Welling* The federal crime of gratuities prohibits people from giving gifts to federal public officials if the gift is tied to an official act. Both the donor and the donee are liable. The gratuities crime is dysfunctional in two main ways. It is overinclusive in that it covers conduct indistinguishable from bribery. It is underinclusive in that it does not cover conduct that is clearly dangerous: gifts to public officials because of their positions that are not tied to a particular official act. This Article argues that Congress should extend the crime of gratuities to cover gifts because of an official’s position rather than leaving the crime to cover only gifts because of particular official acts. -

View metadata, citation and similar papers at core.ac.uk brought to you by CORE provided by St Andrews Research Repository 1 The Carolingian Past in Post-Carolingian Europe Simon MacLean On 28 January 893, a 13-year-old known to posterity as Charles III “the Simple” (or “Straightforward”) was crowned king of West Francia at the great cathedral of Rheims. Charles was a great-great-grandson in the direct male line of the emperor Charlemagne andclung tightly to his Carolingian heritage throughout his life.1 Indeed, 28 January was chosen for the coronation precisely because it was the anniversary of his great ancestor’s death in 814. However, the coronation, for all its pointed symbolism, was not a simple continuation of his family’s long-standing hegemony – it was an act of rebellion. Five years earlier, in 888, a dearth of viable successors to the emperor Charles the Fat had shattered the monopoly on royal authority which the Carolingian dynasty had claimed since 751. The succession crisis resolved itself via the appearance in all of the Frankish kingdoms of kings from outside the family’s male line (and in some cases from outside the family altogether) including, in West Francia, the erstwhile count of Paris Odo – and while Charles’s family would again hold royal status for a substantial part of the tenth century, in the long run it was Odo’s, the Capetians, which prevailed. Charles the Simple, then, was a man displaced in time: a Carolingian marooned in a post-Carolingian political world where belonging to the dynasty of Charlemagne had lost its hegemonic significance , however loudly it was proclaimed.2 His dilemma represents a peculiar syndrome of the tenth century and stands as a symbol for the theme of this article, which asks how members of the tenth-century ruling class perceived their relationship to the Carolingian past. -

Eos C 2013 / fasciculus extra ordinem editus electronicus ISSN 0012-7825 RESETTLEMENT INTO ROMAN TERRITORY ACROSS THE RHINE AND THE DANUBE UNDER THE EARLY EMPIRE (TO THE MARCOMANNIC WARS)* By LESZEK MROZEWICZ The purpose of this paper is to investigate the resettling of tribes from across the Rhine and the Danube onto their Roman side as part of the Roman limes policy, an important factor making the frontier easier to defend and one way of treating the population settled in the vicinity of the Empire’s borders. The temporal framework set in the title follows from both the state of preser- vation of sources attesting resettling operations as regards the first two hundred years of the Empire, the turn of the eras and the time of the Marcomannic Wars, and from the stark difference in the nature of those resettlements between the times of the Julio-Claudian emperors on the one hand, and of Marcus Aurelius on the other. Such, too, is the thesis of the article: that the resettlements of the period of the Marcomannic Wars were a sign heralding the resettlements that would come in late antiquity1, forced by peoples pressing against the river line, and eventu- ally taking place completely out of Rome’s control. Under the Julio-Claudian dynasty, on the other hand, the Romans were in total control of the situation and transferring whole tribes into the territory of the Empire was symptomatic of their active border policies. We find is interesting to research why TV 2 decided to do this and further, how they did it. In addition to this, we want to see how the Danish consumers interact with this message and, given the large international response to the campaign and its message, we also want to investigate the international viewers' perception of the campaign. We want to give a special thanks to the 12 respondents and to Vicky Wassman Dahi who participated in our data collection and contributed with interesting and essential meanings and insights to our research. John Darby and the Whig Canon
JOHN DARBY AND THE WHIG CANON I A celebrated series of books by the English commonwealthmen of the seventeenth century was published between 1698 and 1700. The series included major editions of works by John Milton, Algernon Sidney, and James Harrington, and the civil war memoirs of Edmund Ludlow, Denzil Holles, John Berkeley, and Thomas Fairfax. Collectively these texts have become known as the ‘whig canon’.1 Over the following century this set of writings would profoundly shape the development of republican thought on both sides of the Atlantic.2 The texts of the whig canon would be cited approvingly by thinkers as diverse as Bolingbroke and the founding fathers of the American constitution.3 At their original moment of publication, however, the series was designed to bolster opposition to the consolidation of power by the court whigs under William III. By reasserting ‘true whig’ principles against the corruption of the apostates who made their peace with the court, these historic works were made to chime with the political challenges faced by the opposition in the present moment: attacking the maintenance of standing armies by the state, inveighing against priestcraft, and asserting the primacy of the ancient constitution. 1 Caroline Robbins, The eighteenth-century commonwealthman (Cambridge, MA, 1959), p. 32. 2 J. Rowe, Department of Greek and Roman Studies Departmental Member During the last stages of the Marcommani Wars in the late second century A.D., Roman literary sources recorded that the Roman emperor Marcus Aurelius was planning to annex the Germanic territory of the Marcomannic and Quadic tribes. This work will propose that Marcus Aurelius was going to create a province called Marcomannia. The thesis will be supported by archaeological data originating from excavations in the Roman installation at Mušov, Moravia, Czech Republic.
