C. T. EVANS 17th January, 1933 Clerk to the Advisory Council. (Ï./165/33) DRAFT AN ORDINANCE TO AMEND THE SUCCESSION ORDINANCE, 1923. BE IT ENACTED by the High Commissioner for Palestine, with the advice of the Advisory Council thereof:— 1 This Ordinance may be cited as the Succession (Amendment) Short title. 1923־ Ordinance, 1934, and the Succession Ordinance, 1923 (herein• No. 4 of after called the principal Ordinance), the Succession (Amendment) Ordinance, 1932, and this Ordinance, may together be cited as No. 6 of 1932. the Succession Ordinances, 1923-1934. 2. Section 26 of the principal Ordinance shall be amended:— Amendment of section 26 of the (a) by the addition of the words "except an interest regis• principal tered by way of security for money" to the definition of Ordinance. "Miri Land" appearing in paragraph iii thereof; and (b) by the addition of the words "or an interest in miri land registered by way of security for money" to the definition of "Mulk Land" appearing in paragraph iv thereof. OBJECTS AND REASONS. By section 19 of the Succession Ordinance, 1923 (Gazette 1st April, 1923), succession to miri land is in accordance with the provisions of the Ottoman Law set forth in the second schedule to the Ordinance, and section 26 (iii) of the Ordinance defines miri land as including any registered interest in such land. 2. As a mortgage is inter alia a registered interest in miri land, the effect of the Succession Ordinance is that a loan secured on miri land, is for the purposes of succession, treated as miri, and is subject to the law dealing with miri land, whereas a loan secured otherwise is free from such restriction. 3. The object of this amending Ordinance is therefore to remove this anomaly by amending the definition-of "miri land" so as to exclude all interests in such land registered by way of security for money and by making a consequential amendment to the definition of "mulk land".
