PLANNING AND GROWTH MANAGEMENT DEPARTMENT

1. APPLICATION TO ALTER 106-116 / 111-113 LOCATED IN THE SPARKS STREET HERITAGE CONSERVATION DISTRICT AND DESIGNATED UNDER PART V OF THE ONTARIO HERITAGE ACT.

REPORT RECOMMENDATIONS

That the Built Heritage Sub -Committee recommend that Planning Committee recommend that Council approve:

1. Demolition of the 1960s building located at 106 Sparks Street, and the rear part of 108-116 Sparks Street, except the front façade, which is to be retained;

2. Construction of a six -storey mixed -use building at 106 - 116 Sparks Street;

3. Restoration of the façade of the building at 108 - 116 Sparks Street;

4. Construction of an 18 -storey tower at 111 -113 Queen Street and its one-storey link to the Sparks Street façade according to plans by Roderick Lahey Architect received by the City of on June 4, 2013;

5. Delegation of authority for minor design changes to the General Manager, Planning and Growth Management Department; and

6. Issuance of the heritage permit with a three -year expiry date from the date of issuance.

(Note: The statutory 90 -day timeline for consideration of this application under the Ontario Heritage Act will expire September 2, 2013.)

(Note: Approval to alter this property under the Ontario Heritage Act must not be construed to meet the requirements for the issuance of a building permit.)

Therefore be it resolved that item 1 – application to alter 106-113 sparks street be deferred to the September meeting of the built heritage sub committee.

That the built heritage sub-committee recommend that the planning committee recommend that council approve:

The issuance of a letter to the national capital commission expressing council's disappointment that in the light of the technical reports filed it appears that the NCC the long term owner of the property is partly responsible for the need to demolish the existing heritage façade due to the lack of effective regular maintenance: essentially demolition by neglect.

The letter should draw the NCC’s attention to the parks Canada “standards and guidelines for the conservation of historic places in Canada” particularly standard #6 which requires that owner “protect”, and if necessary, stabilize an historic place until any subsequent intervention is undertaken”.

2. APPLICATION TO DEMOLISH A DESIGNATED BUILDING AND APPLICATION FOR NEW CONSTRUCTION AT 325 DALHOUSIE STREET, A PROPERTY LOCATED IN THE BYWARD MARKET HERITAGE CONSERVATION DISTRICT AND DESIGNATED UNDER PART V OF THE ONTARIO HERITAGE ACT

REPORT RECOMMENDATIONS

That the Built Heritage Sub -Committee recommend that Planning Committee recommend that Council:

1. Approve the application to demolish 325 Dalhousie Street;

2. Approve the application for new construction at 325 Dalhousie Street in accordance with the final plans by Neuf Architects, outlined in this report and received on June 17, 2013;

3. Delegate authority for minor design changes to the General Manager, Planning and Growth Management Department;

4. Issue the heritage permit with a two -year expiry date from the date of issuance; and

5. Direct Planning and Growth Management staff to include the installation of an interpretive panel as a condition of site plan approval.

(Note: The statutory 90 -day timeline for consideration of this application under the Ontario Heritage Act will expire on September 11, 2013.)

(Note: Approval to alter this property under the Ontario Heritage Act must not be construed to meet the requirements for the issuance of a building permit.)

DECLARATION OF INTEREST

Member Barry Padolsky, declared a potential, direct pecuniary interest on Item 3, Designation of the British American Bank Note Company, 975 Gladstone Avenue, under part IV of the Ontario Heritage Act , as he is the owner of Barry Padolsky Associates Inc., Architects and his firm has been retained to provide professional services in relation to Barry Padolsky Associates Inc., Architects.

Member B. Padolsky did not take part in the discussion or vote on this Item.

Whereas the Canadian Bank Note Company has recently acquired the former British American Bank Note property; and

Whereas the representatives from the Canadian Bank Note Company will not be available to attend the meetings of the Built Heritage Sub-Committee of July 11, 2013 and September 12, 2013;

Therefore Be It Resolved That the Designation of the British American Bank Note Company, 975 Gladstone Avenue, under Part IV of the Ontario Heritage Act be Deferred to the October 10, 2013 Built Heritage Sub- Committee meeting.

That the Built Advisory Subcommittee recommend that Planning Committee recommend that Council:

1. Approve the application to alter Arts Court, 2 Daly Avenue, according to plans by Barry Padolsky and Associates Architects Inc., and Kuwabara, Payne, Mckenna, Blumberg, (KPMB) Architects, in joint venture, in accordance with plans submitted by the City, as owners of the building;

2. Delegate authority for minor design changes to the General Manager, Planning and Growth Management Department; and

3. Issue the heritage permit with a four year expiry date from the date of issuance.

(Note: The statutory 90 -day timeline for consideration of this application under the Ontario Heritage Act will expire on September 9, 2013.)
