VS 343/2020 THE ROAD VEHICLES (CONSTRUCTION AND USE) (POLICE VEHICLES) ORDER 2020 The Secretary of State makes the following Order in exercise of the powers conferred by sections 44(2) and (3) of the Road Traffic Act 19881. Citation, commencement and expiry 1. This Order may be cited as the Road Vehicles (Construction and Use) (Police Vehicles) Order 2020. 2. This Order comes into force on 1 November 2020 and expires on 1 November 2024, with the exception of article 6 which expires on 1 May 2021. Application 3. This Order applies to a relevant vehicle in circumstances where that vehicle is being used— (a) for a policing purpose, or (b) for purposes that are necessary to ensure the continued availability of the vehicle for policing purposes. 4. In article 3, “relevant vehicle” means— (a) any vehicle driven primarily by police officers or police staff and which is used by or on behalf of any of the constabularies in Schedule 1; or (b) any vehicle specified in Schedule 2. Authorisations 5. Subject to article 6 below, where this Order applies to a vehicle, the Road Vehicles (Construction and Use) Regulations 19862 have effect in relation to that vehicle as if the following modifications were made to regulation 109(1): (a) in sub-paragraph (c), the word “or” is omitted; and (b) in sub-paragraph (d), after the word “destination”, the following is inserted— “; (e) about the location of other vehicles; (f) related to the function of video evidence gathering equipment fitted to the vehicle; 1 1988 c. 52; section 44 was amended by paragraph 51 of Schedule 4 to the Road Traffic Act 1991 (c. 40) and by paragraph 103 of Schedule 1(2) to the Infrastructure Act 2015 (c. 7). 2 S.I. 1986/1078. Page 1 of 12 (g) related to the operation, settings and control of approved emergency services communications systems, and the display of symbols used to communicate urgent policing information by such approved emergency services communications systems; (h) related to the function of automatic number plate recognition equipment (“the ANPR system”) fitted to the vehicle, but limited to: (i) a still image of a vehicle (Overview image); (ii) a still image of a number (Plate Patch); (iii) a Vehicle Registration Mark (VRM) as interpreted by the ANPR system; (iv) symbols communicating information as to the location and description of the vehicle, together with the assigned operational priority for a vehicle read by the ANPR system; (v) symbols communicating information relating to the descriptions of any persons of interest associated with a vehicle identified by the ANPR system; (vi) symbols communicating information relating to any warnings associated with a vehicle read by the ANPR system, or any potential occupants thereof; or (i) any other additional information to assist a police officer in the execution of their duties, provided that such additional information cannot be seen by the driver when the speed of the vehicle to which the apparatus is fitted exceeds 7 miles per hour.” 6. Notwithstanding article 5, where this Order applies to a vehicle specified in Schedule 2 on or before 30 April 2021, the Road Vehicles (Construction and Use) Regulations 1986 have effect in relation to that vehicle as if the following modifications were made to regulation 109(1): (a) in sub-paragraph (c), the word “or” is omitted; and (b) in sub-paragraph (d), after the word “destination”, the following is inserted— “; (e) about the location of other vehicles; or (f) to assist a police officer in the execution of their duties.” 7. For the avoidance of doubt, where this Order applies to a vehicle specified in Schedule 2 on or after 1 May 2021, the Road Vehicles (Construction and Use) Regulations 1986 have effect in relation to that vehicle in accordance with article 5 of this Order.
