Landfill Disposals Tax Enquiry , File Type Freedom of Information Officer Welsh Revenue Authority PO Box 110, Pontypridd CF37 9EH 2 July 2018 Dear WRA/FOI/0001 – Landfill Disposals Tax Enquiry I am writing to you on behalf of the Welsh Revenue Authority (WRA) in response to your request for information around Landfill Disposals Tax, which I received on 7 June 2018. I initially issued a letter of response to acknowledge your email & letter on 12 June 2018 and to confirm I would respond to the request. To recap on your original information request, you asked: 1. is Garth Isaf Farm (Efail Isaf, CF38 1SN) a Landfill site regulated by Natural Resources Wales? If not why not? 2. has this site been registered with the WRA? 3. is Landfill Tax and Landfill Disposals Tax payable on the material that has been deposited on the site? If not why not? 4. is the activity of depositing material on Garth Isaf farm compatible with the Rhondda Cynon Taff Local Development Plan (LDP)? If so how is it compatible with the plan? 5. has there been any communication between the WRA and Rhondda Cynon Taf CBC and Natural Resources Wales in relation to this site? Question 1: is Garth Isaf Farm (Efail Isaf, CF38 1SN) a Landfill site regulated by Natural Resources Wales? If not why not? Having considered the information available, I have decided that information is exempt from disclosure under section 44 of the Freedom of Information Act and is therefore withheld. This is on the basis that the information is confidential taxpayer information and is prohibited from being disclosed under section 17 of the Tax Collection Management (Wales) Act 2016. Landfill sites are regulated by Natural Resources Wales and I understand that you have written separately to that body concerning this request for information. Question 2: has this site been registered with the WRA? Please see Annex 1 for a copy of the information we have published on our website. I have also provided some background information in Annex 2 on when a site should be registered with the WRA for Landfill Disposals Tax. Question 3: is Landfill Tax and Landfill Disposals Tax payable on the material that has been deposited on the site? If not why not? Information concerning Landfill Tax is not held by the Welsh Revenue Authority (WRA). Landfill Tax was administered by the HMRC in Wales prior to the introduction of Landfill Disposals Tax, which replaced Landfill Tax, as of 1 April 2018. Having considered the information available, I have decided that information is exempt from disclosure under section 44 of the Freedom of Information Act and is therefore withheld. This is on the basis that any such information is classed as confidential taxpayer information and is prohibited from being disclosed under section 17 of the Tax Collection Management (Wales) Act 2016. By way of background, I attach at Annex 2, an overview of Landfill Disposals Tax which provides details of how the tax works and in what circumstances someone might be liable to pay the tax. Question 4: is the activity of depositing material on Garth Isaf farm compatible with the Rhondda Cynon Taff Local Development Plan (LDP)? If so how is it compatible with the plan? Having considered the information available, I have decided that information is exempt from disclosure under section 44 of the Freedom of Information Act and is therefore withheld. This is on the basis that the information is confidential taxpayer information and is therefore prohibited from being disclosed under section 17 of the Tax Collection Management (Wales) Act 2016. Question 5: has there been any communication between the WRA and Rhondda Cynon Taf CBC and Natural Resources Wales in relation to this site? The application area covers the existing permitted waste disposal site. The nearest occupied residential properties to the site are Valley View 200 metres to the north west and Bryn Posteg Farm and Maes Socyn 350 metres and 370 metres to the west and south west of the site. A small number of other rural properites are located at distances in excess of 500 metres from the site.
