El precio del tabaco

El Gobierno de Gibraltar ha publicado hoy en el Boletín Oficial la Notificación Legal 235, en consonancia con su compromiso unilateral de alcanzar un diferencial del 32% en los precios del tabaco con España.
El Gobierno también ha tomado nuevas medidas en la última semana para cumplir con sus obligaciones en virtud del Protocolo de Gibraltar del Acuerdo de Retirada mediante la publicación de un paquete de medidas, que consta de 8 piezas legislativas separadas. Estas medidas aplican el Convenio Marco de la Organización Mundial de la Salud para el Control del Tabaco y el Protocolo para la Eliminación del Comercio Ilícito de Productos de Tabaco (el Protocolo de Seúl).
La legislación publicada el viernes pasado prepara a Gibraltar para la aplicación tanto del Convenio Marco como del Protocolo de Seúl con tiempo suficiente para cumplir el plazo del 30 de junio prescrito en el Protocolo de Gibraltar del Acuerdo de Retirada. El importante conjunto de medidas publicado significa el compromiso del Gobierno de cumplir sus obligaciones en virtud del Acuerdo de Retirada.
Como lo permiten la Convención Marco y el Protocolo de Seúl, la puesta en marcha de la nueva legislación se hará en etapas para que los interesados locales puedan adaptarse a las nuevas obligaciones.

Her Majesty’s Government of Gibraltar has today gazetted Legal Notice 235 in line with the Gibraltar Government’s unilateral commitment to reach a 32% differential on tobacco prices with Spain.
The Government has also taken further steps in the last week towards complying with its obligations under the Gibraltar Protocol to the Withdrawal Agreement through the publication of a package of measures, consisting of 8 separate pieces of legislation. These measures implement the World Health Organisation Framework Convention on Tobacco Control and the Protocol to Eliminate Illicit Trade on Tobacco Products (the Seoul Protocol).
The legislation published last Friday prepares Gibraltar for the extension of both the Framework Convention and the Seoul Protocol in sufficient time to meet the 30 June deadline prescribed by the Gibraltar Protocol to the Withdrawal Agreement. The substantial package of measures published signifies the Government’s commitment to meeting its obligations under the Withdrawal Agreement.
As permitted under the Framework Convention and Seoul Protocol, commencement of the new legislation will be staged to allow local stakeholders to adapt to new obligations.

TOBACCO (MINIMUM RETAIL PRICE) NOTICE (No.3) 2020
In exercise of the powers conferred on him by section 4A of the Tobacco Act 1997, the Collector of Customs has made the following notice-
Title.
1. This Notice may be cited as the Tobacco (Minimum Retail Price) Notice (No.3) 2020.
Commencement.
2. This Notice comes into operation on the 25 June 2020.
Minimum retail prices for tobacco.
3. The Collector of Customs has declared the minimum retail price for types of tobacco categorised below as follows:
(Per Packet of 20) Premium Cigarettes for no less than £ 3.00 Mid-High Cigarettes for no less than £ 2.80 Mid-Ordinary Cigarettes for no less than £ 2.60 Ordinary Cigarettes for no less than £ 2.50
Premium cigarettes shall be the following and shall be sold for no less than £ 3.00 per packet of 20 cigarettes:

4. Any brands of cigarettes not categorised above may not be offered for retail sale in Gibraltar without the prior consent of the Collector of Customs, who shall designate the category in which any such cigarettes may be offered for retail sale.
5. The retail sale of any categorised cigarettes for a sum below that set out herein shall be an offence contrary to the Tobacco Act 1997.

Effect of Notice.
6. This Notice replaces the Tobacco (Minimum Retail Price) Notice (No.2) 2020 published as Legal Notice 145 of 2020.
