Method of capture: Nephrops creels (pots) Date of Surveillance Visit: 05 Jul 2010 Date: Jan 2003. Loch Torridon Nephrops Creel Fishery: Certificate suspension 2011 2.0 CERTIFICATE SUSPENSION The rational for the suspension was given in the second surveillance report (posted on the MSC website 10 Sept 2010) and the suspension recommendation (posted on the MSC website 9 Dec 2010). Start of the suspension Immediately upon the date this report was posted on the MSC website. Maximum duration of the certificate suspension The duration of the certificate suspension will be until either the client presents an appropriate response to the assessment team (a clear plan to fulfill condition 1 and/or to demonstrate that the stock within the creel only area is sustainable) or until the next surveillance audit is due (04 Jul 2011), whichever occurs soonest. Note that surveillance report 3 would be posted on the MSC website 35d after the site visit took place. Outline of the circumstances and the process necessary for the certificate suspension to be lifted The suspension may be lifted if the client presents an appropriate response to the assessment team (a clear plan to fulfill condition 1 and/or to demonstrate that the stock within the creel only area is sustainable). MML would conduct an expedited or annual surveillance audit and post a report on the MSC website. If the report recommends the removal of the suspension then the suspension would be lifted 30d after the publication of the audit report on the MSC website. Outline of the circumstances and process for the suspension to change to a certificate withdrawal. The suspension will run until the next annual surveillance audit due on 04 Jul 2011. If TNMG, as client for this fishery, do not present the assessment team with a clear plan to fulfill condition 1 and/or to demonstrate that the stock within the creel only area is sustainable, then MML would post a notice on the MSC website giving 30d notice that the certificate was to be withdrawn. Alternatively the client could ask for the certificate to be withdrawn at any point before 04 Jul 2011 and MML would post this on the MSC website. Once the certificate has been withdrawn the fishery would have to undergo MSC main assessment to regain fishery certification. Implications of suspension and or withdrawal upon certified product in the supply chain (chain of custody) None of the Nephrops from the fishery are sold as MSC certified. Shieldaig Export is the principal shellfish dealer for the certified fishery and does not hold an MSC chain of custody certificate. Certified Nephrops from the Torridon fishery cannot be in the supply chain. The MSC logo is not used. Rev. 01 Page 3 of 3 .
