    Appendix A Regulatory Requirements All Silvicultural Operations, 401 KAR 5:026, 5:029, 5:030, and 5:031 All operations must meet Kentucky water quality standards. Activities Near High-quality Waters and Outstand- ing National Resources Waters, 401 KAR 5:029, 5:030, and 5:031. Kentucky water quality standards (401 KAR 5:029) require the use of BMPs to protect high-quality waters and outstanding national resources waters listed in 401 KAR 5:030. In addition, outstanding resource wa- ters that support federally listed threatened and endan- gered species require protection (see 401 KAR 5:031). Activities Near Wild Rivers, KRS 146.200 et seq. and 401 KAR 4:100-140. The Kentucky Wild Rivers Act and associated regulations give special protection to streams designated as “wild rivers,” including regulation of sil- vicultural activity. Before undertaking any silvicultural activity in a corridor of a designated wild river, the land- owner or logger should contact the Wild Rivers Program of the Kentucky Division of Water for applicable regula- tions and instructions. Debris in Floodplains, KRS 151.250. The Kentucky Division of Water has authority over the placement of debris (including logging slash) in floodplains of peren- nial streams that have a drainage area larger than one- square mile. The Division of Water advises that as long as the BMPs for Streamside Management Zones and log- ging debris are followed, landowners and loggers will be considered in compliance with floodplain regulations that address debris. If these BMPs are not followed, the Ken- tucky Division of Water can institute enforcement pro- ceedings.

    PARTNERSHIP AGREEMENT THE COMMONWEALTH OF KENTUCKY AND THE U.S. DEPARTMENT OF EDUCATION, OFFICE FOR CIVIL RIGHTS Introduction In May of 1999, the Commonwealth of Kentucky and the United States Department of Education, Office for Civil Rights (OCR), entered into a Partnership for the purpose of improving the educational opportunities for African Americans in Kentucky's public institutions of higher education. As part of the Partnership process, the Commonwealth and OCR examined the status of African Americans regarding access, enrollment, retention, and graduation at the Commonwealth’s institutions of higher education. The Partnership process has been a joint, cooperative effort and has not attempted to make legal findings or to conduct any type of legal proceedings. The result of the Partnership process is the following agreement: Part I of the agreement provides an historical overview of Kentucky's system of public higher education, including an outline of Kentucky’s original five-year desegregation plan and a summary of the Commonwealth's recent efforts to increase African American students' access, retention, and graduation in higher education. Part II summarizes the development and accomplishments of the Partnership process. Part III sets forth the commitments that OCR anticipates will bring Kentucky into full compliance with Title VI and the Fordice standards regarding Kentucky's system of public higher education. I. OVERVIEW OF KENTUCKY'S SYSTEM OF HIGHER EDUCATION A. Kentucky's System of Public Higher Education The Commonwealth of Kentucky's system of public postsecondary education consists of eight four-year universities, fourteen community colleges, and fifteen technical colleges. For the purpose of this agreement, the eight public universities and the thirteen community colleges in the Kentucky Community and Technical College System (KCTCS) and the University of Kentucky - Lexington Community College are included.

Following all these disturbances in the National Democratic party's membership in this state and other sections, three nominees were put up for President, each having ardent supporters among all the slave-holding states. Douglas and Johnson, Bell and Elliot, and Breckenridge and Lane, all had their votes and were upheld in Georgia respectively by Stephens, Hill, and Toombs. These Georgians stumped the state for their favorites, all coming to Columbus. Douglas accompanied by Stephens addressid a large gathering from the porch of the Oglethorpe Hotel. Hill and Toombs at other times spoke from the same place. The result of the campaign in Georgia was the selection of a Brecken- ridge and Lane electoral ticket at the Democratic State convention on Au- gust 8, 1860. Peyton H. Colquitt and his brother, Alfred H. Colquitt, were both delegates, though from different counties. At the subsequent Douglas and Johnson convention many supporters went over to the Breckenridge and Lane ticket, among them A. H. Chappell, one of the most ardent leaders. The result of the national election came eventually, however, and Lincoln and Hamlin were announced victorious. The effect on the South was instantaneous and maddening. The Georgia legislature, the same as of 1 8 59, assembled and made Gen. C. J. Williams, of Columbus, Speaker of the House, in place of I. T. Irwin who had died. The main action of the legislature was the calling of a convention of the people of the state to be held January 16th, 1861, at Milledgeville to take up the matter of union or secession.

    Kentucky Rural Water Association Source Water Protection Program Priority Areas Planned for 2015-2016: Hardin County Water District #2. (2nd Dist.) Justification: Non-point source impact by sediment, pesticides and nutrients from agriculture activity, urban land use and development, highway corridor, and logging. Source Water Protection Plan currently under development for their three water sources. Hardin County Water District #2 in late 2014 took over ownership and operation of the Elizabethtown Water Utility. This merging of services will necessitate the combination of the three sources (White Mills Spring, City Springs, and Freeman Lake) into one Source Water Protection Plan. In early 2015, with the assistance of Kentucky Rural Water Association and the Kentucky Division of Water, Hardin County Water District #1 and Hardin County Water District #2 are planning to undertake a joint Public Meeting to inform and educate its county and city leaders and citizens on the need and value of source water protection. Berea (6th Dist) Justification: Berea is one of three (Middlesboro-Fern Lake and Pineville-Cannon Creek Lake) water utilities in Kentucky that has essentially 100% of its watershed forested. Active interest in source water protection and land use planning by Berea College and Berea Municipal Utility. The four watersheds in the Berea source water protection areas has undergone selective logging over the past 100 years since these are managed working forests. Water quality has not changed at this time but close continual monitoring will continue. This site is developing as a case study site in Forest Management Practices with respect to water quality over time.
