61/- The Executive Council considered the email dated 16.03.2021 received from Shri Raj Kumar Bhatia wherein it was proposed for reconsideration of six points of the EC Resolution dated 29.10.2020. However, the minutes dated 08.12.2020 vide Resolution No. 44 mentions 6th point of EC Resolution dated 29.12.2020.

It was decided to amend the portion of the said minutes accordingly. Hence, it would read as:–

“………………it was proposed that Six (6) points of the EC Resolution dated 29.10.2020………………”

Thereafter, the Minutes of the meeting of the Executive Council held on 08.12.2020 (Appendix-I & Appendix-II) were confirmed with above amendment.

62/- The Executive Council considered the email dated 17.03.2021 received from Dr. J.L. Gupta regarding the Resolution No. 60-13.

The Chairperson of the Committee constituted in the matter was again requested to submit the report at the earliest.

Thereafter, the Minutes of the emergent meeting of the Executive Council held on 20.02.2021 (Appendix-III) were confirmed.

63/- The Action Taken Report on the decisions made by the Executive Council at its meeting held on 08.12.2020 (Appendix-IV) and 20.02.2021 (Appendix-V) were noted.

The Executive Council also noted:-

63-1. The University of Delhi vide letter No. CNC-II/2020/R-4195 dated 08.12.2020 conveyed following two names of Committee members as per provisions of Statute 11-F of the Delhi University Act, 1922 for appointment of new Vice Chancellor to the Ministry of Education:

1. Shri Yogendra Narain, IAS (Retd.), Chancellor, Hemwati Nandan Bahuguna Garhwal University (HNBGU), Uttarakhand. 2. Prof. Raj Kumar, Vice-Chancellor, Punjab University, Chandigarh

63-2. The Ministry of Education vide order dated 24.12.2020 (copy enclosed) notified that the Hon’ble President of India in his capacity as Visitor of the University, on consideration of facts and material available on record is pleased to direct to conduct an enquiry into the allegations of dereliction of duties and lack of commitment and devotion against Yogesh Tyagi, Vice-Chancellor, University of Delhi by a Committee having following composition:

(a) Prof. K.K. Aggarwal, Chairman, NBA (b) Prof. Sanjay Dhande, Ex Director, IIT Kanpur (c) Prof. Tirupati Rao, Ex Vice Chancellor, Osmania University

63-3. Prof. Yogesh Tyagi vide email dated 09.03.2021 relinquished the office of the Vice Chancellor on completion of his 5 year term at the University of Delhi.

63-4. Consequent upon relinquishment of charge on account of completion of tenure of Vice Chancellor by Prof. Yogesh Tyagi, Prof. P.C. Joshi, Pro Vice Chancellor shall perform the functions of the Vice Chancellor until the appointment of new Vice Chancellor in terms of provisions of Statute 11-F(6) read with Statute 11-H(4) of the Delhi University Act, 1922, and the same has been notified vide notification No. Estab. II(i)/1010/2016/06/R-4226 dated 10.03.2021.

Note:- The Department of Higher Education, Ministry of Education, Government of India vide letter no. 4-15/2020, CU-II dated 09.03.2021 conveyed the continuation of the charge of Vice-Chancellor of University of Delhi by the Pro-Vice-Chancellor, till a new Vice-Chancellor is appointed and enters upon office or till further orders.

64/- The Executive Council considered and approved the un-audited Annual Accounts of the University, its maintained Halls & Hostel, Delhi University Press, Provident Fund and New Pension Scheme for the Financial Year 2019-20.

Note:-The Finance Committee at its meeting held on 11.01.2021 considered the un-audited Annual Accounts for the Financial Year 2019-20 (Appendix-VI).

65/- The Executive Council considered and approved the procedure recommended by the Committee (Appendix-VII) constituted by the Competent Authority for change of name of a student of the University, on request. The below mentioned table brings about the amendment recommended by the committee in the light of the Judgement of the Hon’ble High Court of Delhi in WPC No.6813/2020 in Rayaan Chawla Vs University of Delhi and Anr. matter dated 06.11.2020 (Appendix-VIII).

6. Application for change of name will be entertained only No Change when the applicant is a student of University of Delhi at the time of applying for change of name.

Application for change of name from a person who is not a student of the University at the time of submission of application or who has already completed his/her course of study shall not be considered.

7. The process of change of name may require at least 2 No Change week’s time after submission of application.

8. Application of students of any class for change of name No Change shall be accepted only after 30th September.

9. Any change in name/ surname will be effective only after No Change its approval by the University. 10. The name after change will be read as changed name alias/ No Change nee earlier name. 11. The student shall first get the name changed from The student CBSE/State Boards/Other related Boards. shall not be required to first get the name changed from CBSE/State Boards/other related boards.

Note:-The committee recommends that this amendment will ensure a streamlined procedure for change of name of a student of the University in a prospective manner.

66/- The Executive Council considered and approved the 97th Annual Report of the University for the Year 2019-2020. (Appendix-IX).

67/- The Executive Council considered and approved the Minutes of the Finance Committee Meeting held on 11th January, 2021 (Appendix-X).

68/- The Executive Council considered and approved the Minutes of the Finance Committee Meeting held on 08th March, 2021 (Appendix-XI).

69/- The Executive Council considered and approved the Financial Estimates 2021-22 (Revised Budgeted Estimate 2020-21 and Budget Estimate 2021-22) of the University as considered by the Finance Committee Meeting held on 08.03.2021. (Appendix-XII).

70/- The Executive Council considered the order passed by the High Court of Delhi in the Writ Petitions W.P.(C) 10564/2019, WP(C) 10744/2019 and WP(C) 10789/2019, CM No. 44576/2019 (Appendix-XIII) wherein the recommendation, regarding date of eligibility of promotion, of the Selection Committee approved by the Executive Council was challenged.

The Court observed as under:

“21. In view of the above, the petitions need to be allowed. The proceedings of the Selection Committee / Executive Council / communication dated July 04, 2019 are set aside to the extent that promotion has been given to the petitioners to the post of Professor is made prospectively i.e. from June 25, 2019. The said promotion shall relate back to their date of eligibility. No costs.”

The Executive Council discussed the matter at length vis-à-vis numerous representations received from Faculty Members to antedate the date of promotion to date of eligibility. This relates back to the period for almost 20 years or so. The representations also include the persons who got superannuated. Therefore, the span of applicability of the said judgment is unlimited and involves financial implications. Further denial of benefits except to those in whose favor the judgement has been pronounced would lead to multiple litigations. The option available is either to accept and implement the decision of the Hon’ble Court or go in for appeal.

After a lengthy discussion, the Executive Council authorized the Vice-Chancellor to take decision in the matter.

71/- Disciplinary Matters (71-1 & 71-2)

72/- The Executive Council considered the matter regarding the recovery of salary from teachers who availed study leave for award of Ph.D. Degree.

The Executive Council noted that as per the bond signed by the teachers it was envisaged that the recovery of salary shall be made in case a teacher is not awarded Ph.D. degree within the span period of study leave.

The Executive Council also noted that during the span period of study leave pursuing for Ph.D., it is expected from a teacher to do compulsory course work, data collection / survey, experimentation, field work etc. Besides above, pre-synopsis, Ph.D. confirmation seminar, pre- Ph.D. submission seminar and thesis writing followed by thesis evaluation and viva-voce are the statutory requirements to be completed before the Ph.D. is awarded, which in most of the cases cannot be completed in the span of study leave period.

Therefore, the Executive Council decided that the recovery of salary shall not be made from the teachers who have been awarded Ph.D. degree while in service after availing the study leave.

73/- The Executive Council considered the representation received from DUCKU to grant permissions to the Non-Teaching staff to contest elections to any Legislator or Local authorities and approved the amendment to University Non-Teaching Employees (Terms and Conditions of Service) Rules-2013 clause 46 (5) to the extent that nothing in this rule shall be deemed to prohibit any employee to participate or to contest the elections for various bodies such as Parliament, State Legislative Assemblies and Municipal Corporations etc. on the same terms and conditions as are applicable to teachers and also subject to the conditions that the employees will avail of their own leave for contesting the Elections. However, in the event of their getting elected or nominated to any body, they will be required to take leave of absence during the term as member as in the case of teachers.

74/- The following decision/action taken by the Vice-Chancellor/Pro-Vice Chancellor in exercise of his powers/delegated powers vested in him other than emergency powers in the following matters were reported, recorded and confirmed:

74-1. Accord of approval on 03.11.2020 to the appointment of Prof. Anil Rai, Department of Hindi as Dean, International Relations (Social Science and Humanities) in place of Prof. K.N. Tiwari, in addition to his other duties and responsibilities w.e.f. 03.11.2020 till further orders.

74-2. Accord of approval on 12.11.2020 granting permission to Prof. Manoj Kumar Jha, Department of Social Work to join as a member of Rajya Sabha. He has also been granted permission to attend his teaching duties and responsibilities and to teach core papers in each semester and continue supervising Ph.D. and M.Phil. students. He has further been granted permission to draw his salary from Delhi University. [As per UGC letter no. F.1-1/2014(PS) Audit dated 27.02.2019 addressed to Rajya Sabha Secretariat mentioning that the matter was placed before Commission in its Meeting held on 26.02.2019. The commission resolved as under:

1. “As per UGC Circular of 1987 and as stated in the Programme of Action on National Policy on Education, the teachers who wish to take the leave of absence during their term as Members of the Parliament/State Legislature may be allowed to do so while ensuring that they do not lost their seniority or increments in the process. In this case they will draw their salary from the Parliament/State Legislature Secretariat.

2. The teachers who wish to continue teaching in the University departments/colleges after being elected/nominated as Members of Parliament/State Legislation, may be allowed to continue with the teaching and research work in the Universities/colleges with the provision that they may be treated as “on duty” when the Parliament/State Legislature is in session for attending the session and when such teachers undertake any other Parliamentary/State Legislative assignments. To ensure that the teaching work does not suffer, the University may consider assigning appropriate work load to such teachers. However, such teachers should not hold any administrative positions/responsibilities in the University/College during the period they are Members of Parliament/State Legislature.

Such teachers may draw their salary from the concerned University/College. However, the admissible allowances may be drawn from the Parliament/State Legislature Secretariat.

74-3. Accord of approval on 13.11.2020 to the promotion of Sh. Rajinder Singh, Assistant Engineer (Elect.) to the post of Executive Engineer (Elect.) in the Engineering Deptt. (Group-A).

74-4. Accord of approval on 03.12.2020 granting deputation to Prof. Dinabandhu Sahoo, Department of Botany for a period of three years from the date of his relieving from the Department i.e. 05.12.2020 (A/N) to join as Vice-Chancellor, Fakir Mohan University, Balasore, Odhisa.

74-5. Accord of approval on 17.12.2020 to the appointment of Dr. Ajay Kumar Arora, Associate Professor, Keshav Mahavidyalaya (University of Delhi) as OSD (Examinations) in the University of Delhi w.e.f. 18.12.2020 (FN) till further orders.

74-6. Accord of approval on 18.12.2020 to the appointment of Prof. Devesh K. Sinha, Department of Geology as Honorary Director, Delhi School of Climate Change & Sustainability (DSCCS) in addition to his current duties w.e.f. 28.12.2020, till further orders.

74-7. Accord of approval on 23.12.2020 to the extension of extra-ordinary-leave (without pay) to Professor Ajay Kumar Singh, Department of Commerce w.e.f. 10.05.2021 to 30.10.2022 in continuation to extra-ordinary-leave (without pay) already granted to him w.e.f. 10.05.2019 to 09.05.2021, to enable him to join as Vice-Chancellor in Sri Sri University, Cuttack.

74-8. Accord of approval on 30.12.2020 to the reconstituted Advisory Committee of the Insitute of Life Long Learning (ILLL), University of Delhi for a period of two years w.e.f. 31.12.2020, the composition is as under: 1.
