safety Steve Gehring Joins Hyundai as Executive Director of North American Safety Regulations and Policy FOUNTAIN VALLEY, Calif., March 24, 2020 – Hyundai Motor North America has named Steve Gehring as its new executive director of North American Safety Regulations and Policy. Steve will be based at Hyundai’s Washington, D.C. office and will be responsible for executing Hyundai’s vehicle safety strategy in the U.S., Canada and Mexico. In addition, he will focus on Hyundai’s work with the National Highway Traffic Safety Administration, the U.S. Department of Transportation, and other vehicle safety policy groups and stakeholders. He started in this role on March 23 and reports to Hyundai Motor North America Chief Safety Officer Brian Latouf. “Regulatory and safety matters are complex, so we are fortunate to have Steve join our team to provide guidance and expertise in these areas,” said Latouf. “Keeping our customers safe is of the utmost importance and with his three decades of experience and proven abilities in vehicle policy and regulation, we are confident that Hyundai will continue to be a leader in transportation safety.” Gehring comes to Hyundai with 30 years of automotive industry experience, most recently with the Association of Global Automakers and the Alliance for Automotive Innovation. This experience involved developing and implementing the trade group’s policy and regulatory positions on safety and autonomous vehicles. Prior to Global Automakers, he was director of Safety Public Policy at General Motors in Washington, D.C.
