As you are aware, former Secretary of State Hillary Clinton used a private email system during her tenure to conduct official government business. That conduct violated federal recordkeeping guidelines and regulations established under the Federal Records Act, jeopardized the security of classified information, and obstructed citizen oversight by frustrating numerous Freedom of Information Act requests. Cause of Action Institute has been following and investigating this matter ever since it was first reported in the New York Times last year.1 A new development in this saga has recently come to our attention. We have learned that some of Mrs. Clinton’s aides and ex-campaign staffers from her 2008 bid for the Democratic nomination for president, who followed her to the United States Department of State (“State Department”), continued to use communication devices and email accounts associated with Mrs. Clinton’s presidential campaign committee during their subsequent employment at the State Department. Former campaign staff used these campaign devices and email accounts to communicate on official channels and co-mingle agency records with their personal communications. -

Although Abramoff’s misconduct is an extremely serious matter to his private clients and to the integrity of - and public confidence in - government, his cooperation and that of others following his and Scanlon’s pleas, has exposed significant misconduct by others in and out of public office and revealed to law enforcement officials and the public the manner and means used by government officials to game the system for private advantage in violation of criminal, regulatory, and ethical laws and rules. In making its recommendation for this sentence reduction for Abramoff, the United States asks the Court to consider the following public information. 1. Abramoff’s substantial assistance was especially important in four convictions. Abramoff deserves substantial credit for the following convictions by guilty plea: • Tony Rudy (former deputy chief of staff to a leader in the U.S. House of Representatives). On March 31, 2006, Rudy pled guilty to a multi-object conspiracy with Abramoff and others to commit honest services fraud, violate his one year lobbying ban, and defraud SPI Spirits and the Saginaw Chippewa each of $25,000, which was used to partially fund the August 2002 golf trip to Scotland. Abramoff was debriefed multiple times regarding Rudy. Among other things, he described how $50,000 paid to Rudy’s wife through a non-profit was really money intended to support Rudy without regard to whether his wife performed any real service for the organization for which she purportedly worked. -

MEMORANDUM OPINION In 2011, the defendant, Fraser Verrusio, the former policy director of the House Transportation Committee, was convicted on three counts relating to his receipt of gifts from Jack Abramoff’s lobbying group. Petitioning for a writ of habeas corpus, pursuant to 28 U.S.C. § 2255, or in the alternative, a writ of coram nobis, pursuant to 28 U.S.C. § 1651, the defendant seeks to vacate his convictions. See generally Def.’s Mot. to Vacate, Set Aside, and Correct Sentence Pursuant to 28 U.S.C. § 2255, or in the Alternative, Petition for a Writ of Error Coram Nobis (“Def.’s Mot.”), ECF No. 162. The defendant primarily argues that his convictions cannot be sustained in the wake of the Supreme Court’s decision in McDonnell v. United States, 136 S. Ct. 2355 (2016). See id. at 1–3. Staffers in the office of former House Majority leader Tom DeLay could dine--usually, free of charge--at Signatures, the expense-account restaurant conveniently owned by lobbyist Jack Abramoff. Then they could sit in his skybox at Washington's MCI Center, home of the NBA Wizards and NHL Capitals. Before too long, recalled a former GOP leadership aide--who, like almost anyone on Capitol Hill these days, declines to be identified talking about his relationship with Abramoff--the DeLay staffers began to think that Abramoff's box at the arena was their box, and, in the cozy way of Washington, it might as well have been. "Jack was sort of like a drug dealer," said the former staffer. "He'd give them [DeLay's staffers] a little taste and then get them hooked." It may be convenient for Hill staffers to think of Abramoff as insidious, subtly corrupting idealistic but naive public servants.
