EXTREME SPORTS AND EXTREME LIABILITY: THE EFFECT OF WAIVERS OF LIABILITY IN EXTREME SPORTS Amanda Greer INTRODUCTION Imagine that a skier in a base jumping competition is about ready to jump off a cliff. Once the skier jumps off the cliff, usually the bindings of the skis will come off and the parachute will open, enabling a safe landing. However, in this situation, the bindings of the skis come off, but the parachute fails to open. The skier subsequently crashes to the ground, sustaining extremely serious injuries that leave the skier para- lyzed. As a result of the injuries, the skier files an action against the sponsors' involved in putting on the competition, claiming that they were negligent in giving him a defective parachute. The sponsors as- sert that the skier signed a liability waiver barring all claims, even negligence. -
Enduro 2 Class Success for Salminen & Husqvarna in Sweden
Enduro 2 class success for Salminen & Husqvarna in Sweden Husqvarna Enduro Team by CH Racing , riders Juha Salminen and Alex Salvini enjoyed podium success at the sixth round of the Enduro World Championship, the GP of Sweden, with Salminen winning the Enduro 2 class on day one before again finishing on the podium on day two in second. Salvini, who had a day to forget on day one, bounced back in style to place third in class on day two – the Italians second podium result of the series. Despite heavy rain during the days leading up to the Swedish race the event remained largely dry, but proved to be a long and challenging one. Making things tough for competitors was a typically Swedish forest enduro test that played a key role in deciding the results. Recording the fastest Enduro 2 class time during the Friday night super test Salminen went on to enjoy a near perfect start to the opening day. Quickly asserting himself at the front of the class the Finn went on to top four of the day’s special tests before placing a sizeable 39 seconds ahead of his nearest rival. Unable to explain exactly why things didn’t go quite as well on day two Juha placed as runner-up to Frenchman Pierre-Alexandre Renet. The fastest rider on the all-important enduro test on day one, on day two Salminen dominated the motocross test but wasn’t able to continue his mastery of the fast paced enduro special stage. Nevertheless Juha claimed a well deserved second place result and now looks forward to his home GP in Finland, next weekend. -
David Knight Press Release Erzberg
PRESS RELEASE David Knight Press Release Red Bull KTM Off Road Race Team Knighter opts not to compete at Erzberg ‘08 Red Bull KTM Off Road Team rider and current leader of the ’08 US Grand National Cross Country series David Knight has made the difficult decision not to compete in the ’08 edition of the world famous Erzberg Rodeo, staged in Eisenerz, Austria. Following discussions with the Red Bull KTM Off Road Team after the sixth round of the US GNCC series it was decided that due to increased testing commitments it would be best for Knight not to compete in the word’s toughest one-day extreme race. Although more than 40 pints ahead of his nearest XC1 Pro class rival in the ’08 US GNCC series Knight is focused on claiming the best results he can in the three events that remain before the championships two-month summer break. Heading to Austria on Monday, May 19 for several days of testing Knight would have next to no time to prepare himself for the Erzberg event. David Knight: “My goal this season is to successfully defend my US Grand National Cross Country title, which is why I have decided not to compete at Erzberg this year. Things are going extremely well for me in the States at the moment and I have a 41‐point lead in the XC1 Pro class championship, which is largely due to having spent many, many hours practicing, training, testing and racing on my 450 XC‐W. The down side of all this time spent riding my 450 is that I have had no time to prepare for Erzberg, where I planned on riding a 250cc two‐stroke. -
