Becomes Singapore Airlines Cargo’S Sole Cargo Handling Partner in the Uk & Ireland NEWS RELEASE Please find here a news release issued today by Worldwide Flight Services (WFS) Media contact: Jamie Roche, JRPR Date: 5 December 2014 T: + 44 (0) 1344 631880/1/3 E: [email protected] WORLDWIDE FLIGHT SERVICES (WFS) BECOMES SINGAPORE AIRLINES CARGO’S SOLE CARGO HANDLING PARTNER IN THE UK & IRELAND Worldwide Flight Services (WFS) has won a three-year contract to provide full cargo handling services for Singapore Airlines Cargo at London Heathrow and at all of its UK regional locations. The contract takes effect in January 2015 and will see WFS handle some 46,000 tonnes of cargo a year for the airline. Singapore Airlines Cargo operates two Boeing 747 freighter services a week from the UK with a payload of 100 tonnes per flight and provides cargo uplift for Singapore Airlines’ twice daily Airbus A380 flights and twice-daily B777-300 from London to Singapore, each offering between 10 and 27 tonnes of cargo capacity respectively. At London Heathrow, Singapore Airlines Cargo will be handled in WFS’ Building 550 in the World Cargo Centre, which is undergoing significant investment prior to the start of the contract. This will provide new equipment and systems, more cargo acceptance doors and extra operational offices, and see the refurbishment of offices for Singapore Airlines Cargo’s team based at Heathrow. WFS has also been awarded the ramp transportation contract for Singapore Airlines at London Heathrow. P.T.O Patrick Roberts, Vice President UK & Ireland for WFS, said: “Having provided cargo handling services to Singapore Airlines Cargo in Manchester for some 20 years, we are extremely proud that this new contract now makes us the airline’s sole handler in the UK and Ireland. Singapore Airlines Cargo is a major cargo carrier with a strong reputation for the quality of its freight services. This contract is a significant addition to our business in the UK and Ireland. It is also a tribute to the service levels provided by the WFS teams at all of our locations that we have been successful in what was, not surprisingly, a very competitive tender process.” WFS is the largest on-airport cargo handler at London Heathrow, with more than 280,000 square feet of freight facilities. In September this was boosted by the opening of a further 50,000 sq ft location in Scylla Road at the airport, adjacent to the World Cargo Centre. In the UK and Ireland, WFS also operates cargo centres at London Gatwick, Birmingham, Manchester and Glasgow, as well as at Luton, Bristol, Leeds-Bradford, Newcastle, Edinburgh, Aberdeen, Dublin, Shannon and Cork. WFS was founded in 1971 and is a leading global provider of ground handling and technical services, and the world’s largest cargo handler. Today, it is present at some 140 major airports in more than 20 countries on five continents. It allowed KLM and any other Dutch carrier to fly to any point in the United States, and allowed U.S. carriers to fly to any point in the Netherlands, a country about the size of West Virginia. The U.S. was ideologically wedded to open markets, so the imbalance in traffic rights was of no concern. Moreover, opening up the Netherlands would allow KLM to drain traffic from surrounding airline networks, which would eventually encourage the surrounding airlines to ask their governments to sign “open skies” bilateral with the United States. • 1993 - the U.S. conferred antitrust immunity on the Wings Alliance between Northwest Airlines and KLM. The encirclement policy began to corrode resistance to liberalization as the sixth freedom traffic drain began to grow; soon Lufthansa, then Air France, were asking their governments to sign liberal bilaterals. • 1996 - Germany fell, followed by the Czech Republic, Italy, Portugal, the Slovak Republic, Malta, Poland. • 2001- the United States had concluded bilateral open skies agreements with 52 nations and concluded its first multilateral open skies agreement with Brunei, Chile, New Zealand and Singapore. • 2002 – France fell. • 2007 - The U.S. and E.U. concluded a multilateral “open skies” traffic agreement that liberalized everything but foreign ownership and cabotage. • 2011 – cumulatively, the U.S. had signed “open skies” bilaterals with more than100 States. Multilateral and Bilateral Air Transport Agreements • Section 5 of the Transit Agreement, and Section 6 of the Transport Agreement, provide: “Each contracting State reserves the right to withhold or revoke a certificate or permit to an air transport enterprise of another State in any case where it is not satisfied that substantial ownership and effective control are vested in nationals of a contracting State .

    AVIANCA BRASIL TO EXIT STAR ALLIANCE Star Alliance maintains competitive network in the region FRANKFURT, Germany – 19 August 2019 –Brazilian airline Ocean Air Linhas Aéreas S/A, headquartered in São Paulo and formerly doing business as Avianca Brasil, will formally leave Star Alliance with effect from 1 September 2019. Ocean Air’s withdrawal follows several months of bankruptcy protection and the withdrawal of its Air Operator Certificate (AOC) by Brazilian regulator ANAC. The Star Alliance network maintains a significant and long-time presence in the Brazilian market continuously since its founding in 1997. As of 1 September 2019, the Alliance will number 27 member airlines. Jeffrey Goh, CEO Star Alliance, said: “Initially joining Star Alliance in 2015, Avianca Brasil made important contributions to our customer proposition in the Brazilian market, and we regret this unfortunate development. “I wish to stress that the exit of Avianca Brasil in no way affects the membership of Avianca S.A., our valued member based in Bogota, Colombia, which continues to be a significant contributor to the Alliance in South America."     436 Singapore Academy of Law Journal (2014) 26 SAcLJ THE QANTAS/EMIRATES DECISION How the Competition Commission of Singapore Used the Net Economic Benefits Exclusion to Regulate the Air Passenger Market The Competition Commission of Singapore (“CCS”) did not properly assess the Net Economic Benefits (“NEB”) created by the co-operation agreement between Qantas Airways Ltd and Emirates. In particular, the high market shares of the two companies should have excluded the NEB defence under the Competition Act (Cap 50B, 2006 Rev Ed), even more so as the remedies proposed by the parties are likely to increase their market share further. The CCS appears to have failed to follow the letter of the Competition Act and instead effectively regulated the airlines sector through the use of competition tools, undermining the enforcement of competition rules and restricting competition in the airlines sector. The more recent decision on the Qantas/Jetstar co-operation shows an improvement in the assessment of economic benefits. The CCS must continue to improve its competitive assessment, must restrict the use of the NEB defence and possibly adopt the more internationally accepted slot divestment remedy as a way of solving competition concerns in airline agreements, or it will hurt competition and consumers in Singapore.
