Jurnal Daulat Hukum Reconstruction of Life Imprisonment in Prison... Volume 2 Issue 4, December 2019 (Boma Wira Gumilar) ISSN: 2614-560X Reconstruction of Life Imprisonment in Prison System in Indonesia Boma Wira Gumilar1, Gunarto2 and Akhmad Khisni3 Abstract. The most important part in a Book of Criminal Law (Penal Code) is a prison, because the prison contains rules about the size and implementation of the criminal. The position of life imprisonment in the national criminal justice system is still considered relevant as a means of crime prevention, it can be seen from the number of offenses punishable with life imprisonment. However, life imprisonment is considered contrary to the penal system. This study aims to investigate the implementation of life imprisonment, weaknesses, and the solution in the future. The approach used in the study is a non-doctrinal legal research with socio-legal research types (Juridical Sociological). The results of research studies show that life imprisonment is contrary to prison system, and life imprisonment become an obstacle to fostering convicts back into society. Bill Criminal Code of September 2019 can be used as a solution to life imprisonment change in the future. Presented advice, in order to be disseminated to the application of the criminal purpose of the Criminal Code of Prison adopted in the future, so that the public and experts no longer make the criminal as a form of retaliation. Keywords: Reconstruction; Crime; Prison; Life Imprisonment; System; Corrections. 1. Confiscation vs Return of Property of Religious Minorities in Pakistan, India, and Bangladesh Shivani Patel POL 390-02: The Politics of Social Inclusion Policy December 10, 2020 Patel 1 Introduction The property acts in Pakistan, India, and Bangladesh are one of the numerous discriminatory policies in South Asia that deepen the decades-long religious conflict between Hindus and Muslims. These policies were passed and implemented in response to the India-Pakistan war in 1965, which set off the migration of religious minorities between each country, while the governments amassed all of the left behind property. These are Pakistan’s Enemy Property Act of 1965, India’s Enemy Property Act of 1968, and Bangladesh’s Vested Property Act of 1971. In contrast to the two other countries, Bangladesh repealed its policy to the Vested Property Return Act of 2001 and the Vested Property Return (Amendment) Act of 2011, which returned the confiscated property of indu migrants. Bangladesh’s repealment of the Vested Property Act is the variation in this research, as it is the only country in the region that is moving to alleviate the religious discrmination in the country. The puzzling outcome is that Bangladesh and Pakistan, which should have turned out similarly, do not maintain the same policy, whereas India and Pakistan, which are warring countries, end with the same outcome of upholding their property acts. Considering the variation in these policies, I ask: why did Bangladesh repeal its Vested Property Act, while India and Pakistan upheld their original Enemy Property Acts? My research illustrates that the degree of ethnic nationalism in a country determines the repealment of the property acts.

  • Pakistan 2018 International Religious Freedom Report
PAKISTAN 2018 INTERNATIONAL RELIGIOUS FREEDOM REPORT Executive Summary The constitution establishes Islam as the state religion and requires all provisions of the law to be consistent with Islam. The constitution also states, “subject to law, public order, and morality, every citizen shall have the right to profess, practice, and propagate his religion.” It also states “a person of the Qadiani group or the Lahori group (who call themselves Ahmadis), is a non-Muslim.” The courts continued to enforce blasphemy laws, punishment for which ranges from life in prison to execution for a range of charges, including “defiling the Prophet Muhammad.” According to civil society reports, there were at least 77 individuals imprisoned on blasphemy charges, at least 28 of whom had received death sentences, although the government has never executed anyone specifically for blasphemy. Some of these cases began before the beginning of the year but were not previously widely known. According to data provided by nongovernmental organizations (NGOs), police registered at least seven new blasphemy cases against seven individuals. On October 31, the Supreme Court acquitted Asia Bibi, a Christian woman sentenced to death for blasphemy in 2010. In what was described as an effort to end widespread violent protests orchestrated by the antiblasphemy movement Tehreek-e-Labaik Pakistan (TLP) against the government in the wake of Bibi’s acquittal, the government promised protestors it would not oppose a petition seeking further judicial review of the case. Following violent antistate threats, the government later undertook a sustained campaign of detentions and legal charges against the TLP leadership and violent protestors.

CHAPTER ONE INTRODUCTION 1.1 Background of the study A statistic shows that 1in 10 rape cases is experienced by men according to the Bureau of Justice Statistics in 2013. However, that is only the reported case. The reason behind the least number of reported rape cases happens due to the heavily stigmatized these cases are. The male - on- male rape case is seen as a taboo case and has a negative connotation among heterosexual and homosexual men. Moreover, the victims of rape cases have to deal with the community and service provider's allegations toward the victims’ sexual orientation and the gender of their perpetrators (Deborah, 2014). Melhado (2010) stated that during the civil war in Congo, male refugees that flee to Uganda were reported of getting raped by men and were accused of being weak when they reported the case. Moreover, in Northern Uganda, there have been rape cases happened to men by rebel groups against the government forces. During these conflicts, civilian men have often been attacked, kidnapped, raped, and forced to fight for the rebel groups. Another problem of male- on- male rape cases that make the victims afraid of reporting their cases are because of the Universitas Teknokrat Indonesia 2 myths regarding male victims of rape. Society believes that male should not be vulnerable, always wants sex, are less traumatized than women, and afraid of being called gay (Lynda, et al, 1993). At the beginning of 2020, Reynhard Sinaga to be famous after he did rape and sexual violence in which many victims of Reynhard Sinaga.
