Educational Provision for Young Prisoners: to Realize Rights Or to Rehabilitate? EDUCATIONAL PROVISION FOR YOUNG PRISONERS: TO REALIZE RIGHTS OR TO REHABILITATE? A thesis submitted for the degree of Doctor of Philosophy by Rosfizah Md Taib School of Law, Brunel University August 2012 Abstract This thesis examines the extent to which, and the reasons why, the government of Malaysia provides educational opportunities for children and young people who are being detained in the closed (penal) institutions on orders under section 91 (1) (f) and section 97 of the Child Act, 2001. This thesis presents a detailed analysis of the driving factor(s) that motivate the government of Malaysia in formulating and implementing policy and law in regards to providing educational opportunities for such young people. The thesis, therefore, examines the conceptualization by the Malaysia Prisons Department of children‟s rights, particularly their rights to education and offender rehabilitation. Analysis reveals that, educational rights in Malaysia have such priority because education is seen generally as the way to socialize (all) young people and to improve human capital and economic potential in Malaysia. Consequently, rehabilitation in Malaysian penal institutions is conceptualized almost entirely as education. The thesis argues that the Malaysian government has been using children‟s rights to education and also offender rehabilitation to improve the process of socialization of young people in prisons institutions to enable them to contribute to the achievement of the national goals. ii ACKNOWLEDGEMENTS To My Beloved Late Parents, MD. The lack of documentation on the early periods of library history creates an emphasis on developments in the modern period. This is not out of order since it is only recently that libraries in West Malaysia and Singapore have been recognized as one of the important media of mass education. Lack of funds, failure to recognize the importance of libraries, and problems caused by the federal structure of gc,vernment are blamed for this delay in development. Hinderances to future development are the lack of trained librarians, problems of having to provide material in several different languages, and the lack of national bibliographies, union catalogs and lists of serials.     CHAPTER 2 Merdeka for Malaya: Imagining Independence Across the British Empire Tom Rice ‘And now an era comes near to its close’, announces the British commentator, ‘as the last few minutes of 170 years of British protection over Malaya tick away’. A shot from below of the clock striking midnight is interspersed with the image of the Union Flag, now lowered from its pole. The sound of the chiming clock competes with that of the British national anthem before both are replaced by the noise of cheering crowds. The camera pans down to reveal a neon sign, stating ‘Merdeka’ (Freedom). The shot fades to black. This short sequence within the Malayan Film Unit’s (MFU) official record of Malayan Independence, Merdeka for Malaya (director unknown, MFU, 1957), visualises the country’s move from colonial to independent state. This complex, contested and often violent process is contained and imagined throughout this 30- minute film within succinct visual displays, through public celebrations, airport departures and official ceremonies. The film offers a record of the ceremonial events of independence, illustrating the ways in which states are symbolically imagined through such pageantry. While there has been much excellent recent scholarship on independence ceremonies, I want to think more closely in this chapter about the film record. In doing this, we might usefully examine the spectacle of colonial handover as 73 a distinctly ‘filmic’ moment, one that is organised visually and constructed on film. In short, how is changing statehood visualised through film? Furthermore, what role do government film units play within this process? A closer examination of the production history of Merdeka for Malaya provides a further way to explore the move from ‘colonial’ to ‘postcolonial’ within film.

    South East Asian Studies, Vol. 13, No.4, March 1976 The Structure of Government in the Colonial Federation of Malaya by Martin RUDNER* The colonial Federation of Malaya, which came into being in 1948 and gave way to self-government in 1957, constituted in historical perspective a major formative influence in state-building. From the standpoint of recent Malayan history, the colonial Federation marked the transition from a variegated imperial pattern to modern state forms. To be sure, the colonial Federation was not the first effort at governmental modernization in British Malaya, however it was the first that combined a joint, British-Malayan design for political development. Just two years prior, a British­ imposed Malayan Union, conceived on a secular model of administrative efficiency, floundered precisely because the scheme failed to cope with the suddenly expressive and rapidly changing tenor of Malaya's communal politicallifeY Its successor Federation of Malaya was conceived more in terms of the reconciliation of fundamental political interests, on one hand colonial and emergent nationalist, on the other the rival claims of the ethnic communities, and so offered a delicately blended governmental structure. The efficacy of this state-building venture may be evidence in its early transformation to independence, after only nine years. The project explores how national and international interventions have and have not been effective in fostering and sustaining political deals and elite bargains; and whether or not these political deals and elite bargains have helped reduce violence, increased local, regional and national stability and contributed to the strengthening of the relevant political settlement.     Kajian Malaysia, Vol. 34, No. 1, 2016, 135–138 BOOK REVIEW Templer and the Road to Malayan Independence: The Man and His Time, by Leon Comber. Singapore: Institute of Southeast Asian Studies (ISEAS), 2015, 239 pp. There are a number of books on General Sir Gerald Templer and his two year proconsulship in Malaya (1952–1954) as High Commissioner and Director of Operations but views on the man are somewhat mixed. One view describes him as a "martinet in manner and appearance"; another labeled him a dictator while a Malaysian scholar claimed the man was notorious for his violent temper and intemperate language. Then there are those who saw his crucial role in defeating the Communist uprising while others credited this success to the Briggs Plan which was put in place before his arrival in Malaya by the previous Director of Operations Lt. General Sir Harold Briggs. This brilliant plan forced the Malayan Communist Party (MCP) to focus on consolidation rather than military offensive through its withdrawal deep into the Malaya-Thai border and later into south Thailand. Leon Comber provides a fresh insight to the argument by giving a more balanced account of the man. He argues that Templer's "own input was the vigour and military drive he infused into the campaign against the Communists" and for this Templer should be given credit. I agree with Comber's assessment of Templer who was widely accepted as an outstanding general but his dealing with politicians were not as remarkable. His "well known abrasiveness and use of barrack room language left one with the feeling that he was an old-world imperialist who was out of touch with the times who regarded with extreme distaste the abandonment of Britain's imperial responsibilities." Coming from a former imperial functionary himself this is certainly a perceptive assessment of Templer.

    Draft manuscript British Counterinsurgency in Malaya: Population Control, Intelligence and Military Operations Great Britain scored a military victory in the colonial campaign it fought in Malaya from 1948 to 1960. At the end this conflict its army controlled the disputed territory, having systematically defeated, rooted out and forced their enemies into hiding or across international borders1. Despite that, the conflict ended with the colonial power leaving the land and recognizing its independence. Although the British left Malaya in the hands of a friendly government representing the local economic elite and all too willing to make military and economic concessions to the former colonial power the result was a military victory combined with a cessation of formal imperial ties2. The Malayan campaign was a brutal affair in which tens of thousands lost their lives and hundreds of thousands were displaced. Both the government and the insurgents may have followed noble, generous goals, but in doing so they wrought pain and suffering on many innocents. In a pattern that has very little to do with the stated aims of the guerrillas and the professed democratic values of the governments, the conclusion of the conflict was reached through violence and bloodshed. This paper will discuss the Malayan Emergency in the following format: the first section presents the political, economic and military context of the conflict, with a focus on internal and foreign aspects.
