I am very sorry for our delay in providing our reply to you. This was due to staff resources and the need to redact some of the information provided.

I am writing in respect of your recent request for information from County Council, which has been dealt with under the provisions of the Freedom of Information Act 2000.

I can confirm that we do hold the information that you are seeking and we are able to provide most of it to you. Please note that at this stage we are providing you with a part reply.

Our reply

Please see attached requested information pertaining to the sale of the West Somerset Railway Freehold.

There will be some more files due to come to you, but there will be a delay in doing so. I am also away from the office for two weeks, and I have tasked my colleague to see if she can help, however it is likely that this may have to await my return, and I am very sorry that this will cause further delays.

Please note that where we have redacted information we judge this information to be exempt under section 40 of the Freedom of Information Act.

Section 40 (2) (3)(a)(i)); Personal Information states that any information to which a request for information relates is also exempt information if—

(a) it constitutes personal data which do not fall within subsection (1), and

(b) either the first or the second condition below is satisfied.

(3) The first condition is—

(a) in a case where the information falls within any of paragraphs (a) to (d) of the definition of “data” in section 1(1) of the Data Protection Act 1998, that the disclosure of the information to a member of the public otherwise than under this Act would contravene—

(i) any of the data protection principles.
