16 The Argentinean shipbuilding industry Workers’ struggles in a state shipyard Cintia Russo Introduction The aim of this chapter is to analyse the trajectory and survival of one of the oldest and largest ship repair yards in Argentina – Talleres Dársena Norte (also known as TANDANOR, and today known as Complejo industrial naval argentino, CINAR). I will also identify and analyse stages in the history of the Argentine shipbuilding industry (ASI) to provide context to the two Argentinean shipyards studied in this book. In this sense, I highlight the role played in this path by two social actors, the state and trade unions: the former is a key factor in the trajectory of the ASI, and the struggles of the latter have achieved the shipyard’s survival.1 Founded in 1879, TANDANOR was originally established for the maintenance of the Argentinean naval fleet. TANANDOR/CINAR, with a history of more than a century, has acquired, in the past twenty years, a symbolic status as one of the oldest shipyards in Argentina, and the first to be privatised in 1991, then managed by its workers for nearly a decade, and finally renationalised in 2007. TANDANOR is a representative example of the peaks and troughs of the Argentinean economy. 1 The sources used in these pages are: statistics (national, provincial, and chambers of com- merce), institutional documents, and reports and balance sheets of TANDANOR and the trade associations: the Federation of Industry Naval Argentina (FINA), the Association of Buenos Aires shipbuilding (ABIN). For the diagnosis and proposals of the shipbuilding trade unions, I privileged two sources: key informant interviews and the local press. -

Maritime and Coastguard MARINE GUIDANCE NOTE MGN 477 (M) Amendment 2 Maritime Labour Convention, 2006: Seafarers' Employment Agreements Notice to all shipowners, ship operators and ship managers; employers of seafarers; masters, officers and seafarers on sea-going ships ordinarily engaged in commercial operations. This notice should be read in conjunction with Part 4 of the Merchant Shipping (Maritime Labour Convention) (Minimum Requirements for Seafarers etc.) Regulations 2014. (the “MLC Minimum Requirements Regulations”) This Marine Guidance Note (“MGN”) replaces MGNs 148(M) and 149(M) in respect of those vessels to which the MLC Minimum Requirements Regulations apply. MGN 474(M) replaces MGNs 148(M) and 149(M) in respect of those vessels, not subject to the MLC Minimum Requirements Regulations, which will still require Crew Agreements. Summary • Every seafarer employed on a vessel to which the Merchant Shipping (Maritime Labour Convention) (Minimum Requirements for Seafarers etc.) Regulations 2014 (“the MLC Minimum Requirements Regulations”) apply must have a legally enforceable Seafarer Employment Agreement (an “SEA”). • An SEA must include the minimum information specified in the MLC Minimum Requirements Regulations, set out at Annex 1 to this Notice. • The notice period for termination of an SEA must be at least seven days, and must not be shorter for the shipowner than for the seafarer. • An SEA may consist of more than one document; for example, it may include a Collective Bargaining Agreement. • If an SEA is not in English, an English translation must be provided on board the ship. • A recommended model format for an SEA for an employed seafarer is provided on www.gov.uk, if required. -

CSR SECTORIAL POLICY - SHIPPING 1. Scope The present policy (the « Policy ») applies to all loans and investments and more generally to all Crédit Agricole CIB (the « Bank »)’s operations in connection with maritime industry. Maritime activity as covered by this Policy encompasses: (i) building, repair or dismantling of merchant vessels by Clients of the Bank, (ii) acquisition and operation of merchant vessels by Clients of the Bank. As far as this Policy is concerned, merchant vessels are ships used for transportation of passengers or goods as well as other ships used for a civil or industrial activity such as: - passenger liners 1 - dry cargo ships 2 - tankers 3 - special purpose ships 4 - port or coastal service boats 5 The following categories of ships do not fall under the scope of this Policy, due to their technical specifications and to ad-hoc regulations: - Scientific ships, - Boats intended solely for on-shore operation (waterways, river transport) - Leisure boats - Military ships - Civil or military submarines - Fishing boats - Ice breakers - Oil rigs and drillships - Hydrocarbon floating storage units (FSO, FPSO) Building, operation and management of ports and harbours are not addressed in the Policy. Solely those activities that the Bank would carry out from the Policy issuance date onwards are concerned. Therefore, outstanding commitments as well as activities already documented or in advance stage of negotiation are excluded from the scope of the Policy. This Policy will come up for regular review. 2. Policy stakes and targets The sea covers over 70% of the total surface of our world. EFFECTIVE AS FROM: Date of this Circular 19 th December 2016 1. General The STCW Convention was amended in 2010. As a result it establishes new grades. The aims of this revision are to ensure that STCW standards remain relevant, to improve the standards of professionalism of seafarers and to improve navigational safety, security and protection of marine environment. The newly established grades are as follows: - “Able Seafarer Deck” (STCW Reg. II/5), - “Able Seafarer Engine” (STCW Reg. III/5) - ‘’Electro-Technical Officer” (STCW Reg. III/6), and - “Electro-Technical Rating” (STCW Reg. III/7), All seafarers working on board St. Vincent and the Grenadines vessels should be trained or certified as competent or otherwise qualified to perform their duties It has been noted that some Administrations have not adopted the regulations to issue a Certificate of Proficiencies for the Able Seafarer Deck and for the Able Seafarer Engine. In this respect, the Shipowners, Ship Operators, Managing Companies may find difficulties in employing sufficient Able Seafarers Deck and Able Seafarers Engine. -
