IT 10.2.2015 IT Gazzetta ufficiale dell'Unione europea L 34/1 II (Atti non legislativi) REGOLAMENTI REGOLAMENTO (UE) 2015/180 DELLA COMMISSIONE del 9 febbraio 2015 recante modifica del regolamento (CE) n. 748/2009 relativo all'elenco degli operatori aerei che hanno svolto una delle attività di trasporto aereo che figurano nell'allegato I della direttiva 2003/87/CE del Parlamento europeo e del Consiglio al 1o gennaio 2006 o successivamente a tale data, che specifica lo Stato membro di riferimento di ciascun operatore aereo (Testo rilevante ai fini del SEE) LA COMMISSIONE EUROPEA, visto il trattato sul funzionamento dell'Unione europea, vista la direttiva 2003/87/CE del Parlamento europeo e del Consiglio, del 13 ottobre 2003, che istituisce un sistema per lo scambio di quote di emissioni dei gas a effetto serra nella Comunità e che modifica la direttiva 96/61/CE (1) del Consiglio, in particolare l'articolo 18 bis, paragrafo 3, lettera b), considerando quanto segue: (1) La direttiva 2008/101/CE del Parlamento europeo e del Consiglio (2) ha modificato la direttiva 2003/87/CE al fine di includere le attività di trasporto aereo nel sistema di scambio delle quote di emissioni dei gas a effetto serra dell'Unione. (2) Il regolamento (CE) n. 748/2009 (3) della Commissione stabilisce l'elenco degli operatori aerei che hanno svolto una delle attività di trasporto definite nell'allegato I della direttiva 2003/87/CE al 1o gennaio 2006 o successi­ vamente a tale data. (3) Tale elenco è inteso a ridurre l'onere amministrativo a carico degli operatori aerei indicando quale Stato membro è preposto alla regolamentazione di un determinato operatore aereo. (4) L'inserimento di un operatore aereo nel sistema per lo scambio di quote di emissioni dell'Unione dipende dall'e­ sercizio di un'attività di trasporto aereo di cui all'allegato I della direttiva 2003/87/CE e non è subordinato all'inse­ rimento nell'elenco degli operatori aerei stabilito dalla Commissione in base all'articolo 18 bis, paragrafo 3, di tale direttiva. (5) Per stabilire l'elenco aggiornato degli operatori aerei al fine di includere gli operatori aerei che hanno svolto una delle attività di trasporto aereo che figurano nell'allegato I della direttiva 2003/87/CE nel 2014, la Commissione ha tenuto conto delle dichiarazioni di flotta fornitele dagli operatori aerei e dalle società di servizi. Tuttavia, alcune società di gestione o di servizi e alcuni marchi di registrazione di aeromobili appaiono nell'elenco aggiornato al posto degli operatori aerei a causa della mancanza di informazioni. (6) È opportuno pertanto modificare di conseguenza il regolamento (CE) n. 748/2009, (1) GU L 275 del 25.10.2003, pag. 32. (2) Direttiva 2008/101/CE del Parlamento europeo e del Consiglio, del 19 novembre 2008, che modifica la direttiva 2003/87/CE al fine di includere le attività di trasporto aereo nel sistema comunitario di scambio delle quote di emissioni dei gas a effetto serra (GU L 8 del 13.1.2009, pag. 3). (3) Regolamento (CE) n. 748/2009 della Commissione, del 5 agosto 2009, relativo all'elenco degli operatori aerei che hanno svolto una delle attività di trasporto aereo che figurano nell'allegato I della direttiva 2003/87/CE al 1o gennaio 2006 o successivamente a tale data, che specifica lo Stato membro di riferimento di ciascun operatore aereo (GU L 219 del 22.8.2009, pag. 1).
