Early Working Draft Raw Materials, Creative Works, and Cultural Hierarchies Andrew Gilden In disputes involving creative works, courts increasingly ask whether a preexisting text, image or persona has been used as “raw material” for new authorship. If so, the accused infringer becomes shielded by the fair use doctrine under copyright law or a First Amendment defense under right of publicity law. Although copyright and right of publicity decisions have begun to rely heavily on the concept, neither the case law nor existing scholarship has explored what it actually means to use something as “raw material,” whether this inquiry adequately draws lines between infringing and non- infringing conduct, or how well it maps onto the expressive values that the fair use doctrine and the First Amendment defense aim to capture This Article reveals serious problems with the raw material inquiry. First, a survey of all decisions invoking raw materials uncovers troubling distributional patterns; in nearly every case the winner is the party in the more privileged class, race or gender position. Notwithstanding courts’ assurance that the inquiry is “straightforward,” distinctions between raw and “cooked” materials appear to be structured by a range of social hierarchies operating in the background. Second, these cases express ethically troubling messages about the use and reuse of text, image and likeness. The more offensive, callous and objectionable the appropriation, the more visibly “raw” the preexisting material is likely to be. Given the shortcomings of the raw material inquiry, this Article argues that courts should engage more directly with an accused infringer’s actual creative process and rely less on a formal comparison between the two works in dispute. -

Spencer Pratt made a splash with his villainous performance on The Hills, but since then his career hasn’t work out quite like he had hoped. Instead of writing books, starting a fashion line and producing more TV, Pratt ended up standing by Heidi Montag’s side while she underwent multiple plastic surgeries to turn herself into the world’s saddest living Barbie doll. FAME US INTRODUCTION Brian Howell A while ago, I started taking pictures of celebrity impersonators after a string of chance encounters with look-alikes. When I began researching the subject, I had no idea that so many people made a living at it. I became intrigued, and as a result, this project was born. I attended a number of conventions for the celebrity imper- sonator industry; there are two major gatherings a year: Las Vegas in the spring and Orlando, Florida in the fall. The impersonators are there to showcase their tal- ent and to network with others in the industry; the conventions are like any other, except that on any given day, you might see George W. Bush hamming it up with Ozzy Osbourne, or bump into Marilyn Monroe wearing her dress from The Seven Year Itch, except there is no subway air vent to blow it up to her waist. Impersonation is a full-time career for many of the people who appear in this book. Some of them make a great living at it, including a few who look more like the ce- lebrity they impersonate than the actual celebrity himself. While getting to know them better, I’ve learned that the biggest misconception about impersonators is that they are somehow obsessed fans desperate to physically become the celebrity they impersonate. But I never met anyone like that. On the contrary, many imper- sonators got into the business because of others—those passersby on the street who stop and stare, and ask, “Has anyone ever told you you look like…?” Simply put, and not in a derogatory way, impersonators are opportunistic, taking advan- tage of a culture with an insatiable, uncontrollable thirst for celebrity and all that it entails. -

ME @THE ZOO A FILM BY CHRIS MOUKARBEL AND VALERIE VEATCH ME @THE ZOO A FILM BY CHRIS MOUKARBEL AND VALERIE VEATCH ME @THE ZOO tells the story of Chris Crocker, a video blogger from a small town in Tennessee. Crocker is part of the first generation of kids raised on the Internet, coming of age under constant self- surveillance. His online videos, including the infamous YouTube declaration “Leave Britney Alone!”– have been viewed hundreds of millions of times and have created a worldwide phenomenon. This portrait weaves a tapestry of Internet media with reactions from Crocker fans and haters to examine a new controversial kind of fame: the Internet folk hero. ACQUIRED BY HBO (USA) AND BBC (UK) DIRECTOR’S WORD Like so many others, we first discovered Chris Crocker by being sent early online videos such as “Bitch Please” and “This or That”. The first question we asked was apparently a common one. “Is this real?” Years later we began making a film that asked the same question in a more general sense. We began a documentary about the history and impact of reality televi- sion. As ideas of consciousness shift in lockstep with new technology, “Reality” has become the dominant medium. Our film research took us around the world. We interviewed everyone from the cast of the original Dutch reality show, Hollywood executives and even a Reality TV School. In the end, this hunt for reality brought us to a small town in Tennessee and to Chris Crocker. Crocker was raised in the age of reality where anyone with a camera can become a star. -

Unintentional Dialogues on YouTube 1 Running Head: UNINTENTIONAL DIALOGUES ON YOUTUBE Unintentional Dialogues on YouTube RESEV 554: Semester Project Analysis Memo Laura Bestler Iowa State University December 15, 2008 Unintentional Dialogues on YouTube 2 Introduction The purpose of this video is to illustrate themes within the online user commentary reacting to Chris Crocker’s (2008) YouTube video titled, “Gay HATE on YouTube!” The central question of this study is how users intermittently engage about Lesbian Gay Bisexual Transgender Queer Questioning (LGTBQQ) topics represented on YouTube. The unintentional dialogues between users on YouTube™ are providing additional knowledge to what is happening within today’s society (Noblit, Flores, & Murillo, 2004). Online social networks are a natural place to employ post modern theory due to its playfulness, reflexivity, and the deconstruction of the cyber world (Noblit, Flores, & Murillo, 2004). The research findings demonstrate a connection between time and negative user reactions towards LGBTQQ topics. Why Online? An evolution of the online world has taken place to provide everyone the ability to create content. Social networks provided a way people to connect with friends, family and online social acquaintances. Similar to the offline world, user created content had begun to utilize hate language and expletives to describe people. These degrading interactions provided a catalyst for me to take action. This online social laboratory can be brought to light, deconstructed and transcended. Therefore, helping people understand their actions are broader than snippet commented online. These unintentional dialogues are broadcast around the world. The internet is an environment where people’s small gestures may become large, and it is a mirror or lens of the world around them (Popkin, 2008). -

BODY TYPE: TYPOGRAPHIC TATTOOS or HOW I BECAME A TATTOO EXPERT WITHOUT REALLY TRYING By Ina Saltz, author of “Body Type: Intimate Messages Etched in Flesh” (Abrams Image, 2006) MY INVOLVEMENT WITH THE WORLD OF TATTOOS began in the most unlikely of ways. I was traveling cross-town on the M86 bus when I spotted an interesting-looking young man with a large text-only tattoo on his right forearm; it spelled out “happy” in a typeface which I instantly recognized as Helvetica. The fact that it was in lower-case letters and so tightly kerned that the letters were touching was especially intriguing to me as a designer and a typophile. I had never seen a tattoo quite like this one—sans serif! Not being in the habit of talking to strangers in New York City, I debated mightily before approaching him...but my curiosity finally got the better of me. “Are you a graphic designer?” I asked. Why, yes, he was. “And would you mind if I took a photo of your tattoo to show my students? I teach typography at City College.” No problem. I whipped out my digital camera and managed to get one shot and to grab his proffered business card before I jumped off at my stop. That evening I uploaded the photo and went to the Web site on his business card to send him the image with a proper thank you message. Imagine my astonishment to find our entire conversation recounted on his blog! As often happens when encountering something new, having seen one typographic tattoo, I now started to see them everywhere (it was August and a lot of skin was visible). -

After all, I went through my own rite of passage and gained access to the crazy, sensational celebrity world. But I thought to myself, “Why should I have all the fun?” Like Paris, I’d like to make this world a hotter place. So this book, my friends, was writ- ten for you. In these pages, I’ll show you what it takes to reach celebrity status, and how, with a few wobbly steps and a case of Astroglide, you too can be a hilton! I don’t mean that you should be a street-corner whore (but you’re definitely getting warmer!). No, what I mean is, you can live like the rich, famous, and utterly depraved without even an ounce of talent or dignity. Tired Reid is a good example of a hilton success story. I can’t even remember the last real work she’s done. After all those horrible movies, train-wreck media appearances, and documented drunken partying, you’d think she’d be banned from Hollywood forever. But somehow she still finds her way into magazines and is even popular in Australia! How can someone who’s made suicide moves to her “career”—on the red carpet, no less—still get attention? It’s because she be- longs to the Hilton generation of Hollywood, and for these hiltons, scandalous behavior is actually not a suicide attempt at all.
