EX10.2 6996 JUSTINE DRIVE To construct, reconstruct, erect or place a building or structure on Block A, Plan 566, (6996 Justine Drive), in the City of Mississauga, Mimico Creek Watershed. The purpose is to undertake works within TRCA's Regulated Area of the Mimico Creek Watershed in order to facilitate the construction of a 139.16 sq. m (1,498 sq. ft.) replacement residential dwelling and a 75 sq. m (808 sq. ft.) garage associated with a municipal building permit application. 48

EX10.3 CITY OF TORONTO To construct, reconstruct, erect or place a building or structure, site grade, temporarily or permanently place, dump or remove any material, originating on the site or elsewhere, and alter a watercourse, on Donwoods Drive from Ivor Road to ; Ivor Road from Yonge Street to Donwoods Drive; and Campbell Crescent from Old Road to Old Yonge Street, in the City of Toronto (North York Community Council Area), Don River Watershed, as located on property owned by the City of Toronto, and by TRCA under management agreement to the City of Toronto. The purpose is to carry out stormwater management improvements. Works will involve reconstruction of storm sewers and existing roadways, as well as watermain replacements. Through review of the information provided and identified in the summary of plans section, TRCA is of the opinion that the project and implementation as proposed will not cause serious harm to fish. The Ministry of Natural Resources warm water fisheries timing window will apply to this proposal, unless otherwise specified in writing by MNR. 51

CITY OF TORONTO [SCARBOROUGH COMMUNITY COUNCIL AREA]

EX10.4 CITY OF TORONTO To construct, reconstruct, erect or place a building or structure, site grade, temporarily or permanently place, dump or remove any material, originating on the site or elsewhere, and alter a watercourse, at Firvalley Woods (656 Warden Avenue, south of St. Clair Avenue East), in the City of Toronto (Scarborough Community Council Area), Don River Watershed, as located on property owned by the City of Toronto. The purpose is to undertake channel restoration works to protect adjacent infrastructure. Works will involve reconstruction of the channel and installation of various reinforcement elements. Through review of the information provided and identified in the summary of plans section, TRCA is of the opinion that the project and implementation as proposed will not cause serious harm to fish. The Ministry of Natural Resources warm water fisheries timing window will apply to this proposal, unless otherwise specified in writing by MNR. 54

4 CITY OF VAUGHAN

EX10.5 MINTO YONGE & ARNOLD INC. To construct, reconstruct, erect or place a building or structure on Lot 66, 67, Plan 9834 & 2132, (7608 Yonge Street), in the City of Vaughan, Don River Watershed as located on the property owned by Minto Yonge & Arnold Inc.. The purpose is to construct a mid-rise condominium building, associated stormwater management infrastructure and conduct associated grading works within a Regulated Area of the Don River Watershed at 7608 Yonge Street in the City of Vaughan. 57

EX10.6 YORK REGION DISTRICT SCHOOL BOARD To site grade on 50 Naylon Street, in the City of Vaughan, Don River Watershed as located on the property owned by York Region District School Board. The purpose is to undertake works within TRCA's Regulated Area of the Don River Watershed in order to facilitate the construction of a parking area and associated enhanced drainage swale at an existing school associated with a municipal site plan application.60

EX10.7 CITY OF TORONTO To construct, reconstruct, erect or place a building or structure, and temporarily or permanently place, dump or remove any material, originating on the site or elsewhere, on Jane Street south of Highway 401, as well as Falstaff Avenue, Fleetwood Avenue, Beckett Avenue and Maidstone Street, in the City of Toronto (Etobicoke York Community Council Area), Humber River Watershed, as located on property owned by the City of Toronto. The purpose is to replace segments of existing storm sewer. Works will involve removal and replacement of the existing storm sewers, as well as replacement of catch basins and watermain. No in-water works are within the scope of this project. 63

5 EX10.8 STANDARD DELEGATED PERMITS 65

Standard Permits are implemented by Planning and Development Division staff and are received monthly by the Executive Committee. Standard permits are subject to the authorization of designated staff appointed as Enforcement Officers, as per Authority Res.#A199/13. Standard permits are non-complex permissions consistent with TRCA approved policies and procedures and issued for a time period of two years or less.

RE: GREENLANDS ACQUISITION PROJECT FOR 2011-2015 Flood Plain and Conservation Component, Duffins Creek Watershed Tensilkote Limited (Pleasure Valley) CFN 32424 ______KEY ISSUE Acquisition of a partial taking from a property located to the east of Brock Road and south of Albright Road in the Township of Uxbridge, Regional Municipality of Durham under the Flood Plain and Conservation Component, Duffins Creek watershed.

RECOMMENDATION

THE EXECUTIVE COMMITTEE RECOMMENDS THAT 24.252 hectares (59.93 acres), more or less, of vacant lands, being Part of Lots 8 and 9, Concession 5, Township of Uxbridge, Regional Municipality of Durham, be purchased from Tensilkote Limited (Pleasure Valley);

THAT the purchase price be $646,388.00;

THAT Toronto and Region Conservation Authority (TRCA) enter into a lease for a term of up to 11 years for the paths and trails on the subject property, subject to Tensilkote Limited (Pleasure Valley) paying market rent for the term of the lease and terms and conditions satisfactory to TRCA staff and solicitors;

THAT acquisition by TRCA is conditional on the availability of all necessary funding;

THAT TRCA receive conveyance of the lands free from encumbrance, subject to existing service easements;

THAT Gardiner Roberts LLP, be instructed to complete the transaction and all reasonable expenses incurred incidental to the closing and for land transfer tax, legal costs, and disbursements are to be paid;

AND FURTHER THAT authorized TRCA officials be directed to take the necessary action to finalize the transaction including obtaining any necessary approvals and signing and execution of documents.

7 BACKGROUND Resolution #A94/10 at Authority Meeting #5/10, held on June 25, 2010, approved the Greenlands Acquisition Project for 2011-2015.

During the 1930's and 1940's, Robert McConnell assembled approximately 640 acres of land located to the south of Albright Road between Brock Road and the 6th Concession Road, in the Township of Uxbridge. In 1979, Robert McConnell leased approximately 330 acres to Pleasure Valley Recreational Inc.. Pleasure Valley Recreational Inc. provided recreational opportunities such as horseback riding and lessons, wall climbing, waterslide, picnics, mini golf, cross country skiing, catering facility and services.

In 2005, TRCA, through the acquisition of lands adjacent to the subject property from both Tensilkote Limited (Pleasure Valley) and the Estate of Robert Kendall McConnell, facilitated the purchase of approximately 104 acres (subject property) from the Estate of Robert Kendall McConnell by Tensilkote Limited (Pleasure Valley). As part of the transaction, TRCA entered into a lease arrangement with Tensilkote Limited (Pleasure Valley) for the paths and trails located on the lands acquired for a term of 20 years.

For the past number of years, TRCA staff has had discussions with representatives of Tensilkote Limited (Pleasure Valley) regarding various acquisition and lease scenarios relating to the subject lands. The proposed partial taking represents the majority of the natural features on the Tensilkote Limited (Pleasure Valley) lands and result in greater protection and enhancement of TRCA's land holdings in the immediate area. Tensilkote Limited (Pleasure Valley) will retain approximately 40 acres which includes two homes, one barn and associated equestrian infrastructure.

Negotiations have been conducted with Reine Schickedanz of RE/MAX All Star Realty Inc., acting as agent for Tensilkote Limited (Pleasure Valley) and Justin Mooney of Davis LLP, the seller’s solicitor. Attached is a plan showing the location of the subject lands.

RATIONALE The subject lands are located in the headwaters of the Duffins Creek. A majority of the lands are Provincially Significant Areas of Natural and Scientific Interest (ANSI) and also contain Provincially Significant Wetlands. The property is designated at Natural Core Area and Linkage area under the Oak Rides Moraine Conservation Plan.

TAXES AND MAINTENANCE Based on TRCA’s preliminary review of the criteria for lands that are eligible to receive a property tax exemption under the provincial Conservation Tax Incentive Programs, it would appear that all of the subject lands may be eligible for an exemption. Taxes for 2014 are estimated to be approximately $5,000. Furthermore, the addition of the subject parcel of land should not significantly impact TRCA's maintenance costs at this location.

8 FINANCIAL DETAILS There are a number of potential funding sources for this transaction. Regional Municipality of Durham will contribute up to 40% for eligible acquisitions and costs. The Ontario Heritage Trust, under the Natural Spaces and Land Acquisition and Stewardship Program, has agreed to contribute $123,500 to purchase the entire property and contribute toward eligible costs. Staff is in discussion with The Ontario Heritage Trust to determine the amount of funding they will contribute to a partial taking. The Green Durham Association has indicated that they may contribute to the purchase. Other funding for this acquisition may include TRCA land sale revenue.

RECOMMENDATION

THE EXECUTIVE COMMITTEE RECOMMENDS THAT WHEREAS Lorna Ann Milne wishes to donate 20.21 hectares (49.94 acres), more or less, of vacant ecologically sensitive lands;

AND WHEREAS The Living City Foundation will accept this donation and issue an income tax receipt to Lorna Ann Milne for the final appraised value, in accordance with the guidelines set out by Canada Customs and Revenue Agency and terms of reference as required by the Ecological Gifts Program;

AND WHEREAS donations of assets to The Living City Foundation in support of a Toronto and Region Conservation Authority (TRCA) managed project may be transferred to TRCA;

THEREFORE LET IT BE RESOLVED THAT TRCA accept title to the lands donated by Lorna Ann Milne to The Living City Foundation, situated to the east of Innis Lake Road and south of Old Church Road, said land being Part of Lot 19, Concession 2 ALBION, in the Town of Caledon, Regional Municipality of Peel;

THAT TRCA shall be responsible for appraisal, environmental audit and reasonable legal fees associated with completion of the transaction;

THAT TRCA extend their appreciation and thanks to Lorna Ann Milne for her generous donation;

THAT TRCA grant a conservation easement to the Oak Ridges Moraine Land Trust;

11 THAT TRCA receive conveyance of the land free from encumbrance, subject to existing service easements;

THAT the firm of Gardiner Roberts LLP, be instructed to complete the transaction at the earliest possible date. All reasonable expenses incurred, by both TRCA and The Living City Foundation, incidental to the closing for land transfer tax, legal costs and disbursements are to be paid;

AND FURTHER THAT authorized TRCA officials be directed to take the necessary action to finalize the transaction including obtaining any necessary approvals and signing and execution of documents.

The subject property is located on the east side of Innis Lake Road, south of Old Church Road, in the Town of Caledon. TRCA staff and The Living City Foundation staff have been approached by Mr. Ross Milne on behalf of Mrs. Lorna Ann Milne regarding the donation of 20.21 hectares (49.94 acres), more or less, of ecologically sensitive land which is located entirely within the Centreville Creek Area Environmentally Significant Area (ESA). A certificate confirming the ecological sensitivity of the land, as required under the Ecological Gifts Program, was received from Environment Canada on June 4, 2014.

Attached is a sketch showing the location of the subject lands.

RATIONALE The Milne property is located within the Centreville Creek Area ESA which consists of a large natural area with high biodiversity and is rich in rare flora / fauna species as well as rare vegetation communities. In addition, the subject land forms part of the Widgett-Innis Lakes Provincially Significant Wetland (PSW) Complex and the Innis-Gibson Lake Kettles which is classified as an Area of Natural and Scientific Interest (ANSI). The property is also situated within the Greenbelt Plan Area and is within the designated Natural Core Area of the Oak Ridges Moraine Conservation Plan.

The acquisition of the Milne property will ensure the long term protection of the ecologically sensitive attributes of the ESA / PSW / ANSI and protect the sensitive flora / faunal communities supported within the natural heritage features of the site. Furthermore, ownership of the Milne property will allow for more effective floodplain management as well as the long term ecological management / enhancement of the sensitive communities the site supports which are of limited representation within the TRCA watersheds.

TRCA staff and Oak Ridges Moraine Land Trust staff have conducted negotiations with Ross Milne representing the owner Lorne Ann Milne. As a result, Lorne Ann Milne has agreed to donate the subject property. The Oak Ridges Moraine Land Trust has requested a conservation easement in their favour registered on title.

12 DETAILS OF WORK TO BE DONE Certification and approval of an appraisal is to be obtained from Environment Canada in compliance with the Ecological Gifts Program.

TAXES AND MAINTENANCE Based on TRCA’s preliminary review of the environmental criteria for lands that are eligible to receive a property tax exemption under the provincial Conservation Land Tax Incentive Program and TRCA’s own field data, it would appear that the subject property would be eligible for a tax exemption. It is expected that the subject parcel of land will not significantly impact TRCA's maintenance costs since these types of lands require a low degree of maintenance.

RECOMMENDATION

THE EXECUTIVE COMMITTEE RECOMMENDS THAT 0.083 hectares (0.204 acres), more or less, of vacant land being Part of Lots 6, 7 and 8, Concession A, City of Toronto, located to the south of Albion Road and west of Islington Avenue, in the City of Toronto, be purchased from Bell Wall International Construction Ltd.;

THAT the purchase price be $2.00;

THAT Toronto and Region Conservation Authority (TRCA) receive conveyance of the lands free from encumbrance, subject to existing service easements;

THAT Gardiner Roberts LLP, be instructed to complete the transaction at the earliest possible date. All reasonable expenses incurred incidental to the closing for land transfer tax, legal costs, and disbursements are to be paid;

AND FURTHER THAT authorized TRCA officials be directed to take the necessary action to finalize the transaction including obtaining any necessary approvals and signing and execution of documents.

RATIONALE The subject property falls within TRCA's approved master plan for acquisition for the Humber River watershed as outlined in the approved Greenlands Acquisition Project for 2011-2015. Through the review of official plan and zoning by-law amendment application #112765401OZ, dated November 30, 2012, TRCA Planning and Development staff established the limits of the open space land which is situated partially within the Regional Storm Flood Plain and the valley corridor of the Humber River at this location.

TAXES AND MAINTENANCE Based on TRCA's preliminary review of the environmental criteria for lands that are eligible to receive a property tax exemption under the Provincial Land Tax Incentive Program, it would appear that all of the subject property may be eligible for exemption for the 2015 taxation year. The adjacent TRCA-owned parcels are already exempt as significant areas of natural heritage under the provisions of the Provincial Policy Statement as issued under the Planning Act . The addition of the subject parcel of land will not significantly impact TRCA's maintenance costs at this location.

RECOMMENDATION THE EXECUTIVE COMMITTEE RECOMMENDS THAT the settlement of compensation be completed for the expropriation from Vinen Atlantic S.A. of the following property interests required for the Mimico Waterfront Linear Park Phase 2: a) fee simple interest in, and riparian rights, if any, associated with Part of Lots 376 and 377, Registered Plan 164, designated as Part 1 on Expropriation Plan AT2615375, City of Toronto; b) fee simple interest in, and riparian rights, if any, associated with Part of Water Lots 4 and 5 patented to John Charles Horwood on August 30, 1910, CLS 55736, in front of Lot C, Broken Concession, designated as Part 1 on Expropriation Plan AT2615848, City of Toronto; c) fee simple interest in, and riparian rights, if any, associated with Part of Water Lot 6 patented to Thomas Norman Sampson on August 25, 1910, CLS 55735, in front of Lot 7, Registered Plan M-205, designated as Part 2 on Expropriation Plan AT2615848, City of Toronto; d) fee simple interest in, and riparian rights, if any, associated with Part of Water Lots 7 and 8 patented to William J. 1) compensation of $2,455,752 for market value of the lands expropriated, injurious affection to Vinen Atlantic S.A. remaining lands and any disturbance suffered by Vinen Atlantic S.A. less a payment of $1,255,752 was made by TRCA leaving an outstanding amount of $1,200,000 to be paid;

2) TRCA will pay Vinen Atlantic S.A. simple interest at 6% as required by the Expropriations Act on the outstanding balance of compensation from time to time;

3) TRCA will pay reasonable legal, appraisal and other costs of Vinen Atlantic S.A. in determining compensation;

4) Vinen Atlantic S.A. will transfer to TRCA, at no cost, the water lots lying to the southeast of the expropriated lands described as Parts 1, 2, and 3 on Expropriation Plan AT2615848;

THAT Vinen Atlantic S.A. provide TRCA with a full and complete release of all claims pursuant to the Expropriations Act;

THAT Chappell Bushell Stewart, Barristers and Solicitors be instructed to complete the transaction at the earliest possible date. All reasonable expenses incidental to completing the transaction are to be paid by TRCA;

THAT Toronto Waterfront Revitalization Corporation (TWRC) be advised of the settlement costs and all reasonable expenses paid for under the project budget as approved by TWRC;

AND FURTHER THAT authorized TRCA officials be directed to take the necessary action to finalize the transaction including obtaining any necessary approvals and the signing and execution of documents.

BACKGROUND At Authority Meeting #10/09, held on January 8, 2010, confidential Resolution #A237/09 was approved as follows:

THAT Toronto and Region Conservation Authority (TRCA) staff be authorized to proceed with the acquisition of all necessary property interests required to facilitate the completion of Phase 2 of the Mimico Waterfront Linear Park, in the City of Toronto, under the provisions of the Expropriations Act, R.S.O. 1990 and the Conservation Authorities Act, R.S.O. 1990;

THAT Chappell, Bushell, Stewart, Barristers and Solicitors, be engaged as legal council for the expropriation of these properties;

19 THAT the authorized Toronto and Region Conservation Authority officials be directed to take whatever action may be required to give effect thereto including the obtaining of necessary approvals and the signing and execution of any documents;

THAT proceeding with expropriation is conditional on receiving funding from Toronto Waterfront Revitalization Corporation (TWRC);

AND FURTHER THAT the Toronto Waterfront Revitalization Corporation be so advised by the CAO's Office.

The Mimico Waterfront Linear Park stretches from Humber Bay West Park in the east to Norris Crescent in the west along the Lake Ontario shoreline.

In November of 2003, TRCA signed a Delivery Agreement with TWRC for the Mimico Waterfront Linear Park project totalling $6.5 million. The Environmental Assessment for the Mimico Waterfront Linear Park was approved by the Minister of the Environment on August 12, 2004. On December 12, 2004 Human Resources and Skills Development Canada also approved the project under the Canadian Environmental Assessment Act .

Under the approved project, it was necessary to acquire either land, water lots or riparian rights from 13 private properties in this area for the project to proceed.

In early 2005, TRCA in consultation with TWRC determined that there would not be sufficient funding available in the project to complete the acquisition and construction of the entire project. The project was split into two phases. The first phase was from Superior Avenue to Norris Crescent and the second was from Humber Bay West Park to Superior Avenue. It was determined that there was sufficient funding in the project to complete the acquisition and construction of Phase 1 plus the acquisition of property rights from willing owners in Phase 2. At that time TRCA was able to complete the purchase of nine of the remaining private properties owned by eight different owners. This left four private properties owned by three different owners to be acquired for Phase 2. Construction of Phase 1 commenced in July of 2006 and was completed in 2008.

On April 9, 2009, TRCA entered into a Change Notice to the original Delivery Agreement with TWRC which increased the budget to $18.6 million to allow for the completion of Phase 2 of the Mimico Waterfront Linear Park.

An agreement was reached with one of the owners in Phase 2 in early 2010 leaving two owners that owned three properties. Notices of Application for Approval to Expropriate Land were served on these two owners in March of 2010. TRCA entered into an agreement pursuant to Section 30 of the Expropriations Act with one of the owners in 2010 to give TRCA possession of the property. This agreement was finalized in 2011.

20 Vinen Atlantic S.A. (Vinen) was the owner of the remaining two properties required for the project. The property interests required from Vinen included a one metre strip at the rear of 2309 and 2311 Lakeshore Boulevard West together with any interest they may have had in the Crown land southeast of this property and lands adjacent to the Lake Ontario shoreline together with the water lots at the rear of 2355, 2361 and 2369 Lakeshore Boulevard West. Vinen requested a Hearing of Necessity to determine if the proposed taking by TRCA was fair, sound and reasonably necessary in the achievement of TRCA's objective for the project. A Hearing of Necessity was held on August 5, 2010 and the hearing officer determined that proposed taking at the rear of 2309 and 2311 Lakeshore Boulevard West was fair, sound and reasonably necessary, however, the proposed taking at the rear of 2355, 2361 and 2369 Lakeshore Boulevard West would be reduced to only include that portion of the water lot that was required for the filling in connection with the project. Based on the decision of the hearing officer, TRCA registered the expropriation plans.

The matter of compensation was referred to the provincially appointed Board of Negotiation (BON) for mediation. The BON took into account several factors such as the location of the properties in an evolving area along the waterfront and the relative strength of Vinen's claim to have possessory title to the Crown land. The BON recommended that there should be an additional payment of $1.2 million, together with interest at 6% on the outstanding balance from time to time and payment of the owner's reasonable costs of determining compensation. BON also recommended that Vinen convey to TRCA the remainder of the water lots lying to the southeast of the expropriated lands.

TRCA staff has had discussions with TWRC and they are in agreement with the proposed settlement.

RATIONALE The subject property was required for the construction of Phase 2 of the Mimico Waterfront Linear Park.

TAXES AND MAINTENANCE This parcel of land has been turned over to the City of Toronto under the terms of the existing management agreement.

21 FINANCIAL DETAILS The amount of compensation for market value, injurious affection and any disturbance damage is $2,455,762 less the amount of $1,255,752 paid in accordance with Section 25 of the Expropriations Act leaving a balance outstanding of $1,200,000. The simple interest at 6% on the outstanding balance for time to time is estimated at $365,000 based on a completion date of October 31, 2014. Vinen's reasonable costs associated with determining market value is estimated at $250,000. Funds for the costs related to this settlement are available in the Mimico Waterfront Linear Park Project, through TWRC capital in account 205-15.

THAT staff be authorized to spend the project contingency amount of $70,000.00, if available, to complete additional dredging to the limit of available funding of $250,000.00 from the City of Toronto;

THAT should staff be unable to execute an acceptable contract with the awarded contractors, staff be authorized to enter into and conclude contract negotiations with the other contractors that submitted tenders, beginning with the next lowest bidder meeting TRCA specifications;

BACKGROUND In 1983, TRCA began dredging operations at the mouth of Coatsworth Cut to maintain navigation between Lake Ontario and the boating facilities located at Ashbridge’s Bay Park. As a result of ever increasing dredging volumes and associated expenses, TRCA began to investigate shoreline modification options that would eliminate the need for annual maintenance dredging in 1999.

24 Currently the long-term solution to the sedimentation problem in Coatsworth Cut is being addressed through a number of planning initiatives, however TRCA plans to continue with maintenance dredging until such time that the final solution is in place and sedimentation rates are confirmed to be declining in response. As of the date this communication was prepared, implementation of the preferred solution was expected to commence in 2015 pending receipt of the necessary approvals and funding, with work anticipating to take 4 - 6 years to complete.

Maintenance dredging at Coatsworth Cut was last completed in the summer of 2013 with the removal of approximately 3,000 cubic metres of material. The dredged material was tested and deemed to meet parkland quality guidelines for disposal at Tommy Thompson Park (TTP) for use in the construction of habitat projects within the park. TRCA performed an updated sounding survey of the channel in July 2014 which confirmed that approximately 2,500 cubic metres of sediment has deposited in the previously dredged portion of the channel since the last maintenance dredging was completed.

RATIONALE This project is aligned with leadership strategy number two in TRCA’s new strategic plan. Through improvements of the flow regime, this project will assist in the successful management of our regional water resources for current and future generations.

Ongoing deposition reduces available water depth in the channel, creating a hazard to boaters and limiting marine-based emergency access if not addressed. To reduce the risk of property damage and personal injury, TRCA proposes to dredge approximately 2,500 cubic metres of material based on the results of a recent hydrographic survey by staff, commencing the last week of September 2014 pending the receipt of all necessary approvals and execution of agreements.

Material is proposed to be removed using a combination of water and land based equipment for dredging and off site disposal to TTP for use in the construction of on site habitat projects as part of the master plan implementation.

As hydrographic surveys have shown that material deposits in the channel on a continual basis, and there is a delay between when the dredging volume is determined and the dredging work is performed, a $70,000 contingency allowance is recommended to complete additional dredging as required to meet the minimum channel depths required for safe navigation. It is also recommended that as the minimum depth for safe navigation is approached, staff review the total project costs to date, and any remaining funds held as contingency be released to fund the removal of additional material from the navigation channel.

Tender RSD14-112 was publicly advertised on the electronic procurement website Biddingo ( http://www.biddingo.com/) on Tuesday, July 22, 2014 with a mandatory site information meeting held on Wednesday August 6, 2014. Tender packages were sent to the following nine contractors:

Restoration Services staff reviewed the bids received and determined that the price discrepancy between the bids is a result of mobilization and demobilization costs. Catalina Excavating is currently working in the Toronto area and have a water-base mobilization set-up and therefore incur less costs than Ontario Construction Company Ltd. or Dragage Ocean DSM for mobilization and demobilization. Ontario Construction Company Ltd. use a land-base mobilization set-up and have to crane their equipment to site. Dragage Ocean DSM is based out of Quebec and is extremely high travel costs associated with their mobilization and demobilization.

Staff reviewed the bid received from Catalina Excavating Inc. against its own cost estimate and has determined that the bid is of reasonable value and also meets the requirements as outlined in the contract documents. Further assessment by TRCA staff of Catalina Excavating Inc.'s experience and ability to undertake similar projects was conducted through reference checks which resulted in positive feedback that Catalina Excavating Inc. is capable of undertaking the scope of work.

BACKGROUND In 1981 Bluffer’s Park opened at the foot of Brimley Road as a waterfront park in the City of Toronto. Included within the park is a commercial marina as well as four boating clubs which access Lake Ontario by way of the entrance channel.

In early 2008, concerns of insufficient water depths in the entrance channel were brought to TRCA’s attention by members of the boating clubs. TRCA notified the City of Toronto (Parks, Forestry & Recreation) of the hazard, who in turn retained TRCA to undertake maintenance dredging later that summer. Upon completion of the 2008 dredging project, approximately 1,700 cubic metres of sediment was removed from the entrance channel; a relatively minor amount compared to the more than 70,000 cubic metres of sediment which is estimated to have accumulated over the more than 30 years since the entrance channel was constructed. Recognizing that the maintenance work restored only the minimum depth required for safe passage through the channel, with no allowance provided for ongoing siltation, it was communicated by TRCA staff to the City of Toronto that future maintenance dredging would likely be required.

28 In 2010, insufficient water depths in the entrance channel were again brought to TRCA’s attention. In response, TRCA completed a hydrographic survey of the entrance channel in April 2010 to provide updated information to the City of Toronto and determine the appropriate course of action. The survey showed that a large sand bar formed laterally across the entrance channel, reducing water depths to approximately 1.5 m and creating a risk to the members of the boating community who require a minimum draft of 1.8 m below chart datum for safe passage. As a result of shallow water in the entrance channel, a member of the Cathedral Bluffs Yacht Club got stranded on the sand bar on the evening of April 26, 2010, requiring rescue. Although no injuries were reported, it is noted that the draft on the stranded boat was 1.4 m.

Emergency dredging was completed within the entrance channel in June 2010, allowing for approximately 3,500 cubic metres of sediment to be removed. Unfortunately, a sounding completed by TRCA on May 9, 2011 revealed that more than 2/3 of the volume removed eleven months earlier had re-accumulated.

Ongoing deposition reduces available water depth in the channel, creating a hazard to boaters and limiting marine-based emergency access if not addressed. To reduce the risk of property damage and personal injury, TRCA proposes to dredge approximately 9,000 cubic metres of material based on the results of a recent hydrographic survey by staff.

RATIONALE This project is aligned with leadership strategy number two in TRCA’s new strategic plan. Through improvements of the flow regime, this project will assist in the successful management of our regional water resources for current and future generations.

As it is standard practice to include a healthy contingency in project estimation in the event of unforeseen events, $98,682.50 has been set aside as the project contingency. However as the City of Toronto has directed TRCA to remove as much sediment as possible with the available budget, it is recommended that the progress of the work be closely monitored, and that any remaining funds held as contingency be released to fund the removal of additional material from the entrance channel.

Sediment samples were collected from the channel on July, 2014 and sent for laboratory analysis to determine disposal options for the dredgeate. Based on the results of these analyses, the sediment meets Ministry of the Environment’s Table 1 background data, meaning that the material meets unconfined disposal guidelines. Given that on-site disposal is the most cost-effective solution and site disturbance is expected to be minimal, permanent disposal of the dredgeate is to be placed in the west park area of Bluffer's Park where Parks, Forestry & Recreation staff has identified a need for clean sand for restoration activities.

Dredging works is tentatively scheduled to commence the first week of October, 2014 pending authorization to award Contract RSD14-123 and the receipt of all necessary approvals. Work is anticipated to take approximately four weeks to complete, weather permitting.

RECOMMENDATION

THAT EXECUTIVE COMMITTEE RECOMMENDS THAT WHEREAS Toronto and Region Conservation Authority (TRCA) is the owner of Part of Lot 12, Concession VI and Lot 247, Registered Plan 1842, City of Toronto;

AND WHEREAS the subject lands have been previously turned over to the City of Toronto for management purposes, in accordance with the terms of an agreement dated June 14, 1961;

THEREFORE LET IT BE RESOLVED THAT TRCA concur with the City of Toronto renewing the installation agreement with the Greater Toronto Airports Authority (GTAA) for a term of three years commencing January 1, 2015, be approved;

AND FURTHER THAT the authorized TRCA officials be directed to take the necessary action to finalize the transaction including obtaining any necessary approvals and signing and execution of documents.

BACKGROUND On February 15, 1979 TRCA, with the agreement of The Municipality of Metropolitan Toronto (now the City of Toronto), entered into an agreement with the Ministry of Transport, representing Her Majesty the Queen in Right of Canada (now the Greater Toronto Airports Authority), authorizing Transport Canada (now the Greater Toronto Airports Authority) to install a pole-mounted monitoring facility to record aircraft noise on TRCA-owned lands on Acacia Avenue, City of Toronto.

The agreement was continuously renewed by TRCA until March 31, 1994. TRCA then turned over to City of Toronto the yearly administration of the licence, and since April 1, 1994, City of Toronto has been responsible for its management.

32 The current licence is for a term of five years, which will expire December 31, 2014 and included an annual licence fee of $500.00 for Year 1, $515.00 for Year 2, $530.00 for Year 3, $546.00 for Year 4 and $563.00 for Year 5, net, plus all applicable taxes and costs related to the licensed area. Either party has the right to terminate the licence at any time upon giving at least 90 days prior written notice to the other.

A sketch illustrating the TRCA-owned land effected is outlined in Attachment 1.

FINANCIAL DETAILS In accordance with the terms and conditions of the management agreement, no revenue or expenses will be incurred in this instance by TRCA. The licence fee for the three year period will be $590 for Year 1, $620 for Year 2 and $650 for Year 3, plus applicable taxes. The City of Toronto staff has advised that this proposal is satisfactory to the City, which will receive the revenues generated.

ON M3N 1S4 To the members of the TRCA Executive Committee, We would like to request to purchase a portion of TRCA land located adjacent to our property at 53 Timber Valley Avenue in Richmond Hill. Two files are attached; the first shows the property map and the second shows the portion we would like to purchase outlined in black. As can be seen in the images, the fence that has been erected on the property lies directly underneath my deck, and the deck can be easily accessed with the aid of the fence. One can easily obtain access into the house if they climb the short fence and get onto our deck. I have tolerated this arrangement for several years, but there has been a recent break-and-enter crime on our street and I am scared for our children, especially our youngest one Fazel who is only 6. The fence we hope to erect on the new property line will be in accordance with all bylaw requirements, and would deter anybody from attempting to climb onto our deck and compromising our security in our home. BACKGROUND This request is being brought to the attention of the Executive Committee in accordance with Resolution #26, adopted by TRCA at Authority Meeting #1/91, held on February 22, 1991.

A written request has been received from Mr. Philip Ling, as well as a verbal request from Mr. Rick Sutherland, who are interested in purchasing the subject TRCA-owned property located at 17 Mill Street in the City of Markham, Regional Municipality of York.

A copy of the letter from Mr. Philip Ling is included as Attachment 1.

The subject TRCA-owned lands are situated within the Regulated Area and Regional Storm flood plain of the Rouge River valley corridor at this location.

39 In accordance with TRCA policy, TRCA Property staff will circulate this request for disposal to TRCA technical staff as well as City of Markham and Regional Municipality of York staff for review and comment. Staff will report to the Executive Committee on the comments received and make a recommendation to either retain the property or declare it surplus. The proponent is advised of the results of the review at the time a report is prepared for the Executive Committee. The proponent has the opportunity to make a request to delegate at the Executive Committee at the time the matter is being considered.

THAT Contract #10000028 for Albion Hills Conservation Area House on Hill Washroom Upgrades be awarded to MIR Construction Inc. at a total cost not to exceed $96,000.00, plus 20% contingency to be expended as authorized by Toronto and Region Conservation Authority (TRCA) staff, plus HST, it being the lowest bid meeting TRCA specifications;

THAT the contract be subject to terms and conditions satisfactory to TRCA staff and, if necessary, solicitor;

THAT should staff be unable to negotiate a mutually acceptable tender agreement with the above-mentioned contractor, staff be authorized to enter into contract negotiations with other contractors, beginning with the next lowest bidder meeting TRCA specifications;

AND FURTHER THAT authorized TRCA officials be directed to take the necessary action to implement the contract including the signing and execution of documents.

BACKGROUND Albion Hills Conservation Area (AHCA) House on Hill (HOH) washrooms building requires significant upgrades and repairs in order to accommodate campers and day use visitors. The current condition of the building is in significant disrepair and does not meet client expectations. Over the past several months staff worked closely with Markham High Tech Architects to prepare and refine detailed design and construction drawings required to move forward with the construction phase and Request for Quotation (RFQ) documentation. Key upgrades include:

 accessible site grading, unit paving and replacement of existing concrete entry pad installation;  new epoxy flooring and wall tiles;  new accessible fixtures including sinks, toilets, partitions and showers;  painting of walls and ceilings;

43  new doors and frames to ensure fully accessible entrance to the building;  mechanical and electrical upgrades;  plumbing upgrades.

RATIONALE This project is aligned with leadership strategy number three - Rethink Greenspace to Maximize it's Value in TRCA’s new strategic plan. Through improvements to TRCA's public infrastructure, this project will help more people engage in nature more often.

Request for Quotation (RFQ) #10000028 for the Albion Hill Conservation Area House on Hill Washroom Upgrades was publically advertised on July 18, 2014 and the following 12 firms attended a mandatory site meeting:  MIR Construction Inc.;  GTA General Contractors;  United Contracting Inc.;  Ruscan Construction;  C.L. Proposal: The purpose is to construct a detached garage with storage loft space within a Regulated Area of the Rouge River watershed. The subject property is located entirely within the Regional Storm Flood Plain and within the Unionville Special Policy Area.

In accordance with TRCA's Valley and Stream Corridor Management Program, the proposed building has been adequately floodproofed to the 350-year storm flood elevation of 172.32 m.a.s.l. plus a 0.3 metre freeboard. The applicant has confirmed that the proposal does not involve the creation of additional habitable space and is intended as an ancillary structure. The proposed works are located within a generally flat, manicured rear yard. No significant vegetation removals are required as part of this project.

47 Control of Flooding: TRCA water resources engineering staff are satisfied that the proposal has nominal impact on the storage and conveyance of flood waters.

Pollution: There are no sediment transport issue associated with this application.

Dynamic Beaches: Not applicable.

49 Proposal: The purpose of this application is to undertake works within TRCA's Regulated Area of the Mimico Creek Watershed in order to facilitate the construction of a 139.16 sq. m (1,498 sq. ft.) replacement residential dwelling and a 75 sq. m (808 sq. ft.) garage associated within a municipal building permit application. The subject property is located at 6996 Justine Drive, west of Goreway Drive, and north of Derry Road East, in the City of Mississauga. TRCA's Valley and Steam Corridor Management Program (VSCMP) allows for the replacement dwelling within the floodplain. However, the new dwelling must meet specific requirements and standards. Although the proposed dwelling and garage are located within the Regional Storm Floodplain, it will be floodproofed in accordance with TRCA's floodproofing requirements. TRCA Water Resource Engineering staff are satisfied that the proposed dwelling and garage will not significant impact the conveyance and/or storage of flood waters. As well, the total area of the proposed dwelling will not exceed 50% of the existing dwelling. Additionally, there are no ecological or geotechnical concerns associated with this application. Therefore, TRCA staff is satisfied that the replacement dwelling meets our policies

Control of Flooding: The proposed works are located within the Regional Floodplain. However, TRCA Water Resource staff has reviewed the proposal and anticipate that the proposed works will not have any significant impacts to the storage and/or conveyance of flood waters.

Pollution: Appropriate erosion and sediment control (i.e., silt fence) have been proposed with this application, and will be maintained throughout all phases of construction.

52 RATIONALE The application was reviewed by staff on the basis of the following information:

Proposal: The City of Toronto is proposing storm sewer, watermain and roadway improvements in the area of Yonge Street and York Mills Road on Donwoods Drive, Ivor Road, and Campbell Crescent. This project is part of the City's ongoing Hoggs Hollow road and stormwater management improvements program. These works were previously identified in a municipal class environmental assessment that the City completed in 2005. Works will involve installation of new storm sewers and catch basins within the roadway on Donwoods Drive and Ivor Road. These new storm sewers will connect to sewers at the east end of Donwoods Drive, completed under a prior phase of this project. Works will also involve installation of replacement storm sewers and catch basins on Campbell Crescent between Old York Mills Road and Old Yonge Street. The replacement works on Campbell Crescent will include reconstruction of an existing outfall structure discharging into the West Don River in York Mills Park, which will involve new headwall and armour stone treatments.

As with the prior phases of these works, a staging area will be located at the southwest corner of Mill Street and Donino Avenue, isolated with silt fencing and mud mats for erosion and sediment control. Silt fencing will also be used to isolate the works in York Mills Park, while a coffer dam is to be employed for the reconstruction of the outfall to isolate the work area from the watercourse. Once all storm sewer and water service improvements have been carried out, disturbed roadways will be laid with new asphalt and concrete curb and gutter. There are several vegetation removals associated with this project, which will be compensated through the planting of native trees and shrubs around the reconstructed outfall. Construction is anticipated to occur in 2015.

Control of Flooding: The proposed works are not anticipated to impact flooding, flood storage or conveyance of flood waters. The proposed works will improve the existing storm runoff conditions in this area. All grades will be maintained or matched.

Pollution: Erosion and sediment control measures (silt fence, coffer dam) will be installed prior to construction and maintained for its duration. These measures are being implemented to prevent the release of construction generated sediment into the West Don River. Erosion and sediment control measures have been provided in accordance with the TRCA Erosion and Sediment Control Guideline for Urban Construction (2006).

Dynamic Beaches: The proposal will not have any implications to dynamic beaches.

Erosion: There are no impacts identified to slope stability or erosion as a result of these works.

53 Conservation of Land: Through review of the information provided and identified in the summary of plans section, TRCA is of the opinion that the project and implementation as proposed will not cause serious harm to fish. The Ministry of Natural Resources warm water fisheries timing window will apply to this proposal, unless otherwise specified in writing by MNR.

Plantings There are several vegetation removals associated with this project, which will be compensated through the planting of native trees and shrubs, ensuring all disturbed areas are restored to pre-construction conditions, or better, upon completion of works.

Policy Guidelines: This proposal complies with Section 4.3, Infrastructure and Servicing, of the TRCA’s Valley and Stream Corridor Management Program.

55 RATIONALE The application was reviewed by staff on the basis of the following information:

Proposal: The City of Toronto is proposing to undertake channel restoration works in Firvalley Woods, located on the west side of Warden Avenue, south of St. Clair Avenue East. These works are being necessitated to protect an exposed sanitary sewer maintenance chamber and three storm sewer outfalls from channel erosion issues. Works will involve reconstruction of the banks, construction of riffles and pools, and installation of an armour stone treatment. The armour stone walls will tie into three riffle structures that shall be created within the channel, extending from the wing walls of an existing single, 2100mm diameter storm sewer outfall, 20m on its west side and 30m on its east side. The wall will vary between 1.5m and 3.75m in height. The concrete apron on this upstream, single outfall structure will be reinforced with additional armour stone. The area behind the wall will be backfilled with clear stone, finished with coir matting on topsoil. Additional armour stone will surround the exposed sanitary sewer chamber on the east channel banks. Downstream from this area, the failing banks behind a twin storm sewer outfall will be reconstructed using non-shrink fill, with a vegetated rip rap treatment on both sides of the watercourse. Watercourse flows are to be bypass pumped around the work area with temporary culverts in place for access above. All construction is to occur in the dry.

Access shall be obtained directly from the west side of Warden Avenue, opposite Bell Estate Road, along a previously used but unmaintained access route. An additional access route will be along trails connecting to St. Clair Avenue East through Warden Woods Park. All staging will occur within the access routes. Silt fencing is to be established on either side of the Warden Avenue access route, along with erosion control matting and straw. There are several tree removals associated with this project, which are to be compensated in accordance with City of Toronto Urban Forestry standards. Construction will occur in summer 2014.

This application seeks to formalize works that have already been approved through the emergency works process. These works were classified as emergency works because the erosion issues and exposed sewer infrastructure in Firvalley Woods presented an immediate hazard to public safety, and as such, represents a threat of injury to persons, loss of life, or loss of property (Conservation Authorities Act ).

Control of Flooding: The proposed works are not anticipated to impact flooding, flood storage or conveyance of flood waters. All grades will be maintained or matched.

Pollution: Erosion and sediment control measures (silt fence) will be installed prior to construction and maintained for its duration. These measures are being implemented to prevent the release of construction generated sediment into Taylor Massey Creek, a tributary of the East Don River. Erosion and sediment control measures have been provided in accordance with the TRCA Erosion and Sediment Control Guideline for Urban Construction (2006).

56 Dynamic Beaches: The proposal will not have any implications to dynamic beaches.

Erosion: There are no impacts identified to slope stability or erosion as a result of these works.

Conservation of Land: Through review of the information provided and identified in the summary of plans section, TRCA is of the opinion that the project and implementation as proposed will not cause serious harm to fish. The Ministry of Natural Resources warm water fisheries timing window will apply to this proposal, unless otherwise specified in writing by MNR.

Plantings There are several tree removals associated with this project, which are to be compensated through the planting of native trees and shrubs, ensuring all disturbed areas are restored to pre-construction conditions, or better, upon completion of works.

Policy Guidelines: This proposal complies with Section 4.3, Infrastructure and Servicing, of the TRCA’s Valley and Stream Corridor Management Program.

RATIONALE The application was reviewed by staff on the basis of the following information:

58 Proposal: The purpose is to construct a mid-rise condominium building and associated infrastructure and grading works within a Regulated Area of the Don River watershed. The subject property is currently occupied by a commercial plaza and a single detached dwelling. The property is located within a highly urbanized area and are devoid of any significant vegetation. Based upon our mapping, a drainage feature which is subject to flooding is located on the subject property. The drainage feature had been captured as part of the TRCA's Fill Extension program and was eventually incorporated into our mapping for Ontario Regulation 166/06 in 2006. However, the extent of the Regional Storm Flood Plain had not yet been determined at the time of adoption. Based upon site visits conducted by TRCA staff, the drainage feature crosses a portion of the subject property along the property line and flows into a storm sewer inlet. This storm sewer empties into a larger storm sewer 70 metres downstream which ultimately discharges to the East Don River.

As confirmed by City of Vaughan Planning Staff, TRCA had not been circulated on the Official Plan Amendment (application no. OP.05.004) and Zoning By-law Amendment (application no. Z.05.011) applications for the subject property when they were submitted to the City in 2005. At the time, the subject property was not located within a Fill Regulated Area under Ontario Regulation 158 but as noted above had been identified as part of TRCA's Fill Extension program.

TRCA staff were notified that the Official Plan and Zoning By-law Amendments were being appealed by the applicant at the Ontario Municipal Board in early 2008. It was at this time that TRCA staff became aware of the project and began to review the application. However, the extent of the flood plain for this area was unknown. Subsequently, TRCA staff requested that a flood study be prepared to determine the extent of the flood plain and the overall feasibility of the proposal.

Based upon a Flood Study prepared by MMM Group Limited dated December 2008, a large portion of the subject property is subject to flooding. In order to allow for development, the applicant proposed new stormwater management infrastructure to manage the flooding issue. The works proposed as part of this permit will substantially reduce the extent of the flood plain for the subject property and a number of the surrounding properties through the installation of a larger by-pass storm sewer with a lower invert. The new storm sewer will provide greater hydraulic capacity and conveyance.

The proposed condominium and parking garage entrance are setback 10 metres from the revised flood plain. In order to achieve a net ecological gain for the subject property, the drainage feature will be kept open to the furthest extent possible and has been enhanced with native, non-invasive plantings. A planting plan for this drainage feature has been included as part of this permit.

Please note that TRCA previously issued a permit under Ontario Regulation 166/06 for these works (Permit No. C-110756, issued September 9, 2011). The previous permit has since expired and it is TRCA's staff understanding that the proposed works are ongoing and the applicant was required to obtain a new permit to continue development on the subject property.

59 Control of Flooding: TRCA water resources staff are satisfied that the proposed works will reduce the flood plain on the subject property and surrounding properties without any upstream or downstream impacts.

Pollution: Sediment control measures will be implemented to prevent the transport of sediment into the existing storm sewer system.

Dynamic Beaches: Not applicable.

Erosion: There are no geotechnical issues associated with this application.

Conservation of Land: As a watercourse will not be impacted by the proposal, no fisheries concerns will result. There are no other significant natural features on or adjacent to the site that may be negatively impacted by the project.

Plantings A planting plan consisting of native, non-invasive plantings will enhance the drainage feature resulting in a net ecological gain for the subject property.

Policy Guidelines: The proposal is consistent with Section 4.2 - Existing Development - of TRCA's Valley and Stream Corridor Management Program

The subject property is located on the east side of Naylon Street, south of Major Mackenzie Drive West and west of Keele Street, in the City of Vaughan. The proposed works are partially located within the floodplain of a tributary of the West Don River. TRCA Water Resource Engineering staff are satisfied that the storage and/or conveyance of the flood waters will not be adversely affected and the proposed works do not result in an increase in risk to life or property. Additionally, the area where development is proposed does not contain any significant natural features. There are no geotechnical or ecology related concerns related to this development.

Control of Flooding: The proposed works are located within the Regional Storm Floodplain. However, TRCA Water Resources staff has confirmed that the proposal will not have a significant impacts to the storage and/or conveyance of flood waters.

Pollution: Appropriate erosion and sediment controls have been proposed with this application, and will be maintained throughout all phases of construction.

Dynamic Beaches: Not applicable

Erosion: There are no geotechnical and/or slope stability concerns with this project.

Conservation of Land: No significant vegetation will be removed as a result of this project.

Proposal: The City of Toronto is proposing upgrades to the existing storm sewer system in the area of Jane Street, south of Highway 401. This project is part of the City’s ongoing Basement Flooding Protection Program. Works will involve replacing various segments of concrete storm sewer with new larger storm sewer, as well as relocation of catch basins and replacement of watermains on Jane Street south of Highway 401, as well as Falstaff Avenue, Fleetwood Avenue, Beckett Avenue and Maidstone Street. A guide rail will also be replaced on the more northerly bridge carrying Jane Street over Black Creek. Silt fencing is to be employed to isolate the guide rail replacement from the watercourse, while the catch basins will be outfitted with silt sacks. There are several street tree removals associated with this project, which are to be replaced with new tree plantings at the completion of works. Other disturbed areas will be restored with topsoil and sod. Construction is anticipated to begin in fall 2014.
