76 Hon. Walter Forward HON. WALTER FORWARD Robert M. Ewing "No purer man ever wore the judicial ermine, and Allegheny County never had a more worthy representa- tive." In these words the late Erasmus Wilson, "The Quiet Observer," summed up his estimate of Walter Forward, (1) and in this paper we shall endeavor to point out some of the events of his life, characteristics and public ser- vice, that appear to fully warrant the tribute thus paid to his memory. He was born at Old Granby, near Hartford, Connect- icut, now the town of East Granby on January 24th, 1786, the son of Samuel and Susannah Holcombe Forward. His great-grandfather, Samuel Forward, in the early days came from England and settled in Windsor, Connecticut. Young Walter was raised on a farm in Old Granby, and when about fourteen years of age, about 1800, his par- ents moved to Aurora, Ohio, a short distance southeast of Cleveland. We are told that the boy Walter drove his father's team on that long journey. In this new envi- ronment he worked on his father's farm for three years, during which time his spare moments were devoted to reading and study, and in teaching for a time a night school. (2) He evidently had a fixed purpose to study law, and it is said that one of the books he first purchased, out of his meager earnings, was a volume of Blackstone's Com- mentaries. When and how his purpose to study law was implanted in him we do not know, but in furtherance of this purpose sometime in 1803 he packed up a few be- longings—only scant and necessary wearing apparel — and started out on foot for Pittsburgh, then a city of less than five thousand inhabitants. -

WALTER FORWARD IN THE PENNSYLVANIA CONSTITUTIONAL CONVENTION OF 1837-38 FRANK B. SESSA 1 constitutional convention of 1837-38 was held in Pennsylvania'sdays of political controversy as bitter as that of today. The question of the constitutionality and advisability of creating numerous governmental agencies, conveniently designated by triads of letters from the alphabet, didnot arise, but opinion was certainly quite as sharply divided over Jack- son's attack on the second United States Bank. Although the question of holding such a convention fared better at the hands of the electorate than did a similar, quite recent attempt inPennsylvania, the result to all intents and purposes was the same, for the convention accomplished little ornoth- ingafter several months of deliberation. The Jacksonian Democrats chose as one of their delegates Walter Forward, a native New Englander, who had come to Pittsburgh inhis youth by way of Aurora County, Ohio. Forward had studied law with Henry Baldwin, one of the city's most prominent attorneys, and in com- pany withBaldwin and Tarleton Bates had acted as one of the directors of the editorial policy of the Tree of Liberty, Pittsburgh's second news- paper. Subsequently Forward had served in the General Assembly of Pennsylvania and in Congress although he had been defeated on two separate occasions for re-election to the national House of Representa- tives. Despite the thwarting of his legislative ambitions Forward remained active in Pittsburgh civic life and had a great many friends in the sur- rounding counties. It was not strange, then, that the Democrats should choose him as one of their delegates to the constitutional convention due to meet on May 2, 1837. -

OFFICERS OF THE EXECUTIVE BRANCH OF THE GOVERNMENT [ 1 ] EXPLANATORY NOTE A Cabinet officer is not appointed for a fixed term and does not necessarily go out of office with the President who made the appointment. While it is customary to tender one’s resignation at the time a change of administration takes place, officers remain formally at the head of their department until a successor is appointed. Subordinates acting temporarily as heads of departments are not con- sidered Cabinet officers, and in the earlier period of the Nation’s history not all Cabinet officers were heads of executive departments. The names of all those exercising the duties and bearing the respon- sibilities of the executive departments, together with the period of service, are incorporated in the lists that follow. The dates immediately following the names of executive officers are those upon which commis- sions were issued, unless otherwise specifically noted. Where periods of time are indicated by dates as, for instance, March 4, 1793, to March 3, 1797, both such dates are included as portions of the time period. On occasions when there was a vacancy in the Vice Presidency, the President pro tem- pore is listed as the presiding officer of the Senate. The Twentieth Amendment to the Constitution (effective Oct. 15, 1933) changed the terms of the President and Vice President to end at noon on the 20th day of January and the terms of Senators and Representatives to end at noon on the 3d day of January when the terms of their successors shall begin. On 23 February 1843, Secretary of the Treasury Walter Forward wrote to the Honorable John White, Speaker for the House of Representatives, responding to public criticisms of the Treasury’s management of the United States Light-House Establishment. In his letter, Secretary Forward argued, “it has been impossible to guard against all abuses. These necessarily result from the existing defects in the system and must not be readily imputed to mismanagement of the Department.”1 Historians of the Light-House Establishment, however, have failed to acknowledge the secretary’s comments or the system under which the Treasury managed the nation’s coastal beacons. Early Pittsburgh Lawyers and the Frontiers of Argument and Dissent
EARLY PITTSBURGH LAWYERS AND THE FRONTIERS OF ARGUMENT AND DISSENT Ron Schuler* ABSTRACT Pittsburgh, during the period from 1788 through the 1840s, was a city on the frontier of the American Republic. Amid the privations and risks of living in the frontier, the political discourse of the early lawyers of the bar Pittsburgh often concerned itself with questions of self-determination and dissent from the establishment. The methods of argument and dissent by Pittsburgh’s early lawyers also reflected the harshness of life on the frontier, as seen in such episodes as the Whiskey Rebellion, the impeachment of Judge Alexander Addison, and the duel between Tarleton Bates and Ephraim Pentland. Henry Baldwin, a Pittsburgh lawyer who had participated in his own duel as well as being a key player in the Bates- Pentland affair, was appointed to the United States Supreme Court in 1830, and as an associate justice he played a key role in creating the institution of the dissenting opinion on the Court—a fact which may be seen within this context as a frontier influence on American jurisprudence. The end of the early bar and its concerns with dissent coincides with the Civil War, in which 115 Allegheny County lawyers—many of them middle-aged with lucrative practices in full bloom—risked life and limb to preserve order within the Republic. * Managing Member of the Pittsburgh office of Spilman, Thomas & Battle, PLLC. The 1967 Research Conference at Boiling Springs and Harrisburg
THE 1967 RESEARCH CONFERENCE AT BOILING SPRINGS AND HARRISBURG BY GAIL M. GIBSON N THE spring of 1966, a conference on "Research Needs anc "Opportunities in Pennsylvania History" was sponsored by the Pennsylvania Historical and Museum Commission and the Re- search Committee of the Pennsylvania Historical Association. So many possible fields of investigation were suggested that the sponsoring groups felt the need for a second conference to analyze in depth a few selected topics. Such a conference was held on the weekend of April 7-8, 1967, with Friday sessions at the hotel at Allenberry on the Yellow Breeches, near Boiling Springs, and Saturday sessions at the William Penn Memorial Museum and Archives Building in Harrisburg. Dr. Alfred D. Sumberg, of East Stroudsburg State College, presided. The three fields selected for concentration were: the economic history of Pennsylvania from 1790 to 1900; political development of the Commonwealth from 1840 to 1900; and the historian's perennial problem of finding a publisher. Professor Philip S. Klein, of the Pennsylvania State Univer- sity, served as chairman of the economic history session on Friday afternoon. In his introductory remarks, he noted that Pennsyl- vania's political history had received considerable attention from scholars in the past twenty years, and that perhaps it was time to shift to an emphasis upon economic history. Among the topics to be investigated would be the flow of capital over the political boundaries of New Jersey, New York, and Pennsylvania, in a sectional study such as was suggested by Roy F. Nichols in his article, "Has the History of the Middle States Been Neglected?" (Peclisylvania History, II (1935), 99-103). -

Besides original manuscripts by the presidents, there are books written by them, as well as printed material about them and their campaigns. There is also a section at the end about the presidency in the abstract, most notably a certified manuscript copy of the 12th Amend- ment of 1804, altering the manner of presidential elections. Within the catalogue, material is organized chronologically, president by president. While all but the most modern presidents are represented, the overwhelming emphasis here is on the first three.
