Report on Texas Boarding Houses H.B. 1168 Submitted to the Governor and the Texas Legislature January 2009 Members of the 81st Texas Legislature, In compliance with House Bill (HB) 1168, 80th Legislature, Regular Session, 2007, the Texas Health and Human Services Commission (HHSC) contracted with Health Management Associates to prepare this report outlining methods for regulating boarding houses, including recommendations on clarifying the authority of and granting additional authority to counties and municipalities to establish health and safety standards for boarding houses. The report highlights issues for legislative consideration surrounding boarding houses in the state, primarily concerns surrounding the care and treatment of the aged, disabled and mentally ill. As indicated in the report, very few housing options are available for these individuals given their low income level. Boarding houses have developed as an alternative option to the lack of appropriate and affordable housing for these individuals. Despite filling that void, there is a considerable amount of concern for boarding house residents, particularly unsafe environments and access to personal care services. HMA has included fourteen recommendations in the report, grouped in three categories: strengthening housing options, strengthening enforcement and monitoring, and better education regarding boarding houses. One of the recommendations includes increasing the availability of Community-based Alternatives (CBA) waiver slots to allow for more Medicaid-funded assisted living options for these individuals. If more CBA slots were available, individuals would not need to rely on boarding houses and would be able to receive personal care services that they are currently unable to receive in boarding houses. In the report, HMA recommends that the Legislature create a new funding item that would provide housing stipends to mental health consumers. -

DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT Division of Environmental Health and Sustainability SANITARY STANDARDS AND REGULATIONS FOR PUBLIC ACCOMMODATIONS 6 CCR 1010-14 [Editor’s Notes follow the text of the rules at the end of this CCR Document.] ______________________________________________________________________ 1.0 ADMINISTRATION 1.1 AUTHORITY Chapter 25-1-107(m), Colorado Revised Statutes 1973. 1.2 ADOPTED; February 17, 1971 1.3 EFFECTIVE DATE: April 15, 1971 1.4 PURPOSE The purpose of these “Sanitary Standards and Regulations” is to provide minimum requirements for the protection of the health and safety of the occupants of public accommodations and residents of the general communities. 1.5 APPLICATION The provisions of these “Sanitary Standards and Regulations” are applicable to the maintenance, sanitation, ventilation, occupancy, and use of public accommodations, (rooming houses, boarding houses, lodging houses, hotels, and motels) as defined, and accessory structures thereto, located in any part of the state. 1.6 SCOPE Occupancies and uses of existing buildings used for transient or public housing facilities may be continued provided that such buildings were constructed in compliance with; applicable state or local building codes in effect at the time the buildings were constructed, other state or local housing codes, laws, and ordinances and further, that such continued use is not hazardous to the health or safety of the occupants, and is in compliance with the following standards for maintenance and operation. These requirements shall not be construed to pre-empt or limit the authority of any town, city, or county, to concurrently regulate the housing types defined under Public Accommodations, provided, that such local ordinances or regulations are not less stringent than these regulations. -

CHAPTER 14.01 PURPOSE AND DEFINITIONS 14.01.010 Purpose The several purposes of this ordinance are: To implement the Comprehensive Plan; to encourage the most appropriate use of the land; to conserve and stabilize the value of property; to aid in the rendering of fire and police protection; to provide adequate open spaces for light and air; to lessen the congestion on streets; to allow for orderly growth in the city; to prevent undue concentration of population; to facilitate adequate provisions for community utilities and facilities such as water, sewerage, electrical distribution systems, transportation, schools, parks, and other public requirements; and, in general, to promote public health, safety, convenience, and general welfare. The standards and conditions contained herein have been reviewed and deemed consistent with Comprehensive Plan policies. 14.01.020 Definitions As used in this ordinance, the masculine includes the feminine and neuter, and the singular includes the plural. The following words and phrases, unless the context otherwise requires, shall mean: Accessory Dwelling Unit. An interior, attached, or detached residential structure that is used in connection with or that is accessory to a single-family dwelling. Accessory Structure or Use. A structure or use incidental and subordinate to the primary use of the property and which is located on the same lot or parcel as the primary use or is on a contiguous lot or parcel under the same ownership.
