DISPOSICIONES GENERALES MINISTERIO DE HACIENDA Y ADMINISTRACIONES PÚBLICAS 545 Resolución de 22 de enero de 2015, de la Presidencia del Comisionado para el Mercado de Tabacos, por la que se publican los precios de venta al público de determinadas labores de tabaco en Expendedurías de Tabaco y Timbre de la Península e Illes Balears. En virtud de lo establecido en el artículo 4 de la Ley 13/1998, de Ordenación del Mercado de Tabacos, se publican los precios de venta al público de determinadas labores de tabaco en Expendedurías de Tabaco y Timbre de la Península e Illes Balears, que han sido propuestos por los correspondientes fabricantes e importadores. Primero.     ANNUAL CERTIFICATION OF COMPLIANCE FOR MANUFACTURER OF CIGARETTES AND/OR “ROLL-YOUR-OWN” TOBACCO (To be filed by manufacturers who do not participate in the Master Settlement Agreement) For sales made within Michigan during the 2002 calendar year Amendments in 2002 to the Tobacco Products Tax Act (1993 PA 327) support enforcement of the escrow requirements for tobacco product manufacturers who are not participating in the tobacco Master Settlement Agreement (1999 PA 244). The amendments require that non-participating manufacturers (NPM’s) provide to the State, and anyone who sells their cigarettes and/or ‘roll-your-own’ tobacco for consumption in Michigan, an annual certification of compliance. By providing the certification, they are attesting to the fact that they have met their escrow obligation under Act 244. The amendments prohibit anyone in Michigan from acquiring, possessing, or selling cigarettes and/or ‘roll-your-own’ tobacco manufactured by an NPM who has failed to provide the certification. The Act provides severe penalties for NPM’s, or anyone selling the cigarettes and/or ‘roll-your-own’ tobacco of NPM’s, for failure to comply with the requirements. The cigarettes, including ‘roll-your-own’ tobacco, of an NPM who has failed to provide the annual certification required by the Tobacco Products Tax Act are subject to seizure or confiscation from anyone in possession of them. If an NPM or any other person does not comply with these requirements, they may be subject to a civil fine not to exceed $1,000.00 per violation, in addition to other penalties that may be imposed under this act or the revenue act.

Il mercato internazionale del tabacco e` dominato, dal lato dell’offerta, dalle seguenti societa`: Philip Morris, British American Tobacco, Im- perial Tobacco Company, RJ. Reynolds, Gulf and Western, Gruppo RuperRembrandt- Rothmans e American Brands, che formano il « Tobacco Transnational Conglomerates » (TTCs). I tre principali Paesi esportatori sono gli Stati Uniti, i Paesi Bassi e il Regno Unito. Per la distribuzione mondiale le sigarette sono quasi sempre caricate in container e trasportate su navi. La modalita`di trasporto piu` frequentemente utilizzata in Europa e` rappresentata dal trasporto su strada. Le multinazionali hanno stabilimenti di produzione e reti distributive diffuse in tutto il mondo (15), sovrintendono la formazione del prezzo del tabacco in foglie (possedendo o controllando le principali societa` che ne trattano la commercializzazione) e grazie ad investimenti nei settori bancari, assicurativi e dei trasporti, godono di vaste economie di scala, caratterizzando cosı` in modo oligopolistico l’intero mercato. Per quanto attiene piu` in particolare all’Italia, secondo i dati forniti dal Ministero delle Finanze per il 1999 la societa` con il maggiore volume di vendita risulta la Philip Morris, che detiene una fetta di mercato superiore al 50%, come puo` rilevarsi dal seguente prospetto (16).
